Cemetery is divided into operating cemetery and public cemetery. The third municipal civil affairs department is responsible for the management of the city's cemeteries; District and county (city) civil affairs departments are responsible for the management of cemeteries within their respective administrative areas.
Departments of land planning, construction, agriculture (forestry), public security, health, overseas Chinese affairs, prices, ethnic and religious affairs, industry and commerce administration and environmental protection at all levels shall, according to their respective functions and duties, cooperate with civil affairs departments to do a good job in cemetery management. Article 4 The municipal civil affairs department shall, jointly with the municipal planning, land planning, overseas Chinese affairs, agriculture (forestry), ethnic religion and other departments, be responsible for the preparation of the city's cemetery construction plan, which shall be implemented after being reported to the Municipal People's Government for approval. Article 5 Cremation shall be fully implemented within the administrative area of this Municipality. Minority citizens should respect their own funeral customs when they die; Voluntary cremation, others shall not interfere. Chapter II Cemetery Construction Article 6 Cemetery construction shall adhere to the principles of unified planning, total control, rational layout, land conservation and environmental protection.
No new cemeteries will be approved in the SAR. Article 7 It is forbidden to build cemeteries in the following areas:
(1) Cultivated land and forest land;
(two) city parks, scenic spots, cultural relics protection areas and nature reserves;
(3) Near reservoirs, river dams and water source protection areas;
(four) navigable rivers, railways and highways (national highways and provincial highways) on both sides of the field of vision.
It is forbidden to build graves outside the cemetery. Eighth strictly limit the tomb area. The area of single tomb or double tomb for burying ashes shall not exceed 1 m2, and the area of single tomb or double tomb for burying remains shall not exceed 4 m2. Ninth operating cemetery construction, by the local county (city) people's government after the first instance, reported to the municipal civil affairs department for examination. After examination and approval, it shall be submitted to the Provincial Civil Affairs Department for examination and approval.
The construction of public cemetery shall be approved by the town people's government (street office), and the tomb site in the urban area shall be approved by the municipal civil affairs department; If the tomb site is not in the urban area, the cemetery shall be examined and approved by the county (city) civil affairs department, and the columbarium shall be examined and approved by the county (city) people's government.
After the application for the construction of a cemetery is approved, it shall go through the relevant formalities with the departments of land, planning and construction according to law. After the completion of the operating cemetery, you should hold the relevant approval documents to the local industrial and commercial department to obtain a business license. Article 10 To apply for the construction of a cemetery, the following materials shall be submitted:
(a) the applicant's qualification certificate;
(2) an application report;
(3) Feasibility report;
(four) the cemetery plan and other related materials;
(5) Other relevant materials. Eleventh civil affairs departments or local governments shall examine and approve the application for cemetery construction in strict accordance with the cemetery planning approved by the municipal government, and make a decision on examination and approval within 30 working days from the date of accepting the application. If it is not approved or approved, it shall explain the reasons and inform the applicant in writing. Twelfth changes in the use of a cemetery shall be reported to the original cemetery construction examination and approval authority in accordance with the provisions of the first and second paragraphs of Article 9 of these Measures, and then the relevant procedures shall be handled in accordance with the provisions. Thirteenth without approval, no unit or individual may build a cemetery without authorization. Chapter III Management of Cemetery Article 14 Cemetery service units sell graves or storage spaces for ashes on the basis of cremation certificates or burial certificates of remains. It is strictly forbidden to illegally sell graves or ashes storage spaces by pyramid schemes. Fifteenth sale of graves or ashes storage spaces should be signed a sales contract. The contents of the contract shall be agreed by the parties, and generally include the following clauses:
(1) The name and address of the party concerned;
(two) the location of the grave or ashes storage cell;
(3) service life;
(4) Price, expenses and payment method;
(5) Liability for breach of contract;
(6) Other contents agreed by the parties.
The service life of a grave or ashes storage cell is generally 20 years. When the service life expires and the owner of the tomb requests to extend the use, the cemetery service unit shall sign a renewal agreement with it within 3 months from the date of expiration of the service life; For more than 3 months, the owner of the tomb has not requested to postpone the use, and the remains or ashes have not been disposed of, the cemetery service unit has the right to dispose of them according to the situation of the tomb without the owner. Sixteenth cemetery service units shall collect fees according to law, clearly mark the price, use standardized burial (custody) vouchers, and establish a strict sales and registration system. Seventeenth cemetery service units need to publish cemetery advertisements, which shall be approved by the municipal civil affairs department. Eighteenth cemetery service units shall have the following acts:
(a) receiving the burial of the remains that should be cremated according to law;
(two) the construction of feudal superstitious facilities, family graves, clan graves and killing the game in the cemetery. Article 19 It is forbidden to change a public cemetery into a business cemetery without authorization. Twentieth cemetery service units shall be responsible for the maintenance and maintenance of cemeteries. Twenty-first approved to change the use of the cemetery, the cemetery service unit shall be responsible for moving the tomb for the owner, and bear corresponding responsibilities according to law. Article 22 It is forbidden to engage in feudal superstitious activities in cemeteries.
