The provincial development and reform department shall supervise and manage the bidding announcement and publicity information release activities within its administrative area according to law. Unless otherwise provided by the provincial people's government, such provisions shall prevail. Article 5 The pre-qualification announcement and tender announcement of a project subject to tender according to law shall include the following contents:
(a) the name, content, scope, scale and source of funds of the project subject to tender;
(two) the bidding qualification requirements, and whether to accept the consortium bid;
(three) the time and manner of obtaining the prequalification documents or bidding documents;
(four) the deadline and method for submitting the prequalification documents or bidding documents;
(five) the name, address, contact person and contact information of the tenderer and its procuratorial agency;
(6) Where electronic bidding is adopted, the website and method for potential bidders to visit the electronic bidding trading platform;
(seven) other contents that should be explained according to law. Article 6 The publicity of the candidate winning the bid for a project subject to tender according to law shall include the following contents:
(a) the ranking, name, tender offer, quality, time limit for a project (delivery date) and bid evaluation of the successful candidate;
(two) the name and number of the person in charge of the project and the relevant documents that meet the requirements of the tender documents promised by the successful candidate;
(3) The qualification and ability of the successful candidate to respond to the requirements of the tender documents;
(four) the channels and methods of raising objections;
(5) Other contents stipulated in the tender documents.
The name of the winning bidder shall be specified in the publicity of the winning result of the project that must be subject to tender according to law. Article 7 For a project subject to tender according to law, the tender announcement and publicity information shall be compiled in accordance with the bidding laws and regulations and the standard documents formulated by the National Development and Reform Commission in conjunction with relevant departments, and standardized and formatted. Article 8 For a project subject to tender according to law, the tender announcement and publicity information shall be published on the "China Public Bidding Service Platform" or the provincial electronic bidding service platform where the project is located (hereinafter referred to as the "release media"). Ninth province electronic bidding service platform should be connected with the "China bidding service platform", and in accordance with the provisions of synchronous bidding announcement and public information interaction. For the bidding announcement and publicity information of projects that must be subject to bidding according to law, the publishing media shall share information with the corresponding public resource trading platform.
"China public bidding service platform" shall collect and disclose the national bidding announcement and publicity information, as well as the basic information such as the name, website address, office space and contact information of the publishing media as stipulated in Article 8 of these Measures, maintain and update them in time, share them with the national public resource trading platform, and collect them into the national credit information sharing platform, and make them public through the website of "Credit China" as required. Article 10 The text of the tender announcement and public information to be issued shall be sealed by the tenderer or its tendering agency, and signed by the principal responsible person or the person in charge of the project authorized by it. In the form of data messages, electronic signatures shall be made in accordance with regulations.
The tenderee or its tendering agency shall abide by the time limit stipulated in the laws and regulations on tendering and bidding when issuing the tender announcement and publicity information. Eleventh to encourage the bidding announcement and publicity information of projects that must be carried out according to law to be entered through the electronic bidding trading platform and interacted with the release media for verification and release, or directly entered through the release media for verification and release.
According to the requirements of data specifications related to electronic bidding, the bidding announcement and the text of public information should be exchanged, and the release media should release it within 12 hours after receiving it. If the text of the tender announcement and publicity information is submitted or directly entered in other forms such as e-mail, electronic media, fax and paper text, the release media shall release it within 1 working day from the date of verification and confirmation. The longest verification and confirmation shall not exceed 3 working days.
The tenderee or its tendering agency shall be responsible for the authenticity, accuracy and legality of the tender announcement and publicity information provided by it. The publishing media and electronic bidding trading platform shall be responsible for the timeliness and completeness of the published bidding announcement and publicity information.
The publishing media shall take effective measures in accordance with the provisions to ensure that the data messages that publish tender announcements and public information will not be tampered with, omitted and traceable for at least 10 years. Article 12 The media shall provide free information publishing services for the bidding announcement and publicity of projects that must be tendered according to law, and allow the public and market participants to consult the complete information of the aforementioned bidding announcement and publicity free of charge and in time.
