The relevant administrative departments of the people's governments at or above the county level shall do a good job in soil and water conservation according to their respective responsibilities.
Township (town) people's governments and sub-district offices shall take measures to do a good job in soil and water conservation within their respective jurisdictions. Article 5 People's governments at or above the county level and their relevant departments shall take various forms to strengthen publicity and education on soil and water conservation, incorporate soil and water conservation into the scope of public welfare publicity, the national quality education system and the legal education content of primary and secondary schools, popularize scientific knowledge of soil and water conservation, and enhance public awareness of soil and water conservation. Article 6 The people's governments at or above the county level shall formulate policies, arrange special funds, provide scientific research and experimental sites and talent training bases, encourage and support scientific research and popularization of soil and water conservation, and train talents for soil and water conservation. Chapter II Planning Article 7 The people's governments at or above the county level shall, according to the survey results of soil erosion and the regional socio-economic development plan, delimit and publish key prevention areas and key control areas of soil erosion.
The key prevention and control areas of soil erosion mainly include sensitive areas with fragile ecology or high potential risk of soil erosion, such as Heyuan District, water conservation area and drinking water source protection area. The key control areas of soil erosion mainly include rocky desertification, sloping farmland and other areas with serious soil erosion and deteriorating ecological environment. Article 8 The water and soil conservation plan shall be formulated by the water administrative department of the people's government at or above the county level in conjunction with the relevant departments of the people's government at the same level, and shall be organized and implemented by the water administrative department after being approved by the people's government at the same level or its authorized department. The opinions of experts and the public shall be solicited in the compilation of soil and water conservation plans. The approved water and soil conservation plan shall be reported to the water administrative department of the people's government at the next higher level for the record.
Soil and water conservation planning should be coordinated with related planning. Soil and water conservation planning is divided into general planning and special planning, and special planning should be subject to the general planning.
Cross-regional or river basin water and soil conservation planning shall be compiled by the water administrative department at the next higher level in conjunction with relevant departments, and shall be organized and implemented by the water administrative department after being approved by the people's government at the same level or its authorized department. Ninth infrastructure construction, mineral resources development, urban construction and public service facilities construction planning may cause soil erosion in the implementation process, the planning authority shall put forward countermeasures and measures to prevent soil erosion in the planning. Before the plan is submitted for examination and approval, the opinions of the water administrative department of the people's government at the corresponding level shall be sought. Chapter III Prevention Article 10 People's governments at all levels shall, according to the water and soil conservation plan, take measures such as fence protection and ecological restoration, organize planting trees and grass, expand the coverage area of forest and grass vegetation, conserve water sources, control rocky desertification, and prevent and alleviate soil erosion. Eleventh owners or users of water and soil conservation facilities have the responsibility to manage and maintain water and soil conservation facilities, implement the responsibility of management and protection, and ensure their normal functions. No unit or individual may damage soil and water conservation facilities.
The people's governments of townships and towns shall encourage and guide villagers' committees to formulate village rules and regulations, protect soil and water conservation facilities, and strengthen the construction of ecological environment. Article 12 The water administrative department of the people's government at or above the county level shall strengthen the supervision and management of soil and water conservation in activities such as earth borrowing, sand digging and quarrying, so as to prevent and mitigate soil erosion. Thirteenth it is forbidden to plant crops on steep slopes above 25 degrees.
When planting economic forests on steep slopes above 25 degrees, it is necessary to scientifically select tree species, strengthen tending management, adopt land preparation methods such as fish scale pits and horizontal steps, and take measures such as water storage, water diversion and drainage to prevent soil erosion. Fourteenth it is forbidden to take topsoil in woodland and hillside.
It is forbidden to shovel turf, dig tree pockets, dig sand, quarry or dig Chinese herbal medicines and ornamental stones indiscriminately in key prevention areas and key control areas of soil erosion. Fifteenth in the slope above five degrees, planting trees, planting cash crops, Chinese herbal medicines, etc. , you can take contour, strip and other planting methods that are conducive to soil and water conservation, and arrange horizontal ditches, drainage ditches and other soil and water conservation measures. Article 16 Where production and construction projects that may cause soil erosion are built in mountainous areas, hilly areas and other areas that are prone to soil erosion as determined in the soil and water conservation plan, the production and construction unit shall prepare a soil and water conservation plan and submit it to the water administrative department of the people's government at or above the county level for examination and approval.
The soil and water conservation plan shall be subject to grading examination and approval system. For the production and construction projects approved by the relevant administrative departments of the people's governments at or above the county level, the water and soil conservation plan shall be approved by the water administrative department of the people's government at the same level, and the cross-administrative projects shall be approved by the water administrative department of the people's government at the next higher level.
