In order to implement Scientific Outlook on Development, further improve the regulation policy of the real estate market, reasonably guide housing consumption and housing development and construction, and promote the healthy and stable development of the real estate market in our city, combined with the actual situation in our city, we hereby put forward the following opinions:
First, further create a good housing consumption environment.
(1) Adjust the policy of purchasing houses. The implementation scope of the housing purchase policy for households has been expanded from Hangzhou Economic Development Zone, Hangzhou High-tech Development Zone (Binjiang) and Qianjiang New City to Shangcheng District, Xiacheng District, Xihu District, Jianggan District and Gongshu District. The property buyers are non-registered residents (excluding outsiders) in Hangzhou, and the total price of buying single houses (including stock houses) in Shangcheng District is above 6.5438+0 million yuan (including 6.5438+0 million yuan), or the total price of buying single houses (including stock houses) in Xiacheng, Xihu, Jianggan and Gongshu District is above 800,000 yuan (including 800,000 yuan). The specific operation measures shall be implemented according to the Notice of the General Office of Hangzhou Municipal People's Government on Forwarding the Pilot Measures for Foreigners to Purchase Houses in Hangzhou (Hangzhou Zhengban [2006] No.6). Hangzhou Economic Development Zone, Hangzhou High-tech Development Zone (Binjiang) and Qianjiang New City are still implemented according to the original policy.
(2) Relaxing the housing provident fund loan policy. The maximum amount of housing provident fund loans will be raised from 500,000 yuan to 600,000 yuan; The longest term of housing provident fund loans is adjusted from 60 years old for men and 55 years old for women to 65 years old for men and 60 years old for women.
Reduce the down payment ratio of housing provident fund loans, and reduce the down payment ratio of employees to purchase commercial housing from 30% to 20%;
If the per capita construction area of commercial housing purchased by employees using the first set of loans does not meet the standard of per capita housing construction area in the city, they can apply for the second set of housing provident fund loans according to the corresponding amount.
Allow Hangzhou District, county (city) to handle housing provident fund loan procedures in different places. Encourage employees to withdraw their own, spouse and immediate family members housing provident fund to buy self-occupied housing.
(three) the purchase of commercial housing deed tax, stamp duty subsidies. From the date of publication of the Opinions to June 5438+February 3, 2 009 1 day, individuals who purchase ordinary commercial housing in Shangcheng District, Xiacheng District, Jianggan District, Gongshu District, Xihu District, Hangzhou High-tech Development Zone (Binjiang), Hangzhou West Lake Scenic Area, Hangzhou Economic Development Zone and Hangzhou Zhijiang Resort will pay deed tax after obtaining the ownership certificate.
(four) the implementation of tax subsidies for the stock of housing transactions. From the date of issuance of the Opinions to February 3, 2009, the Buyer and the Seller (both individuals) bought and sold individual ordinary houses located in Shangcheng District, Xiacheng District, Jianggan District, Gongshu District, Xihu District, Hangzhou High-tech Development Zone (Binjiang), Hangzhou West Lake Scenic Area, Hangzhou Economic Development Zone and Hangzhou Zhijiang Resort.
(5) Simplify the tax declaration procedures for stock house transactions. Taxpayers who sell their own houses and buy new houses within one year before and after the sale will no longer receive personal income tax deposits.
(six) clearly define the object of buying a second house. Family children 1.8 can purchase a second house according to the first home loan policy.
(seven) to suspend the collection of real estate registration and other related fees. From the date of publication of the Opinions to June 5438+February 3, 2 009 1 day, the property registration fees for ordinary commercial houses and ordinary stock houses in Shangcheng District, Xiacheng District, Jianggan District, Gongshu District, Xihu District, Hangzhou High-tech Development Zone (Binjiang), Hangzhou West Lake Scenic Area, Hangzhou Economic Development Zone and Hangzhou Zhijiang Resort were completely stopped.
Two, encourage the implementation of monetary resettlement for housing demolition.
(eight) to encourage the demolition of housing monetary resettlement. In project construction, land acquisition and demolition, encourage monetary resettlement and save land for resettlement housing construction. If the land originally planned for resettlement housing construction is adjusted to open land transfer, the transfer income will be returned to the land owner after deducting the prescribed fees and funds for the development of resettlement land and infrastructure construction.
(9) Increase the purchasing power of the government. Municipal departments and urban landowners may, according to their needs, purchase low-and medium-priced commercial houses through government procurement on the basis of reasonable prices and in accordance with the principles of openness, fairness and justice, with the consent of the municipal finance department, so as to increase the supply of resettlement houses.
Third, further optimize the investment and development environment of the real estate industry.
(ten) the enterprise income tax of real estate development enterprises shall be levied according to the lower limit. For the pre-sale income of real estate development enterprises before the completion of the project, the enterprise income tax shall be paid in advance according to the lower limit of the expected profit rate stipulated by the national tax policy, and quarterly prepayment and annual liquidation shall be implemented.
(eleven) adjust the real estate mortgage registration. Real estate projects receive the pre-sale certificate of commercial housing. After the unsold houses stop selling, you can go through the registration procedures of mortgage rights for projects under construction. After the construction in progress is completed and the initial registration of house ownership is handled, the mortgage right of the construction in progress is transferred to the house mortgage registration.
