Housing and urban and rural construction, planning, real estate management, land and resources, development and reform, public security, commerce, industry and commerce administration, environmental protection, economy and information technology, tourism, confidentiality and other departments, within the scope of their respective duties, cooperate with the state security organs to do a good job in the management of construction projects involving national security matters. Article 4 Citizens, legal persons and other organizations shall support and assist the state security organs in the management of construction projects involving state security matters. Article 5 The following construction projects involving national security matters shall be submitted by the construction unit to the state security organ for examination and approval:
(1) Construction projects in security control zones around important state organs, key scientific research units, military facilities and military units;
(2) Construction projects of international airports, railway stations, customs, important mail processing places and communication hubs;
(3) Construction projects invested by overseas organizations, institutions, individuals and foreign-invested enterprises;
(four) other construction projects involving national security matters as stipulated by the state.
The scope of the security control zone around important state organs, key scientific research units, military facilities and military units shall be delineated by the provincial people's government. Sixth housing and urban and rural construction, planning, real estate management, land and resources, development and reform, commerce, environmental protection, economy and information technology departments shall inform the construction unit in writing when examining and approving matters involving national security. After examination and approval by the state security organs, the relevant departments may accept the application of the construction unit. Article 7 State security organs shall examine the following contents of construction projects involving matters of national security:
(1) site selection and utilization;
(two) the planning and design of national security technology prevention facilities;
(three) the design scheme of intelligent integrated system and overseas satellite ground receiving facilities;
(4) Other contents that shall be examined in matters involving national security as stipulated by the state. Article 8 The state security organ shall make a decision of approval or disapproval within seven days from the date of receiving the application materials. In line with the requirements of national security matters, issue examination and approval opinions; Matters that do not meet the requirements of national security shall not be approved, and the applicant shall be notified in writing and the reasons shall be explained. Due to special circumstances, it is impossible to make a review decision within the specified time. With the approval of the principal responsible person of the state security organ at the same level, it may be extended for ten days, and the applicant shall be informed. Article 9 Where the state security organ proposes to take technical preventive measures for a construction project involving national security matters, the construction unit shall take the national security technical preventive facilities as an integral part of the construction project, design and construct them in a unified way, and the required expenses shall be included in the budget of the construction project.
The construction unit or the user unit shall ensure the normal operation of the national security technology prevention facilities, and shall not damage, dismantle or stop using them without authorization. Article 10 After the completion of a construction project involving national security matters, the construction unit shall report it to the state security organ for acceptance. Those who fail to pass the acceptance shall not be put into use. Article 11 Where a unit or individual rents, sells, donates or otherwise provides buildings to overseas organizations, institutions, individuals and foreign-invested enterprises for use, it shall go through the relevant formalities within the safety control zone designated by the provincial people's government only after the approval of the state security organ; Outside the safety control zone designated by the provincial people's government, it shall be reported to the state security organ for the record. Article 12 After a construction project involving national security matters is put into use, the user shall sign a letter of responsibility for safeguarding national security with the state security organ to assist and cooperate with the work of the state security organ. Thirteenth in violation of the provisions of this Ordinance, without the approval of the state security organs, unauthorized construction or unauthorized construction without the approval of the state security organs, the state security organs shall order it to make corrections within a time limit; Refuses to correct, shall be ordered to stop construction, and impose a fine of less than four percent of the direct cost of the project; If it poses a serious threat to national security, it shall be ordered to change its use or dismantle it within a time limit. Fourteenth in violation of the provisions of this Ordinance, one of the following acts, the state security organs shall be ordered to make corrections within a time limit; Refuses to correct, punishable by a fine of ten thousand yuan and fifty thousand yuan:
(a) damage, unauthorized removal or stop using the national security technology prevention facilities;
(two) after the completion of a construction project involving national security matters, it is put into use without reporting to the state security organ for acceptance or failing to pass the acceptance;
(three) without the approval of the state security organs, the buildings (structures) in the security control zone designated by the provincial people's government are rented, sold, donated or otherwise provided to overseas organizations, institutions, individuals and foreign-invested enterprises for use;
(4) Renting, selling, donating or otherwise providing buildings (structures) outside the safety control zone designated by the provincial people's government to overseas organizations, institutions, individuals and foreign-invested enterprises for use, without filing with the state security organ.
