In order to further maintain the order of the real estate market in our city and standardize the sales behavior of commercial housing, according to the Notice on Further Promoting the Stable and Healthy Development of Hefei Real Estate Market (Hefufa [20265438]1No.), the relevant matters concerning the public sale of newly-built commercial housing are hereby notified as follows:
1. Since April 6, 20021,the real estate development enterprise shall entrust a notary office to carry out lottery notarization for the real estate with the ratio of the number of registered house buyers to the number of saleable houses in the urban area of this city greater than (including equal to) 1.5. The computer lottery software provided by the notarization institution shall be used in the selection of houses, and the expenses incurred by notarization shall be borne by the real estate development enterprise.
Second, we should adhere to the principle of giving priority to those who just need to buy a house. Real estate development enterprises should provide not less than 30% of the houses for sale in the current period for those who just need to buy houses when choosing houses through notarization and lottery. Just need to buy a house to participate in the lottery, should also meet the following conditions:
1. The registered buyers meet the housing purchase restriction policy of our city;
2. Registered buyers and their family members have no self-owned housing in the urban area of this Municipality, and there is no housing transfer record before the date of registration;
3. Personal income tax or social insurance certificate for more than 2 years in the urban area within 3 years before the date of purchase registration;
4. The registered purchaser is under 35 years old on the date of registration (subject to the age recorded in the ID card).
3. Before obtaining the pre-sale permit of commercial housing, the real estate development enterprise shall formulate a notarized lottery public sales plan, which shall include the number of houses, the name of the notary office, the lottery method and related processes. The lottery scheme shall be publicized at the sales site, and reported to the Municipal Housing Security and Real Estate Administration and the Municipal Bureau of Justice for the record before organizing the lottery.
Four, real estate development enterprises should formulate the purchase registration rules before the opening sale, clear the start and end time, place (registration website) and conditions of the purchase registration. House purchase registration rules shall comply with the relevant provisions, and shall not set registration conditions that are only beneficial to insiders and specific parties; Do not set any form of registration conditions such as bundled sales and out-of-price charges; It is not allowed to set the registration condition that the down payment exceeds the loan down payment ratio determined by financial institutions for those who just need to buy a house. The purchase registration rules shall be publicized at the sales site and related websites before the purchase registration.
5. The real estate development enterprise shall publicize the houses to be sold in the current period at one time within 10 days from the date of obtaining the pre-sale permit of commercial housing, and organize the registration of buyers in time, with a registration period of not less than 3 days (72 hours). The purchase registration adopts online registration, and the registered purchaser uploads the identity certificate, marriage certificate and household registration certificate of himself and his family members. Real estate development enterprises shall verify whether the registered buyers meet the purchase restriction policy, and shall not register the registered buyers who do not meet the purchase restriction policy. Registered buyers shall not participate in the registration of other projects from the date of this registration until the results of house selection are publicized.
Six, after the deadline for the registration of the purchase, real estate development enterprises should be in accordance with the just-needed property buyers and ordinary property buyers to prepare the "registration shake list", after publicity at the sales site, deliver it to a notary public, and report it to the Municipal Housing Security and Real Estate Administration and the Municipal Bureau of Justice. The publicity time is not less than 2 days.
During the registration period, houses that meet the requirements of the detailed registration rules and the ratio of the number of registered buyers to the number of saleable houses in the current period is less than 1.5 shall be sold by real estate development enterprises after being approved by the Municipal Housing Security and Real Estate Management Bureau, but the conditions set by the detailed registration rules shall not be changed, otherwise the purchase registration shall be re-conducted according to the requirements of this notice.
7. The notarization institution is entrusted by the real estate development enterprise to preside over the notarization lottery, inviting 3 to 5 representatives of registered buyers to participate, and the lottery should be recorded all the time. After the sorting result of the lottery is confirmed by the notary public, the real estate development enterprise will publicize it at the sales site, and the publicity time shall not be less than 2 days.
Eight, the steps of shaking the number. (1) shake the number to choose a room. 1. Just need to buy a house to choose a house, and the number of house selection qualifications shall not be less than 30% of the total number of houses for sale. If the number of people who just need to buy a house is less than 30% of the total number of houses for sale, all those who just need to buy a house will be directly qualified to choose a house; 2. Ordinary property buyers will make a house selection qualification lottery. Those who just need to buy a house fail to win the lottery in this category, and can participate in the lottery of ordinary buyers. The ratio of qualified places to the total number of houses for sale is1:1; 3. Registered buyers who have not won the lottery for house selection qualification will participate in the supplementary house selection qualification lottery, and the quota for supplementary house selection qualification lottery is 20% of the total number of houses for sale; 4. The real estate development enterprise shall submit the relevant materials for the qualification of house selection by lottery and replacement to the Municipal Housing Security and Real Estate Management Bureau, and conduct the qualification examination of house purchase. If the purchaser who has the qualification to choose a house by lottery fails to pass the qualification examination of purchasing a house, the purchaser who has passed the qualification examination of purchasing a house shall be replenished in the order of lottery. (2) Shake the number according to the order of house selection. The house buyers who have obtained the qualification for house selection and passed the audit uniformly shake the house selection sequence, and the sequence generated according to the shaking result is the house selection sequence; The lottery order of buyers who have obtained the qualification of supplementary house selection and passed the audit is also sorted as supplementary house selection.
Nine, the real estate development enterprises under the supervision of the notary public, according to the lottery house sorting (including replacement house sorting) results in turn to organize the house selection. If the person who chooses a house fails to choose a house within the publicity time, the real estate development enterprise shall issue a statement, and the notarization institution shall consider it as giving up the house selection after confirmation.
Ten, after the election of housing, real estate development enterprises should be in the sales website and related websites publicity election results, publicity time of not less than 3 days. The registered purchaser, the lottery purchaser and the contract signer shall be consistent and shall not be changed. The house purchased by Yaohao shall not be listed and traded within 3 years from the date of obtaining the certificate of immovable property rights.
Eleven, real estate development enterprises shall, within 10 days from the end of the notarization of the house selection by lottery, submit the lottery sorting and the notarization of the house selection results, the list of abandoned houses and the list of abandoned houses contractors to the municipal housing security and real estate management bureau.
Twelve, registered buyers should truthfully register the family property information, and make a written commitment to the authenticity of the information provided. Those who provide false information to defraud the purchase qualification or give priority to the lottery qualification will be disqualified from the lottery purchase registration within 3 years. Registered buyers who give up buying houses twice after choosing houses through notarization and lottery will be suspended from buying houses for 6 months from the end of the last house selection.
Thirteen, real estate development enterprises should strictly abide by the city's real estate market regulation policies and the requirements of this "Notice", the implementation of housing selection measures, and shall not refuse to purchase registration without reason. If a real estate development enterprise violates the provisions of this notice, once verified, it will suspend its online signing qualification for the opening sale of commercial housing.
Fourteen, notarization institutions should formulate notarization rules. Holding a lottery to publicly sell commercial housing should be open, fair, just and reasonable. Those who practise fraud or engage in malpractices for selfish ends in the notarization lottery shall be investigated for responsibility according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Fifteen, the city housing security and real estate management bureau, the Municipal Bureau of Justice will further supplement and improve the relevant provisions according to the development of public sales notarization of new commercial housing. The "Notice" shall be interpreted by the Municipal Housing Security and Real Estate Administration and the Municipal Bureau of Justice.