(12) Appropriately adjust the payment period of the transfer price. The transferee has paid the down payment (including the down payment) in full in accordance with the Assignment Contract for the Right to Use State-owned Construction Land (hereinafter referred to as the Assignment Contract) for the real estate business land that has been publicly assigned from June 5438+1 October1date in 2007 to the date of issuance of this opinion. The transferee can make an adjustment to the assignment contract after submitting a written application and going through relevant formalities with approval.
(13) Relax the commencement and completion period of construction projects. For the business land that has been publicly sold from June 1 2007 to the date of issuing this opinion, and the transfer contract stipulates that the construction must be started before July 3 1 2009, the land can be sold only after the transferee pays 70% of the total land price. If it is really difficult to start construction on schedule, the transferee shall submit a written application, and after approval, the time for commencement and completion may be extended by no more than one year.
(fourteen) relax the payment period and proportion of the land price of the newly transferred land. For the newly sold commercial real estate land, the transferee is allowed to pay off the transfer price within 1.2 months. For plots with a total starting price of more than 500 million yuan or a large scale, the maximum payment period of the transfer price can reach 1.8 months; It is allowed to adjust the deposit transfer price (deposit) payable within 65438+O days from the date of signing the transfer contract to 10% of the total transfer price.
(fifteen) deferred payment of housing property maintenance fund and civil air defense construction fees. The house property maintenance fund received in advance when receiving the Pre-sale Permit for Commercial Housing is deferred to the initial registration of the house. The civil air defense construction fee will be postponed to the "Pre-sale Certificate of Commercial Housing".
(sixteen) to improve the level of government services. Municipal functional departments and city governments should create a good development environment, strengthen ties with enterprises, and help enterprises solve difficulties encountered in business activities; It is necessary to strengthen services, improve efficiency, reduce examination and approval links and shorten the time limit for examination and approval. At the same time, we will conscientiously implement the spirit of the Notice of Hangzhou Municipal People's Government on Suspension of Collection of 152 Administrative Charges (Hangzhou [2008]184), and ensure that 1 2 suspended collection projects involving real estate are put in place, including 2 items from the housing management department: urban housing demolition management fee and housing ownership certificate fee; 7 items of land and resources departments: land acquisition management fee, land acquisition unforeseen fee, land registration certificate fee (foreign-funded enterprises), land registration certificate fee (ordinary individuals), land registration certificate fee (ordinary units), special land registration certificate fee (units) and special land registration certificate fee (individuals); 2 items in the construction department: engineering quota determination fee and engineering quality supervision fee; Civil air defense department project 1: project quality supervision fee.
(seventeen) increase support and supervision. All financial institutions and real estate enterprises should increase their support for housing provident fund loans. For real estate development enterprises that refuse to handle housing provident fund loans for buyers, relevant functional departments will investigate and deal with them as appropriate, and informed criticism.
(eighteen) to encourage real estate enterprises to adopt new materials, new equipment and new technology to promote energy conservation and emission reduction. The R&D expenses incurred by real estate development enterprises for the development of new technologies, new products and new processes can enjoy the enterprise income tax R&D expenses plus deduction policy according to regulations; Real estate development enterprises can enjoy the corresponding fiscal and taxation policies by purchasing the relevant preferential catalogues of investment in special equipment such as environmental protection, energy saving and water saving, and safe production that meet the national regulations.
Fourth, create a good social atmosphere for the development of the real estate industry.
(nineteen) the establishment of real estate market analysis mechanism. The leading group for the implementation of the "Home Ownership Project" in the city shall convene member units and relevant departments from time to time to analyze the current real estate situation, timely and accurately release the dynamic information of the real estate market, and maintain the stability of the real estate market.
(20) Establish a communication and coordination mechanism. Through the government-bank-enterprise forum, we will build an interactive platform for the docking of banks and enterprises, coordinate and solve the difficulties faced by enterprises in time, and provide financial support for the further development of enterprises. Encourage banks to increase effective credit input under the guidance of national macro-control policies, support the normal and reasonable credit demand of qualified real estate enterprises, and effectively support the healthy development of the real estate industry.
(twenty-one) the establishment of emergency plan mechanism. Formulate emergency plans for public emergencies in the development of the real estate market, and establish and improve emergency mechanisms.
(twenty-two) give full play to the role of industry associations. Actively guide and help enterprises to improve their competitiveness, anti-risk ability and ability to cope with changes in the real estate situation.
(twenty-three) to strengthen the management of the real estate market. Strengthen the management of price order in the real estate market, and seriously investigate and deal with false advertisements of development enterprises. Providing false information, malicious speculation and misleading consumption will be severely dealt with. Strengthen the construction of the credit system in the real estate market and effectively protect the legitimate rights and interests of real estate consumers.
(twenty-four) to strengthen the guidance of public opinion. Strengthen the publicity of our city's urban construction, urban development and real estate development prospects, report the real estate market objectively and fairly, and at the same time strengthen the publicity of laws and regulations, knowledge of house purchase and investment risks in house purchase, and guide the masses to establish a correct concept of housing consumption.
