Regulations of Chongqing Municipality on the Maintenance and Management of Municipal Facilities

The maintenance of municipal facilities shall implement the relevant national and municipal technical standards and norms, strengthen daily inspections, conduct regular maintenance and testing, and immediately rectify any problems found to ensure the normal use of municipal facilities.

The maintenance quality of municipal facilities shall be implemented in accordance with the provisions of the state and this Municipality on the quality management of construction projects. The maintenance of municipal facilities should introduce market competition mechanism and implement bidding.

Municipal facilities maintenance management unit shall have corresponding qualifications and professional and technical personnel, equipped with special maintenance equipment. Municipal facilities maintenance management units are responsible for the maintenance of municipal facilities under their respective management.

Municipal facilities invested and built by social units shall be maintained by the construction unit before handover.

Municipal facilities that are franchised shall be maintained by the management unit in accordance with the franchise contract and relevant regulations. Municipal facilities maintenance and repair construction site should set up standardized warning signs, indicate the maintenance period, and take safety protection measures to ensure the safety of pedestrians and vehicles; Low-noise and dustproof construction equipment and methods should be adopted during construction, which meet the requirements of environmental protection.

If the construction site affects the traffic safety and smoothness, it shall be implemented in accordance with the relevant provisions of the Chongqing Road Traffic Safety Regulations.

Major maintenance projects of main roads in busy areas and window areas should be announced to the public five days in advance, and at the same time, they should avoid peak hours.

Special vehicles for urban road maintenance should use uniform signs, and when performing emergency tasks, they are not restricted by the driving route and direction under the condition of ensuring safe and smooth traffic. The municipal administrative department shall strengthen the supervision and inspection of the maintenance of municipal facilities and establish an emergency mechanism. The maintenance and management of major municipal facilities shall be undertaken by units with corresponding construction qualifications.

The maintenance and management unit of municipal facilities shall establish the inspection system and reporting system for the use and management of municipal facilities. Found damaged or lost, should be handled within twenty-four hours. In urban road facilities, the following acts are prohibited:

(a) cleaning a motor vehicle or driving a motor vehicle on the sidewalk;

(2) Test the brake;

(three) the discharge of sewage, dumping garbage, muck and other solid and liquid substances;

(four) stacking flammable, explosive, toxic, malodorous, easy to fly or burning garbage;

(five) moving or damaging road signs and other road facilities;

(six) directly mixing cement mortar, concrete and other mixtures on the pavement;

(7) Failing to take protective measures when driving an iron-wheeled vehicle or a tracked vehicle;

(eight) other acts of occupation and damage to urban road facilities.

In the non-planned sections of urban roads, roads shall not be occupied for business activities. On the urban road facilities, the following occupation and excavation activities shall not be carried out without the approval of the municipal administrative department:

(1) Setting up parking spots;

(2) Parking motor vehicles on the sidewalk;

(three) stacking items, setting up signs or advertisements;

(4) Opening ramps or crossings;

(five) all kinds of buildings (structures);

(six) other acts of occupation and excavation of urban road facilities. Newly built, rebuilt and expanded urban road facilities shall not be excavated within five years after delivery and three years after the completion of urban road facilities overhaul. If excavation is really necessary, it shall be reported to the people's government of a county (autonomous county) or the Municipal People's government for approval in accordance with the jurisdiction of urban road facilities.

During major statutory festivals and major city-wide activities, no new urban road facilities may be excavated. If excavation has been carried out, the construction shall be stopped.

If underground pipelines are buried under trenchless conditions, trenchless technology shall be adopted; If it can be combined with construction, it should be cross-merged to reduce the excavation of urban road facilities.

When building, rebuilding, expanding or overhauling urban primary and secondary trunk roads, underground pipelines should be embedded and comprehensive pipe trenches should be built. Overhead pipelines are prohibited. In the transformation of the old city, pipeline units should move and underground pipelines simultaneously with road reconstruction and construction. Units that need to excavate urban road facilities, such as new construction, renovation and expansion of underground pipelines, shall report the excavation plan for the next year to the municipal administrative department before 10/3/0 every year, and the municipal administrative department shall formulate and publish the annual excavation plan in a unified way according to the needs of road facilities maintenance.

The overhaul and reconstruction of urban road facilities shall be included in the annual excavation plan, and the municipal facilities maintenance and management unit shall notify all relevant units at least fifteen days in advance during the overhaul and reconstruction; If there is a need for pipe network construction, it should be implemented simultaneously. Temporary occupation and excavation of urban road facilities shall be implemented after approval by the municipal administrative department; Involving fire protection, landscaping, electric power, communications and other facilities, it should also seek the opinions of the fire control institutions of public security organs, the administrative departments of gardens and the property rights units of facilities; If the traffic safety and smoothness are affected, the consent of the traffic management department of the public security organ shall also be obtained.

