The competent department of energy conservation and the energy conservation supervision institution shall publish the report telephone number and keep it confidential for the informants. Section II Contents to be Supervised Article 8 Energy conservation supervision mainly includes the following contents:
(a) the special demonstration of rational energy use in the feasibility study report of fixed assets investment projects, and the implementation of energy-saving policies, rational energy use standards and energy-saving design specifications in the design and construction of fixed assets investment projects;
(two) to stop the production, use and operation of energy-using products and equipment explicitly eliminated by the state, and the situation that the design unit prohibits the use of energy-using products and equipment explicitly eliminated by the state in design;
(three) the establishment and implementation of energy metering management, energy quota management, energy consumption statistics and energy utilization analysis system;
(four) key energy-using units to establish energy management system, set up full-time energy management personnel and key energy-using equipment operators to receive energy-saving education and training, and regularly report energy utilization;
(five) the implementation of the energy consumption limit and energy efficiency standard per unit product formulated by the national and provincial energy management departments by the production units of products and equipment with high energy consumption;
(six) the implementation of product energy efficiency labeling and energy consumption indicators by the production and business units of energy-using products;
(seven) forgery or fraudulent use of energy-saving product certification marks;
(eight) whether the energy-saving technical service unit has forced to provide services, expand service items or raise service charges without authorization;
(nine) other contents stipulated by laws, regulations and rules. Ninth energy conservation departments and energy conservation supervision institutions shall perform the following supervisory duties:
(a) publicity of energy-saving laws, regulations and rules;
(two) to supervise and inspect the compliance of energy-using units with energy-saving laws, regulations and rules;
(3) Accepting reports;
(four) to deal with illegal acts of energy conservation according to law;
(5) Other supervisory duties as stipulated by laws, regulations and rules. Tenth energy-saving inspectors in accordance with the law to implement energy-saving supervision, can exercise the following functions and powers:
(a) ask the relevant personnel, and put it on record;
(2) consulting, copying or transcribing relevant materials;
(three) check the workplace of the energy-using unit, and record and take photos of the relevant site;
(four) to require the supervised unit to make a written reply to the relevant questions truthfully within the prescribed time limit;
(five) to stop and correct violations of energy-saving laws, regulations and rules;
(six) other functions and powers conferred by laws, regulations and rules. Eleventh energy conservation departments or energy conservation supervision institutions beyond their functions and powers to carry out supervision, the supervised units have the right to refuse.
Energy conservation supervisors shall perform their duties according to law and shall not disclose the business secrets of the inspected units. Section III Procedures for Energy Supervision Article 12 The competent energy conservation departments and energy conservation supervision institutions shall strengthen the training, management and supervision of energy conservation supervision personnel.
Energy-saving supervisors must be familiar with energy-saving laws, regulations, rules and standards before taking up their posts, have corresponding business capabilities, and obtain administrative law enforcement qualifications in accordance with regulations. Thirteenth energy-saving supervision institutions to implement energy-saving supervision, should be 10 days in advance, the time, content and requirements of the implementation of supervision, written notice to the supervised unit. Fourteenth in any of the following circumstances, the competent department of energy conservation or energy conservation supervision institutions can implement timely supervision:
(a) due to technological transformation or other reasons, major energy-consuming equipment, production technology or energy consumption structure of key energy-using units have undergone major changes, affecting energy conservation;
(two) accepting reports or through on-site inspections, etc., it is found that energy-using units are suspected of illegal use of energy;
(three) whether the energy-using units ordered to rectify within a time limit according to law meet the rectification requirements on schedule;
(four) other circumstances stipulated by laws, regulations and rules.
