Article 7 The administrative departments in charge of construction in the three districts of the city are responsible for the bidding management of engineering construction within the scale limit of 6.5438+0 million yuan in this district, and the administrative departments in charge of construction in Tuzuoqi, Tuoxian and Suburb are responsible for the bidding management of engineering construction within the scale limit of 2 million yuan in this district, conscientiously implement the bidding documents of the administrative departments in charge of construction at higher levels, and perform the corresponding duties in Item (3) to Item (10) of Article 6 above. Chapter III Bidding Article 8 According to the principle of owner responsibility system for construction projects, the project construction unit, as the investment owner and owner, enjoys the following rights:
1. Organize tendering and bidding activities under the guidance of the superior administrative department of tendering and bidding according to the relevant procedures;
Second, according to the qualification standards stipulated by the government, properly select and determine the tendering units;
Three, according to the relevant principles of bid evaluation and price management regulations, select the winning price and winning unit. Article 9 A project construction unit shall meet the following conditions when bidding:
1. is a legal person and other organizations established according to law;
Two, there are economic and technical management personnel corresponding to the bidding project;
Third, the ability to organize the preparation of bidding documents;
Four, have the ability to review the qualifications of bidders;
5. Ability to organize bid opening, bid evaluation and bid selection.
Do not have the above two to five conditions, must entrust qualified consulting, supervision and other units for bidding. Tenth construction project bidding shall meet the following conditions:
First, the construction project budget has been approved and included in the annual fixed assets investment plan of the country, region or department;
Two, the construction funds have been implemented, and the main building materials and equipment can meet the needs of continuous construction;
Three, there are construction drawings and technical data that can meet the needs of construction;
Four, the construction land has been requisitioned, the demolition work has been completed, the construction site water, electricity, roads and other construction conditions have been met, or included in the scope of construction bidding;
Five, a construction permit issued by the land and planning departments. Eleventh construction bidding can adopt the whole project bidding, unit project bidding, special professional project bidding and other ways. However, it is not allowed to bid for the division and sub-project of the unit project, nor is it allowed to decompose some components and parts and some building materials from the winning project for self-purchase construction. Twelfth construction bidding adopts the following methods:
First, the public bidding, by the tender unit through newspapers, radio, television and other means to issue a tender announcement;
2. Invitation to bid: The tenderee shall issue invitations to bid to more than three (including three) construction enterprises that undertake the construction capacity of the project;
Third, negotiation, for special projects that are not suitable for public bidding or invitation to bid, they should be approved by the bidding department of the city or district, flag or county and agree to participate in the negotiation with the project construction unit. Under normal circumstances, there should be no less than two construction enterprises. Thirteenth construction bidding procedures;
First, the project construction unit shall organize a bidding team that meets the requirements of Article 9 of these Rules;
Second, the project construction unit shall submit the bidding application to the construction bidding office (see attached table 1).
Three, the project construction unit to prepare the tender documents, in order to conditional preparation of pre-tender estimate (see table 3).
Four, the project construction unit issued a tender notice or invitation to bid (see table two);
Five, the construction enterprise to apply for bidding;
Six, the qualification examination of bidding construction enterprises, and inform the applicant of the results of the examination;
Seven, to the qualified bidding construction enterprises issued bidding documents and design drawings, technical data;
Eight, organize bidding construction enterprises to visit the site, and answer questions on the bidding documents;
Nine, the establishment of bid evaluation organizations, invite relevant departments to participate in the formulation of bid evaluation and calibration methods;
Ten, the bid opening meeting, review the bidding documents, specific evaluation, determine the winning bidder;
Eleven, issued a letter of acceptance; (See Table 5)
Twelve, the construction unit and the winning bidder to sign a contract, the contract signing should be completed within fifteen days after the bid-winning notice.
The contract shall be reported to the bidding management department for the record.