Temporary occupation of urban road facilities shall pay urban road occupation fees, and excavation and repair fees shall be paid for excavation of urban road facilities. Fees shall be collected in accordance with the relevant provisions of the competent price department and turned over to the finance for special purposes. To apply for the excavation of urban road facilities, an application, a construction plan and a schematic diagram of the proposed construction scope shall be submitted; When applying for excavation permit for pipeline construction, road reconstruction and large-scale engineering construction, it shall also submit the construction design drawings and the construction project planning permit issued by the competent department of urban and rural planning administration and its annexes and drawings.

To apply for temporary occupation of urban road facilities, an application form and an occupation plan shall be submitted. Units and individuals that have been approved to temporarily occupy or excavate urban road facilities shall abide by the following provisions:

(1) Publicizing the approval documents in a prominent position on the site;

(2) Occupy or excavate according to the approved area, scope, use and time limit;

(three) the excavation site should be closed and set up with safety warning signs;

(four) take effective measures to control the construction dust and road pollution;

(five) temporary occupation of roads to pile up building materials, construction waste and build temporary sheds should be kept standardized and clean;

(6) At the expiration of the period of temporary occupation or excavation of road facilities, the obstacles shall be removed and the functions of road facilities shall be restored, and the traffic can be resumed only after the municipal administrative department and the traffic management department of the public security organ have passed the acceptance and met the traffic requirements. If it is necessary to excavate urban road facilities for emergency repair of water supply, gas supply, power supply, communication, rail transit and other facilities, and it is impossible to go through the examination and approval procedures in advance, it shall immediately notify the municipal administrative department, and go through the formalities within 24 hours after excavating the road facilities and pay the excavation and repair fee.

If the urban road facilities are damaged due to accidents, the responsible person shall report to the municipal administrative department in time while taking emergency protection measures. Iron-wheeled vehicles, tracked vehicles and ultra-high, ultra-wide, ultra-long and overweight vehicles passing through urban road facilities shall take effective protective measures to drive and park in accordance with regulations; Those who carry indecomposable and out-of-gauge articles shall drive and stop in accordance with the time, route and speed specified by the traffic management department of the public security organ, and hang obvious signs.

If the carrier cannot take protective measures in accordance with the provisions of the preceding paragraph, the municipal facilities maintenance and management unit shall help him to take protective measures, and the expenses required shall be borne by the carrier. In one of the following acts, the traffic administrative department of the public security organ shall promptly inform the municipal administrative department:

(1) Adding or relocating traffic facilities and pipelines on the completed urban road facilities;

(2) Setting up and moving urban bus stations, platforms, kiosks, etc.

If the facilities specified in the preceding paragraph can be built together with the expansion, reconstruction and maintenance of urban road facilities, the municipal administrative department shall coordinate with the traffic management department of the public security organ in time to jointly build. The municipal facilities maintenance and management unit shall, in accordance with the relevant provisions of the state, entrust a bridge inspection and evaluation institution with corresponding qualifications to conduct inspection and evaluation of the bridge.

Bridge inspection and evaluation institutions shall provide true and accurate inspection data and evaluation conclusions according to relevant technical specifications, and evaluate the technical level of bridges.

Safety test results shall be reported to the municipal administrative department for the record. After testing and evaluation, it is determined that the bearing capacity of the bridge has decreased but has not yet constituted a dangerous bridge, and the municipal facilities maintenance and management unit shall immediately take safety measures such as reinforcement.

If it is judged as a dangerous bridge through detection and evaluation, the municipal facilities maintenance and management unit shall announce to the public, set up obvious warning signs, and take timely measures to eliminate the danger; Dangerous bridges are not allowed to be used until the danger is eliminated. The following acts are prohibited in urban bridge and culvert facilities:

(a) unauthorized occupation of urban bridge facilities;

(two) moving or damaging urban bridge facilities and surveying markers;

(three) operations that endanger the safety of urban bridge and culvert facilities;

(four) unauthorized construction of buildings (structures);

(five) other acts of damage, occupation and theft of urban bridge and culvert facilities.

In the urban bridge and culvert facilities safety protection zone, any operation endangering the safety of bridges, underpasses and tunnels is prohibited. The setting of urban public parking lots should follow the principle of adapting to the level of urban development and being moderately ahead of schedule, with scientific planning and rational allocation to ensure the safety and convenience of public travel.

Encourage units and individuals to invest in the construction of public parking lots, and encourage the construction of three-dimensional public parking lots and the use of underground space to build public parking lots. City public parking lot shall meet the following conditions:

(1) entrances and exits of parking lots, parking areas, access roads, etc. Meet the design requirements;

(2) Having professional management personnel commensurate with the scale of the parking lot;

(3) Necessary lighting, fire fighting, communication equipment and other management facilities;

(four) there are management systems and safety precautions for vehicle parking, public security and fire management. The municipal administrative department shall strengthen the construction of urban public parking information system and promote the informationization and intelligence of parking management.

