Provisions of Chengdu Municipality on the Safety Management of Urban Housing Decoration Structure

Article 1 In order to strengthen the safety management of urban housing decoration structure and ensure the living and use safety of housing owners and users, these Provisions are formulated in accordance with the provisions of the People's Republic of China (PRC) Construction Law and other relevant laws and regulations, combined with the actual situation in Chengdu. Article 2 These Provisions shall apply to the safety management of urban housing decoration structures that have been completed and delivered on state-owned land within the administrative area of this Municipality. Article 3 Urban houses mentioned in these Provisions include residential houses, business houses, office houses and other civil non-residential houses.

The term "safety management of house decoration structure" as mentioned in these Provisions refers to the safety management of building main body and load-bearing structure (hereinafter referred to as house structure) such as walls, beams, plates, columns, foundations and roofs of houses demolished due to decoration. Fourth city real estate administrative departments in charge of the city's housing decoration structure safety management.

City real estate administrative departments of the housing safety management agencies responsible for Jinjiang District, Qingyang District, jinniu district, Wuhou District, chenghua district (hereinafter referred to as the five urban areas) within the scope of civil non-housing decoration structure safety management of the specific work. Wucheng district real estate administrative department is responsible for the specific work of safety management of housing decoration structure within its jurisdiction. Longquanyi District, qingbaijiang district and county (city) real estate administrative departments are responsible for the safety management of urban housing decoration structures within their respective jurisdictions.

The relevant departments of the municipal and district (city) county people's governments shall do a good job in the safety management of urban housing decoration structures within their respective responsibilities. Article 5 When decorating a house, the owner or user of the house must ensure the original integrity, seismic performance and structural safety of the house, and shall not dismantle or change the structure of the house without authorization, and shall not affect the use safety of adjacent houses due to decoration. Sixth housing users need to demolish the house or change the structure of the house for investment and decoration, and shall obtain the written consent of the owner of the house. When the user changes, the facilities and equipment that affect the structural safety of the house shall not be removed. Article 7 If it is really necessary for the owner or user of a house to demolish or change the structure of the house, he must submit a written application in accordance with the relevant laws, regulations and these Provisions, and submit the following materials to the real estate administrative department for examination and approval. Decoration can only be carried out after obtaining the structural safety approval of house decoration.

(a) housing ownership certificate;

(two) the decoration design scheme and construction drawing put forward by the original design unit or the design unit with corresponding qualifications;

(three) the implementation of property management, should be submitted to the property management company signed opinions;

(four) the use of decoration, should be submitted to the owner of the house agreed to decorate the written documents;

(five) rental housing, housing rental certificate shall be submitted;

(6) Other materials deemed necessary by the examination and approval authority. Eighth in any of the following circumstances, the real estate administrative department shall not issue a letter of approval for the safety of the house decoration structure:

(a) the ownership or use right of the house is controversial;

(two) the house is seriously damaged or dangerous without repair and reinforcement;

(3) Belonging to dangerous houses;

(four) the house is within the scope of demolition;

(5) Failing to submit relevant materials as required in Article 7. Ninth urban housing renovation within the scope of five urban areas, the need to dismantle the housing structure, which belongs to the civil non-housing, is approved by the municipal real estate administrative department; The district real estate administrative department where the house is located for examination and approval.

Houses in other districts (cities) and counties shall be examined and approved by the district (city) and county real estate administrative departments with reference to the provisions of the preceding paragraph. Tenth real estate administrative departments shall, within seven working days from the date of receiving the application for house decoration, make a decision on whether to approve it, and issue a letter of approval for the structural safety of house decoration if it meets the requirements. If it is not approved, it shall explain the reasons in writing. Eleventh units and individuals engaged in housing decoration design and construction, must have the corresponding qualification grade and employment certificate, can undertake decoration projects. Twelfth housing decoration design and construction, should comply with the relevant norms of housing structure and decoration engineering quality standards, the selection of raw materials and accessories that meet the national product quality standards. Thirteenth housing owners or users to dismantle the housing structure, without obtaining the safety approval of the housing decoration structure, the construction unit and individual shall not be allowed to construct; Units and individuals engaged in construction shall carry out construction in accordance with the decoration design scheme and construction drawing approved by the real estate administrative department. Fourteenth building decoration structure safety approval shall be posted on the construction site.

Construction waste generated in the process of decoration shall be disposed of in accordance with the Regulations of Chengdu Municipality on the Administration of Urban Construction Waste. Fifteenth housing owners or users shall, within seven working days after the completion of the demolition and decoration of the housing structure, apply to the real estate administrative department for the safety inspection and acceptance of the housing decoration structure.

The real estate administrative department shall organize the acceptance within five working days after receiving the application. After the acceptance, it can continue to decorate or put into use. Sixteenth real estate administrative departments, neighborhood offices and the town people's government should strengthen the supervision and inspection of the structural safety of housing decoration. Units and individuals under inspection shall not refuse or obstruct.

The owner of the house, the property management company or other relevant units shall supervise the house decoration, and have the right to stop the acts in violation of these provisions, and notify the relevant departments to investigate and deal with them in time.
