Interim Measures for Safety and Quality Management of Urban Rail Transit Engineering
Chapter I General Provisions
Article 1 These Measures are formulated in order to strengthen the safety and quality management of urban rail transit projects and ensure the safety of people's lives and property.
Article 2 These Measures must be observed in the activities related to the construction, expansion and reconstruction of urban rail transit in People's Republic of China (PRC), and in the supervision and management of the safety and quality of urban rail transit projects.
Article 3 To engage in the construction activities of urban rail transit projects, we must adhere to the principle of first survey, then design and then construction, strictly implement the basic construction procedures, ensure the reasonable construction period and cost in each stage, and strengthen the safety, quality and risk management in the whole process.
Article 4 The competent department of housing and urban and rural construction in the State Council shall be responsible for the supervision and management of the safety and quality of urban rail transit projects throughout the country.
The competent department of the local people's government at or above the county level responsible for the safety and quality supervision and management of urban rail transit projects (hereinafter referred to as the construction competent department) is responsible for the supervision and management of the safety and quality of urban rail transit projects within their respective administrative areas.
Chapter II Safety and Quality Responsibility of Construction Units
Article 5 The construction unit shall be fully responsible for the project management.
The construction unit must establish and improve the safety and quality responsibility system and management system, set up safety and quality management institutions, and equip safety and quality management personnel suitable for the construction scale to manage the safety and quality performance of the survey, design, construction, supervision and monitoring units.
Article 6 The construction unit shall, in the preliminary design stage, organize the safety and quality risk assessment of urban rail transit project (including the impact assessment of construction period and cost on the safety and quality of the project) and organize experts to demonstrate, and at the same time, organize experts to conduct special demonstrations such as earthquake resistance and wind resistance in accordance with relevant regulations.
When submitting the preliminary design documents for review, the construction unit shall submit the safety and quality risk assessment report demonstrated by experts.
Article 7 The construction unit shall provide meteorological and hydrological data, engineering geological and hydrogeological data, buildings and structures, underground pipelines, bridges, tunnels, roads and rail transit facilities to the design, construction, supervision and monitoring units. The relevant departments or units shall support and cooperate with the construction unit in organizing the investigation of the relevant materials mentioned in the preceding paragraph due to the needs of the project.

Article 9 The construction unit shall submit the construction drawing design documents (including survey documents) to a qualified construction drawing review institution for review.
Construction drawings and design documents that have not been examined or are unqualified shall not be used.
Tenth construction units shall go through the safety and quality supervision procedures in accordance with the provisions.
Eleventh construction units should promptly organize survey units to disclose survey documents to design units, and organize survey and design units to disclose survey and design documents to construction, supervision and monitoring units before construction.
The disclosure of survey and design documents shall focus on the contents related to the safety and quality of the project in the survey and design documents, and form a written record, which shall be signed and sealed by all parties.
Twelfth construction units shall entrust engineering monitoring units and quality inspection units to carry out third-party monitoring and quality inspection.
Thirteenth in the preparation of the project budget, the construction unit shall include the safety and quality risk assessment fee, the project monitoring fee, the project surrounding environment investigation fee and the current situation assessment fee, and other expenses required to ensure the safety and quality of the project.

The expert argumentation report shall be used as the basis for compiling the tender documents.
Fifteenth construction units shall implement the provisions of the state on survey and design fees, supervision fees, etc. , shall not express or imply that the survey, design, construction, supervision and monitoring units bid at a price lower than the cost or government guidance price.
The construction unit shall scientifically determine the time limit for each stage of survey, design and construction, and shall not arbitrarily compress the time limit agreed in the contract.
If the contractor is forced to bid at a price lower than the cost or the government-guided price, or the construction period agreed in the contract is arbitrarily shortened, resulting in safety and quality accidents, the construction unit shall bear corresponding responsibilities.
Sixteenth construction units in the preparation of the bill of quantities, safety measures should be listed separately, the construction unit shall not be deleted when bidding.
