Measures of Zunyi Municipality on the Administration of Housing Provident Fund

Chapter I General Provisions Article 1 In order to strengthen the management of housing provident fund in this Municipality and safeguard the legitimate rights and interests of the owners of housing provident fund, these Measures are formulated in accordance with the State Council's "Regulations on the Management of Housing Provident Fund" and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the deposit, withdrawal, loan, value-added income distribution, liquidity risk prevention and control management and supervision of housing provident fund within the administrative area of this Municipality. Article 3 The term "housing accumulation fund" as mentioned in these Measures refers to the long-term housing savings paid by state organs, state-owned enterprises, urban collective enterprises, foreign-invested enterprises, urban private enterprises and other urban enterprises, institutions, private non-enterprise units, social organizations and their employees. Article 4 The housing accumulation fund paid by individual employees and the housing accumulation fund paid by the unit where employees work for employees belong to individual employees.

Housing provident fund shall be extracted and used in accordance with relevant laws and regulations and these measures, and no unit or individual may use it for other purposes. Article 5 The management of housing provident fund in this Municipality follows the principles of decision-making by the Municipal Housing Provident Fund Management Committee, operation of the housing provident fund management center, storage in special bank accounts and financial supervision. Sixth city housing provident fund management center should actively explore the establishment of information sharing, policy exchange, business interconnection and system interaction with housing provident fund management institutions in different places. Seventh city housing provident fund management center should make full use of modern information technology, establish an intelligent information management service system for housing provident fund, implement online deposit, withdrawal and loan services, and provide simple and efficient services for deposit units and employees. Eighth citizens, legal persons and other organizations have the right to put forward policy suggestions and complaints to the municipal housing provident fund management center, and the municipal housing provident fund management center shall reply or feedback the results within the prescribed time limit. Chapter II Institutions and Their Duties Article 9 The Zunyi Housing Provident Fund Management Committee (hereinafter referred to as the "Municipal Provident Fund Management Committee") is the decision-making body of the city's housing provident fund management. Specifically perform the following duties:

(a) according to the relevant laws, regulations, rules and policies, formulate and adjust the specific management measures of housing provident fund, and supervise the implementation;

(two) to formulate the specific deposit ratio of housing provident fund;

(three) to determine the maximum loan amount of housing provident fund;

(four) approval of housing provident fund collection and use plan;

(five) to consider the housing provident fund value-added income distribution plan;

(six) to review and approve the report on the implementation of the plan for the collection and use of housing provident fund;

(seven) to consider the application for write-off of bad debts of housing provident fund. Tenth Zunyi City Housing Provident Fund Management Center (hereinafter referred to as the "City Provident Fund Center") is an independent institution of the Municipal People's Government that is not for profit. Under the leadership of the Municipal Provident Fund Management Committee, it will carry out the management services of the city's housing provident fund. The municipal provident fund center shall set up a management department according to the needs of the work. As the office of the municipal provident fund center, the management department shall perform its duties within the scope authorized by the municipal provident fund center.

City provident fund center shall perform the following duties according to law:

(a) the preparation and implementation of housing provident fund collection and use plan;

(two) responsible for recording the deposit, withdrawal and use of employee housing provident fund;

(three) within the scope of authorization of the Municipal Provident Fund Management Committee, the audit unit to reduce the proportion of housing provident fund deposit application and deferred payment application;

(four) responsible for the accounting of housing provident fund;

(five) approval of the extraction and use of housing provident fund;

(six) responsible for the preservation and return of housing provident fund;

(seven) the preparation of housing provident fund collection and use plan implementation report;

(eight) the supervision and inspection of the establishment and payment of housing provident fund units;

(nine) responsible for applying to the municipal finance department for writing off bad debts;

(ten) to undertake other matters decided by the Municipal Provident Fund Management Committee. Eleventh people's governments at or above the county level and their housing and urban and rural construction, finance, people's bank, natural resources, public security, human resources and social security, civil affairs, market supervision, comprehensive law enforcement and other departments. Should be in accordance with their respective responsibilities, support the city provident fund center to do a good job in the collection and expansion, online investigation, information sharing, risk prevention and administrative law enforcement. Article 12 The Municipal Provident Fund Management Committee shall, in accordance with the relevant provisions of the People's Bank of China, designate commercial banks entrusted with the financial business of housing provident fund (hereinafter referred to as "entrusted banks"); The municipal provident fund center shall entrust the bank to handle the financial services such as loans and settlement of housing provident fund and the procedures for the establishment, deposit and return of housing provident fund accounts. The municipal provident fund center shall sign an entrustment contract with the entrusted bank. Chapter III Deposit Article 13 State organs, state-owned enterprises, urban collective enterprises, foreign-invested enterprises, urban private enterprises and other urban enterprises, institutions, private non-enterprise units and social organizations (hereinafter referred to as units) within the administrative area of this Municipality shall deposit housing provident fund for their employees.

On-the-job employees refer to all kinds of personnel (including compatriots from Hong Kong, Macao and Taiwan and foreigners who meet the relevant provisions on deposit) who have established personnel relations or labor relations with employers.

In the form of labor dispatch, the labor dispatch unit shall bear the responsibility for housing provident fund deposit; The labor dispatch unit shall agree with the employing unit to pay the housing provident fund in the labor dispatch agreement.