The municipal administrative departments of all districts in the main city should incorporate the parking information of public parking lots into the city's public parking information system to help parking people grasp the parking information conveniently, timely and accurately. City public parking lot should be put into use within thirty days, reported to the local county (Autonomous County) municipal administrative departments for the record.

City public parking lots shall not be stopped or used for other purposes without authorization. The management unit of urban public parking lot shall perform the following duties:

(a) express the parking lot signs, service items, supervision telephone number, parking lot management responsibility and management system in a prominent position at the entrance and exit of the parking lot;

(two) responsible for vehicle inspection and registration;

(3) Maintain the parking and driving order of vehicles in the venue;

(four) to do a good job in fire prevention, theft prevention and other safety precautions and custody of the parking lot;

(five) to help ease the traffic at the entrance and exit of the parking lot.

City public * * * parking lot to implement paid services, parking fees shall be implemented in accordance with the relevant provisions of the price administrative department, and clearly marked in the parking lot.

Municipal, public security, price and other administrative departments shall strengthen the supervision and inspection of parking lot management in accordance with the division of responsibilities. The municipal administrative department shall, jointly with the public security and other relevant administrative departments, make overall arrangements for the overall urban planning, urban road traffic planning and regional parking conditions and traffic conditions, and prepare a temporary parking spot setting scheme in accordance with the following provisions:

(a) does not affect the normal traffic of pedestrians and vehicles;

(two) in line with the regional road parking total control requirements;

(3) Adapting to vehicle traffic conditions and road carrying capacity;

(four) the designated parking signs of the designated models, and indicate the parking time limit;

(five) occupy the sidewalk to set up temporary parking spaces, limit parking time, and strengthen the ground.

The temporary parking spot setting scheme shall be publicized to the public for public opinions, and the publicity period shall not be less than seven days. After the expiration of the publicity period, the publicity unit shall adopt the reasonable opinions and suggestions of the public, improve the setting scheme, and jointly announce it to the public by the municipal administrative department and the traffic management department of the public security organ. Temporary parking spots shall not be set in the following urban road facilities:

(a) road intersections, schools, hospitals, public transport stations near the road within 50 meters;

(two) sections that may damage urban green space or trees;

(three) fire exits, fire sites, blind passages;

(four) the connecting roads along the urban trunk roads and expressways and between the primary and secondary trunk roads;

(five) two-way traffic is less than six meters, and one-way traffic is less than two lanes;

(6) A sidewalk with a width less than five meters;

(seven) there is a public parking lot within two hundred meters nearby and it can meet the demand of public parking;

(eight) other sections that are not suitable for setting. Managers of temporary parking spots shall observe the following service specifications:

(a) the staff wear service marks and certificates;

(two) set up obvious parking signs at temporary parking spots, equipped with necessary lighting facilities, and do a good job in fire prevention, theft prevention and storage of vehicles;

(3) Collect parking fees according to the standards approved by the competent price department, use unified tax invoices, and announce parking types, charging time, charging methods, supervision telephone numbers and other matters in a prominent position of temporary parking spots;

(four) shall not arbitrarily change the occupied position, expand the occupied area or change the use;

(five) the decision-making department of the temporary parking spot, the setting range and effective period of the temporary parking spot.

The management department of temporary parking spots shall strengthen daily supervision and management. Temporary parking fees shall be implemented in accordance with the relevant provisions of the competent price department, and the income shall be turned over to the finance, and two lines of revenue and expenditure shall be implemented.

In a limited period of time, the temporary parking time shall not exceed two hours, and the charging standard is higher than that of the surrounding public parking lots; Parking for more than two hours will cost twice as much. In any of the following circumstances, the municipal administrative department shall promptly dismantle the temporary parking spots and restore the road facilities to their original state:

(a) the road traffic conditions change, and the temporary parking affects the normal passage of pedestrians and vehicles;

(two) the public parking lot around the road has been able to meet the parking demand;

(three) other acts that affect urban road traffic;

(4) Where laws and regulations provide otherwise, such provisions shall prevail.

If the temporary parking spot is adjusted or removed, it shall be announced to the public in written form.

In case of natural disasters, bad weather, major safety accidents or major activities, which seriously affect traffic safety and it is difficult to ensure traffic safety by taking other measures, the traffic management department of the public security organ may decide to temporarily stop the use of temporary parking spots and inform the relevant departments. After the disposal, temporary parking spots should be restored to use. Vehicle parking shall comply with the following provisions:

(a) obey the command of the management personnel and park the vehicles in the berth line in an orderly manner;

(two) to pay the motor vehicle parking service fee according to the regulations;

(3) Vehicles carrying inflammable, explosive, toxic, radioactive or polluting substances shall not be parked.