The construction unit and the construction unit shall specify the cost of safety measures, as well as the terms of advance payment, payment plan, use requirements and adjustment methods in the construction contract.
The construction unit shall timely allocate the cost of safety measures to the construction unit in accordance with the contract.
Article 17 The construction unit shall organize the property right unit or management unit of underground pipeline to make on-site disclosure to the construction unit before construction, and form a written record, which shall be signed and sealed by all parties.
Eighteenth construction units shall organize the trial operation without passengers after the completion of the project. After three months of trial operation, the project completion acceptance can be carried out according to relevant regulations, and the project completion acceptance filing procedures can be handled.
Chapter III Safety and Quality Responsibility of Survey and Design Units
Nineteenth survey and design units engaged in urban rail transit engineering survey and design business must have corresponding qualifications, and may not subcontract or illegally subcontract the contracted engineering survey and design business.
Twentieth survey and design units shall be responsible for the safety and quality of the project.
The main person in charge of the survey and design unit is fully responsible for the safety and quality of the survey and design of the unit.
The person in charge of the project shall have the corresponding professional qualifications and experience in urban rail transit engineering survey and design. The person in charge of the project is responsible for the safety and quality of the survey and design of the project undertaken.
Employees engaged in engineering survey and design shall be responsible for the survey and design documents signed by them.
Twenty-first survey and design units must establish and improve the safety and quality responsibility system and management system, set up or clarify the safety and quality management institutions, and manage the safety and quality of engineering survey and design.
Field investigation shall strictly implement the investigation scheme, operating rules and relevant provisions on safety production, and take measures to protect underground pipelines and underground structures within the scope of investigation to ensure the safety and quality of field work.

Twenty-second survey units do not have the survey conditions at the survey site, it shall notify the construction unit in writing, and explain the situation in the survey documents, and put forward reasonable suggestions. After the on-site investigation conditions are met, the investigation shall be carried out in time.
If the engineering design and construction conditions change, the construction unit shall promptly entrust the survey unit to carry out supplementary survey.
Article 23 The survey documents submitted by the survey unit shall be true, accurate and reliable, meet the requirements of survey depth stipulated by the state, meet the needs of design and construction, clearly explain the engineering risks that may be caused by geological conditions in combination with the engineering characteristics, and put forward special survey suggestions for special geological conditions when necessary.
Article 24 The design documents submitted by the design unit shall meet the design depth requirements stipulated by the state, and put forward design treatment measures according to the evaluation report on the present situation of the surrounding environment of the project, and carry out special design when necessary.
The design documents shall indicate the key parts and links related to the safety and quality of the project, and put forward the design treatment measures to ensure the safety and quality of the project.
The construction drawing design shall include the monitoring requirements and monitoring control standards of the project and its surrounding environment.
Twenty-fifth design units shall organize experts to demonstrate the design scheme of high-risk projects and the monitoring and control standards for the surrounding environment of the projects determined by the safety and quality risk assessment.
Twenty-sixth engineering design conditions change, the design unit shall timely change the construction drawing design. Major changes in the design of construction drawings shall be re-submitted for approval according to relevant regulations.
Twenty-seventh survey and design units shall file survey and design documents and original data.
Twenty-eighth survey and design units shall appoint professional and technical personnel to cooperate with the construction unit to solve the relevant problems in the survey and design work in a timely manner.
Chapter IV Safety and Quality Responsibility of Construction Units
Twenty-ninth construction units engaged in urban rail transit engineering construction activities must have corresponding qualifications and obtain safety production licenses according to law, and may not subcontract or illegally subcontract.
Thirtieth the construction unit is responsible for the construction safety and quality of the project.
The main person in charge of the construction unit is fully responsible for the construction safety and quality of the unit, and the project leader is responsible for the construction safety and quality of the project undertaken.
The main person in charge of the construction unit, the person in charge of the project and the full-time safety production management personnel shall obtain the safety production assessment certificate according to law. The person in charge of the project shall have corresponding professional qualifications and experience in the construction and management of urban rail transit projects. Construction special operations personnel should hold relevant certificates.
