Notice of Hefei Municipal People's Government on Printing and Distributing the Measures for the Administration of Bidding for Construction Projects in Hefei

Chapter I General Provisions Article 1 In order to strengthen the management of bidding for construction projects, promote fair competition in the construction market, ensure project quality, improve investment efficiency and meet the needs of the socialist market economy, these measures are formulated in accordance with the Measures for the Administration of Bidding for Construction Projects issued by the Ministry of Construction and combined with the actual situation of our city. Article 2 All new construction, renovation and expansion of construction and installation projects within the planned area of this Municipality, with a construction area of more than 1.500 square meters (including 1.500 square meters) or a cost of more than 800,000 yuan (including 800,000 yuan) (except for wholly-owned enterprises), shall be subject to the construction project reporting system and bidding according to these measures. Article 3 Hefei Urban and Rural Construction Committee is the administrative department in charge of construction and bidding of construction projects in this Municipality.

Hefei Tendering and Bidding Management Office (hereinafter referred to as the Municipal Tendering Office) is composed of Hefei Construction Management Office and Hefei Branch of China Construction Bank, and is specifically responsible for the comprehensive management, supervision and inspection of bidding and tendering of construction projects in this Municipality. Its main responsibilities are as follows:

(a) to implement the laws, regulations and rules on bidding promulgated by the state and the province, and to formulate detailed rules for the implementation of bidding in this region;

(2) establishing the construction market;

(3) Examining the qualifications of the tendering units;

(four) review the tender application and tender documents;

(five) review the pre-tender estimate;

(6) Organizing and supervising the bid opening, bid evaluation, bid selection and negotiation;

(seven) to mediate disputes in bidding activities;

(eight) to veto the results of the calibration in violation of the provisions of the tender and bid;

(9) Supervising the signing and performance of contracts. Chapter II Application for Construction Article 4 The construction unit must apply to the Municipal Construction Management Office for application for construction while handling the construction project planning permit, and fill in the Application Form for Construction Project Application (attached).

The key projects approved by the relevant provincial authorities or relevant state ministries and commissions do not need to be built, but should be reported to the Municipal Construction Management Office for the record. Fifth City Construction Management Office to verify and classify the contents of construction projects, and regularly or irregularly publish bidding information in the construction market. Article 6 After the construction project submitted for construction has been examined and approved by the Municipal Construction Management Office, the construction unit shall go through the procedures of project quality supervision, bidding, construction contract signing and review in accordance with the relevant provisions, and the Municipal Construction Management Office will issue the construction permit, and the construction unit will hang the certificate for construction. Seventh according to the provisions of the construction project should be reported but not reported, the Municipal Construction Management Office does not issue a "construction permit", the project may not start. Chapter III Bidding Article 8 If a construction unit meets the following conditions, it may apply to Hefei Construction Management Office for examination and approval, and then enter the construction market to organize bidding by itself:

(1) Having the qualification of a legal person;

(2) Having project management, budget management and financial management personnel suitable for the project;

(3) Having the ability to prepare tender documents and pre-tender estimate;

(four) have the ability to conduct qualification examination and organize bid evaluation and selection.

A construction unit that does not meet the above conditions may entrust an engineering consulting company, a supervision company or a similar professional consulting unit with legal personality as a bidding agency. Article 9 A project subject to tender must meet the following conditions:

(a) the construction project has been submitted for construction;

(two) the approved project investment plan (large and medium-sized projects can be based on the approved preliminary design budget), as well as the construction drawings and construction drawing budgets provided by qualified units;

(three) the source of construction funds and equipment has been implemented;

(four) the planning point has been approved by the municipal planning department;

(five) the requisition, demolition and leveling of construction land have been basically completed;

(six) the bidding application has been approved by the Municipal Bidding Office. Tenth bidding can take the following ways:

(1) open tender. The bidding unit shall publicly publish the bidding advertisement through newspapers, radio or television.

(2) Inviting tenders. The tendering unit shall issue a tender announcement or invitation letter to three or more construction enterprises with contracting qualifications.

(3) Bidding negotiation. For projects that are not suitable for public bidding or invitation to bid, with the approval of Hefei Construction Management Office, they can negotiate with construction enterprises with corresponding qualifications. No less than two units (including two) shall participate in the negotiation.

Negotiations shall be conducted according to the following procedures:

(a) the tenderer shall specify the principles and specific conditions for winning the bid for the project subject to tender;

(two) the bidder shall prepare the construction drawing budget and quote;

(three) the tenderer shall preside over the "tender negotiation" meeting, and make a comprehensive evaluation according to the enterprise reputation, technical quality, machinery and equipment, construction period, quotation and other conditions of the tenderer;

(four) the city bidding office to participate in the "negotiation" meeting, mainly to perform the duties of supervision and management;

(five) issued a letter of acceptance. Eleventh construction project bidding can take the whole project bidding, single project bidding, professional project bidding and bid renewal. Twelfth bidding work according to the following procedures:

(a) the construction unit to fill in the tender application submitted to the municipal bidding office for approval.

(two) the construction unit to prepare the tender documents, pre-tender estimate and formulate bid evaluation and calibration methods, and report to the municipal bidding office for approval.

(three) the construction unit issued a tender advertisement or invitation letter.

(four) the Municipal Bidding Office shall, in conjunction with the construction unit, examine the qualifications of the tendering units.

(five) the construction unit shall send the bidding documents, design drawings and technical data to the bidding unit with bidding qualification.

(6) The construction unit shall organize the bidders to conduct on-site reconnaissance and answer questions on the bidding documents.

(seven) the city bidding office in conjunction with the construction unit and other relevant departments to organize the bid opening, review and comment on the bidding documents, and determine the winning bidder.
