Chapter I General Provisions
Article 1 These Regulations are formulated in accordance with the Bidding Law of People's Republic of China (PRC) and relevant laws and regulations, combined with the actual situation of this province, in order to standardize the bidding activities of engineering construction projects, protect the national interests, social interests and the legitimate rights and interests of the parties involved in bidding activities, improve economic benefits and ensure the quality of projects.
Article 2 These Regulations shall apply to the tendering and bidding activities of engineering construction projects within the administrative area of this province.
Article 3 The following construction projects, including engineering survey, design, construction, supervision and procurement of important equipment and materials related to engineering construction, must be subject to tender:
(a) large-scale infrastructure, public utilities and other projects related to social interests and public safety;
(2) Projects that are wholly or partially invested with state-owned funds or financed by the state;
(3) Projects that use loans or aid funds from international organizations or foreign governments.
The specific scope and scale standards of the projects listed in the preceding paragraph shall be implemented in accordance with state regulations; Need to make supplementary provisions from the reality of the province, formulated by the administrative department of development and reform of the provincial people's government in conjunction with the relevant departments of the provincial people's government, and submitted to the provincial people's government for approval.
Article 4 The tendering and bidding activities of engineering construction projects shall follow the principles of openness, fairness, impartiality and good faith.
Article 5. Where the examination and approval, filing and approval of the bidding scheme and the qualification determination of the bidding agency need to go through the relevant formalities in accordance with the relevant provisions of the state, they should go through the formalities first and obtain approval.
The relevant administrative supervision departments shall not violate the construction laws and regulations to set up administrative licensing matters involving bidding, such as approval, approval and registration; If it has been established, it shall be cancelled.