Thirty-first construction units must establish and improve the safety and quality responsibility system and management system, and strengthen the management of the construction site by the project management organization.
The specialty and quantity of project safety and quality management personnel shall comply with relevant regulations and meet the needs of project management.
Article 32 The project leader of a construction unit shall not hold a post in a project in principle. If it is really necessary to hold a post in other projects, the written consent of the construction unit shall be obtained.
Thirty-third construction general contracting units shall be fully responsible for the safety in production on the construction site.
If the general contractor subcontracts the project to a professional subcontracting unit according to law, the professional subcontracting contract shall specify their respective safety responsibilities. The general contractor and professional subcontractors shall bear joint and several responsibilities for the safety production of professional subcontracting projects.
If the general contractor and the specialized subcontractors subcontract labor services according to law, the general contractor and the specialized subcontractors shall manage the labor services.
Thirty-fourth construction units shall, in accordance with the requirements of the construction period agreed in the contract, formulate a reasonable construction progress plan, and shall not blindly catch up with the progress and the construction period.
The construction unit shall not bid at a price lower than the cost.
Thirty-fifth construction units should use the safety measures for the purchase and renewal of construction safety protection supplies and facilities, the implementation of safety construction measures, and the improvement of safety production conditions. , shall not be used for other purposes.
Article 36 The construction unit shall inspect the surrounding environment of the project. If the present situation of the surrounding environment of the project is inconsistent with the information provided by the construction unit, the construction unit shall organize relevant units to supplement and improve it in time.
Thirty-seventh construction units shall, in accordance with the relevant provisions, prepare special construction plans for sub-projects with greater risks (including sub-projects that may cause serious damage to the surrounding environment of the project, the same below). Experts should be organized to demonstrate the special construction scheme for the dangerous sub-projects exceeding a certain scale.
The special construction scheme shall be prepared according to the design treatment measures, special design and the actual situation of the project, and shall be implemented after being signed by the technical director of the construction unit and the chief supervision engineer, and shall not be changed at will.
Thirty-eighth before the project construction, the project technical personnel of the construction unit shall explain the technical requirements related to construction safety and quality to the construction team and operators in detail, and shall be signed by both parties for confirmation.
Article 39 The construction unit shall designate special personnel to protect the underground pipelines and underground structures on the construction site, explain the basic situation of underground pipelines and underground structures, corresponding protection and emergency measures to the construction team and operators in detail before construction, and set up obvious signs on the site.
Fortieth construction units shall conduct construction monitoring, safety inspection and comprehensive analysis on the supporting structure, surrounding rock and surrounding environment of the project, and timely feed back monitoring data and inspection information to the design and supervision units. If any abnormality is found, the construction, design, supervision and other units shall be notified in time, and corresponding measures shall be taken.
The construction unit shall prepare the construction monitoring plan according to the design requirements and the actual project, and implement it after being audited by the supervision unit.
Article 41 The construction unit shall carry out the construction in accordance with the construction drawing design documents and construction technical standards, implement the design treatment measures proposed in the design documents, ensure the safety and quality of the project, and shall not modify the project design or cut corners without authorization.
The construction unit shall, in accordance with the provisions and the contract, inspect the building materials, building components and equipment. Without inspection or unqualified inspection, it shall not be used.
For test blocks, test pieces and related materials related to structural safety, the construction unit shall, under the witness of the supervision unit, conduct on-site sampling in accordance with the regulations and send them to quality inspection units with corresponding qualifications for quality inspection.
Forty-second after the installation of construction hoisting machinery, the construction unit shall entrust a testing and inspection institution with corresponding qualifications for inspection, and can only use it after passing the inspection.
The construction unit shall, in accordance with the provisions, go through the registration procedures for the use of construction hoisting machinery with the competent department of construction where the project is located.
Forty-third construction units shall, in accordance with the relevant provisions, conduct safety and quality education and training for managers and operators, and the education and training shall be recorded in personal work files. Those who fail the education and training examination shall not take up their posts.
