Provisions of Taizhou Municipality on Elevator Safety Management

Article 1 In order to strengthen elevator safety, prevent elevator accidents and ensure personal and property safety, these Provisions are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment, the Regulations of Zhejiang Province on Safety Management of Special Equipment and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the production (including design, manufacture, installation, renovation and maintenance), use, maintenance, inspection and testing, emergency handling of faults, safety evaluation and safety supervision and management of elevators within the administrative area of this Municipality.

The range of elevators is determined according to the catalogue of special equipment approved by the State Council.

Elevators for single family use can be managed by themselves according to these regulations. For public use, these Provisions shall apply. Article 3 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over elevator safety work, establish and improve the coordination and assessment mechanism, urge relevant departments to perform their supervision and management duties according to law, and timely solve the problems existing in elevator safety management.

The agencies (institutions) of the people's governments of townships (towns) and sub-district offices, development zones (gathering areas, parks) shall strengthen the supervision and inspection of elevator safety conditions within their respective jurisdictions and assist relevant departments to perform their duties of elevator safety supervision and management according to law. Fourth city and county (city, district) special equipment safety supervision and management departments responsible for the supervision and management of elevator safety within their respective jurisdictions.

The construction administrative department is responsible for the supervision and management of elevator specification and quantity configuration design review in construction projects and the supervision and management of elevator pit, shaft, machine room and other engineering quality; Before the elevator is delivered for use, supervise the construction unit to perform the elevator safety management duties.

Property administrative departments are responsible for urging property service enterprises and owners' committees to perform elevator management duties, and supervising and guiding owners to use property special maintenance funds to maintain, transform and update elevators according to law.

Development and reform, public security, finance, planning, production safety supervision and management, market supervision and management, fire protection, bidding management, education, health, tourism and other relevant departments shall, according to their respective responsibilities, do a good job in elevator safety supervision and management. Fifth special equipment safety supervision and management departments should strengthen elevator safety publicity and education, popularize elevator safety knowledge, and enhance public awareness of elevator safety.

Elevator production, use and maintenance units, inspection and testing institutions and relevant social organizations should strengthen the publicity of elevator safety knowledge and guide the public to use elevators correctly.

Schools and kindergartens should take elevator safety knowledge as an important part of safety education, and cultivate students and children's habit of using elevators safely and civilized.

The news media should strengthen the public welfare propaganda of elevator safety and conduct public opinion supervision on the acts that violate the elevator safety management regulations. Article 6 The elevator industry association shall strengthen industry self-discipline, promote the construction of industry credit system, promote fair and orderly competition in the market, provide elevator safety training, publicity and education, consultation and other services, collect and publish industry information such as elevator safety operation, maintenance price, and assist relevant departments in elevator safety management. Article 7 Elevator industry associations, managers, production units, maintenance units and inspection and testing institutions are encouraged to take out elevator safety liability insurance separately or jointly, and insurance institutions are encouraged to provide elevator safety liability insurance products and services. Article 8 The elevator manufacturing unit shall specify the warranty period of the elevator to ensure the normal supply of main components. The scope of the main components of the elevator is determined according to the relevant national standards.

Elevator manufacturing units shall not set up technical obstacles that affect the normal use and maintenance of elevators.

If the main parts of the elevator are replaced, the renovation or maintenance unit shall specify the warranty period of the relevant parts.

Before the elevator passes the supervision and inspection, the installation, renovation or repair unit shall take effective measures to prevent the elevator from being put into use. Ninth need to install elevators in construction projects, the construction unit shall set up elevators in accordance with the relevant provisions and standards, elevator settings do not meet the relevant provisions and standards, the review body shall not issue a certificate of review of construction drawings and design documents.

Where elevators are purchased by means of bidding, the construction unit shall take product performance, technical support, quality assurance commitment, after-sales service ability and credit evaluation as the conditions for elevator bidding. Tenth elevator shaft, shaft, machine room and other engineering construction shall comply with national standards and technical specifications, meet the requirements of ventilation and cooling, seepage prevention and water leakage, and pass the quality acceptance of engineering construction. Eleventh elevators used by single households shall not be used in public places without the supervision and inspection of special equipment inspection institutions or if they fail to pass the supervision and inspection. Twelfth existing buildings should be installed in accordance with the relevant provisions of the state and the province. Thirteenth elevator management responsibility refers to the units or individuals who enjoy the rights and obligations of elevator management.

If the elevator is managed by itself, the owner shall be the person in charge of management. If the realty service enterprise or others are entrusted to manage the elevator, the trustee shall be the person responsible for the management.

If the newly installed elevator is not handed over to the user, the project construction unit shall be the person in charge of management.

Where a place equipped with elevators is leased or lent, the lessor and the lender shall be responsible for the management, except as otherwise provided by law or agreed by the parties.

The elevator owned by the owner * * * has not been entrusted to others for management, so * * * someone should negotiate to determine the management responsibility; If negotiation fails, the township (town) people's government, neighborhood offices, development zone (cluster area, park) management institutions where the elevator is located shall, in conjunction with the county-level special equipment safety supervision and management department, guide and coordinate the owners to determine the management responsible person.

If the person in charge of management is not determined, the elevator shall not be put into use; Those that have been put into use shall be suspended.
