Unfortunately, there is no provision for the crime of violent assaulting a police officer in the current law, but only one crime of obstructing official duties. According to Article 277 of the Criminal Law, whoever obstructs a state functionary from performing his duties according to law by violence or threats shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or a fine.
In the case of violent assaulting a police officer in Huai 'an, Jiangsu Province, Ma's actions were in line with the crime of nuisance of official duties, and because he killed two policemen, Wang Tao and An, he also committed the crime of intentional injury. In the crime of intentional injury, whoever intentionally hurts another person's body by particularly cruel means, causing death or serious disability, shall be sentenced to fixed-term imprisonment of not less than seven years, life imprisonment or death.