Forty-fourth construction units shall, in accordance with the provisions, do a good job in the collection, sorting and filing of safety and quality data to ensure the authenticity and integrity of safety and quality documents.
Forty-fifth when the construction unit submits the project completion acceptance report, it shall issue a quality warranty to the construction unit, specifying the warranty scope, warranty period and warranty responsibility. The warranty scope and warranty period shall comply with the relevant provisions of the state.
Chapter V Safety and Quality Responsibility of Supervision Units
Forty-sixth supervision units engaged in urban rail transit engineering supervision business must have corresponding qualifications and may not transfer the engineering supervision business undertaken.
The supervision unit shall not have affiliation or other interests with the construction unit of the supervised project and the suppliers of building materials, building components and equipment.
Forty-seventh supervision units shall be responsible for the safety and quality of the project. The main person in charge of the supervision unit is fully responsible for the supervision work of the unit. The project chief supervision engineer is responsible for the safety and quality supervision of the project undertaken.
The project chief supervision engineer should have the professional qualification of registered supervision engineer and the supervision experience of urban rail transit engineering.
Forty-eighth supervision units must establish and improve the safety and quality responsibility system and management system, and strengthen the management of project supervision institutions on the construction site.
The specialty and quantity of project supervision personnel should meet the needs of supervision work.
Forty-ninth project chief supervision engineer in principle in a project, it is really necessary to work in other projects, it shall obtain the written consent of the construction unit.
Fiftieth supervision units shall prepare a project supervision plan including the contents of project safety and quality supervision, and formulate detailed rules for the implementation of special safety production supervision of dangerous projects exceeding a certain scale.
Fifty-first supervision units shall review whether the safety technical measures, special construction schemes and construction monitoring schemes in the construction organization design meet the requirements of mandatory standards and design documents for engineering construction.
Fifty-second building materials, building components and equipment shall not be used or installed in the project without the signature of the registered supervision engineer, and the construction unit shall not carry out the construction of the next process.
Fifty-third supervision units shall, jointly with the relevant units, carry out the acceptance of concealed works and partial projects in accordance with the technical standards and norms of construction and relevant regulations, and carry out the pre-construction conditions acceptance of important parts and links of the project.
Fifty-fourth supervision units should check the layout and protection of construction monitoring points, and compare and analyze the data and inspection information of construction monitoring and third-party monitoring. In case of any abnormal situation, it shall promptly give feedback to the construction unit and urge the construction unit to take corresponding measures.
Fifty-fifth supervision units in the process of supervision, found that the construction unit has one of the following circumstances, it shall require the construction unit to immediately rectify. If the situation is serious, the construction unit shall be required to temporarily stop the construction and report to the construction unit in time. (a) the project construction does not meet the requirements of engineering design and standards; (2) failing to organize construction or monitor according to the approved construction organization design, special construction scheme or construction monitoring scheme; (three) the cost of safety measures has not been implemented; (four) there are hidden dangers of safety and quality in the construction site; (five) the main management personnel of the project are not in place or the qualifications and quantity do not meet the requirements. If the construction unit refuses to rectify or stop construction, the supervision unit shall report to the construction unit in time, and the construction unit shall order the construction unit to rectify or stop construction. Fifty-sixth supervision units shall conduct safety quality training for supervision personnel according to regulations.

Chapter VI Safety and Quality Responsibility of Engineering Monitoring and Quality Testing Units
Fifty-eighth engineering monitoring units engaged in the third-party monitoring business of urban rail transit projects (hereinafter referred to as monitoring units) shall have the corresponding engineering survey qualifications, and go through the filing formalities with the competent construction department where the project is located.
The monitoring unit shall not subcontract the monitoring business, and shall not have subordinate relationship or other interest relationship with the construction unit of the monitored project.
Fifty-ninth quality inspection units engaged in the quality inspection business of urban rail transit projects shall have corresponding qualifications.
The quality inspection unit shall not subcontract the inspection business, and shall not have affiliation or other interests with the design unit, construction unit and supervision unit related to the inspected project.
Article 60 The monitoring unit shall be responsible for monitoring the safety and quality of the project. The main person in charge of the monitoring unit is fully responsible for the monitoring work of the unit. The person in charge of project monitoring is responsible for the safety and quality monitoring of the project undertaken.
The person in charge of project monitoring shall have the corresponding professional qualification and experience of urban rail transit engineering monitoring.
Sixty-first monitoring units must establish and improve the safety and quality responsibility system and management system, and strengthen the management of construction sites by engineering monitoring institutions.
The specialty and quantity of project monitoring personnel should meet the needs of monitoring work.
Sixty-second monitoring units shall, according to the survey and design documents, safety and quality risk assessment reports, monitoring contracts and related materials, prepare a third-party monitoring plan, which shall be implemented after being demonstrated by experts and signed by the main person in charge of the monitoring unit.
The monitoring unit shall carry out monitoring and inspection in accordance with the third-party monitoring scheme, and provide monitoring reports to the construction, supervision and design units in a timely manner. If any abnormality is found, immediately give feedback to the construction unit.
Sixty-third quality inspection institutions shall conduct quality inspection in accordance with engineering construction standards and relevant state regulations. Sixty-fifth monitoring and quality inspection units shall conduct safety and quality training for monitoring and testing personnel in accordance with the regulations, and may not take up their posts until they have passed the training and examination.
Sixty-sixth monitoring and quality inspection units shall file engineering monitoring and quality inspection data in accordance with the provisions.
Chapter VII Emergency Disposal of Safety and Quality Accidents
Article 67 The competent construction departments, construction units and construction units of the local people's governments at or above the county level where urban rail transit projects are located shall prepare emergency plans for safety and quality accidents of urban rail transit projects, and establish and improve the safety production early warning and emergency coordination guarantee mechanism.

Chapter VIII Supervision and Administration
Article 71 The competent construction department of the local people's government at or above the county level where the urban rail transit project is located shall supervise and inspect the implementation of laws, regulations and mandatory standards related to the safety and quality of the urban rail transit project.
Article 72 The competent construction department of the local people's government at or above the county level where the urban rail transit project is located may entrust the safety and quality supervision institution of the construction project (hereinafter referred to as the supervision institution) to specifically supervise and inspect the safety and quality of the urban rail transit project.
Supervision institutions shall, according to the scale of urban rail transit projects, be equipped with professional supervision personnel related to urban rail transit projects.
Article 73 When performing the duties of supervision and inspection, the competent construction department of the local people's government at or above the county level where the urban rail transit project is located, or the supervision institution entrusted by it, has the right to take the following measures: (1) Require the inspected unit to provide documents and materials related to the safety and quality of the project; (two) to enter the construction site or workplace of the inspected unit for inspection; (three) the hidden dangers of safety and quality found in the inspection shall be ordered to be rectified immediately; For major safety and quality hazards, it shall be ordered to temporarily stop construction.
Article 74 The competent construction department of the people's government at or above the county level where the urban rail transit project is located shall establish, publish and update the expert database of urban rail transit projects in a timely manner, and formulate corresponding management systems.
Article 75 The safety and quality of urban rail transit projects shall be reported step by step. The competent construction department of the local people's government at or above the county level where the urban rail transit project is located shall report the safety and quality of the urban rail transit project in the administrative area in the previous quarter to the superior construction department every quarter. In case of safety and quality accidents, the accident investigation and handling shall be submitted in time.
The competent construction department of the local people's government at or above the county level where the urban rail transit project is located shall regularly publish the safety and quality information of the construction, survey, design, construction, supervision, monitoring and quality inspection units.
Article 76 Where construction, survey, design, construction, supervision, monitoring, quality inspection and other units violate the laws, regulations and rules of construction, the competent construction department of the people's government at or above the county level shall, according to the management authority, impose administrative penalties such as fines, suspension of business for rectification, reduction of qualification level and revocation of qualification certificate; If a crime is constituted, criminal responsibility shall be investigated according to law.
