Measures of Guiyang Municipality on the Administration of Fire Safety

Chapter I General Provisions Article 1 In order to strictly implement the fire safety responsibility, further improve the fire safety management ability, effectively prevent fires and reduce fire hazards, these Measures are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC) and other laws and regulations, combined with the actual situation of this Municipality. Relevant departments of production safety supervision and management, urban and rural planning, education, health, tourism, culture, commerce, housing and urban and rural construction, civil air defense, civil affairs, transportation, sports, urban management, supervision and inspection, and township (town) people's governments and community service management institutions shall, according to their respective functions and duties, do a good job in fire control safety.

Organs, organizations, enterprises and institutions and village (neighborhood) committees shall perform their duties and obligations of fire control safety according to law and do a good job in fire control safety of their own units. Fifth people's governments at all levels should incorporate fire safety management into the annual target management of the people's governments at the corresponding levels, sign target responsibility letters with their subordinate departments, organs, enterprises and institutions and village (neighborhood) committees, and conduct annual assessment. The assessment will serve as an important basis for the comprehensive assessment of the people's government at the same level and its subordinate departments, institutions, enterprises and institutions, and the leading bodies.

People's governments at all levels and their relevant departments, organs, enterprises and institutions, and village (neighborhood) committees are mainly responsible for the fire control work in their own regions, departments, systems, industries and units, and the person in charge is the main person in charge. Article 6 Any unit or individual has the right to complain and report violations of these Provisions to the fire control institutions of public security organs, police stations and other relevant departments. Chapter II General Provisions Article 7 Fire control institutions of public security organs shall strengthen communication with relevant administrative departments on fire control safety information, report major fire hazards found in fire control supervision and management to the local people's government in time, and notify relevant administrative departments to deal with them according to law. Township (town) people's government and village fire water supply facilities are built, managed and maintained by the local township (town) people's government. The local people's government shall, within/0/5 days from the date of listing supervision, instruct the relevant administrative departments or responsible units to formulate rectification measures, clarify the responsible person, rectification period, funds and organizational guarantee, and eliminate fire hazards in time. If no rectification is made within the time limit, the people's government at the same level shall promptly urge the rectification.

Due to historical reasons, the fire permit procedures have not been handled, causing major fire hazards. After the local people's government organizes urban and rural planning, housing and urban and rural construction, civil air defense, fire control institutions of public security organs and other relevant departments and relevant professional and technical personnel to demonstrate, the relevant departments or responsible units will formulate rectification plans and implement them.

For major fire hazards such as fire lanes, fire water supply and fire safety layout in urban and rural fire protection planning that are difficult to rectify in a short period of time, the local people's government shall instruct relevant departments to formulate transformation plans and organize their implementation. Article 10 The relevant administrative departments in charge of education, health, tourism, culture, commerce, housing and urban and rural construction shall, in accordance with the fire safety management standards of seven industries in this Municipality, standardize the fire safety management of their own systems and relevant units in this industry, and continuously improve the level and ability of fire safety management.

The relevant administrative departments of schools, hospitals, nursing homes, welfare homes, urban passenger stations (stations), stadiums and other crowded places shall strengthen the supervision and management of fire safety in such places, and be responsible for raising funds or taking effective measures to rectify the fire hazards that cannot be rectified. Article 11 In the inspection of fire control institutions of public security organs, if it is found that the public gathering place that has obtained the fire safety inspection certificate according to law no longer meets the fire safety conditions and has not been rectified, it shall cancel the fire safety inspection certificate according to law, announce it to the public in time, and notify the relevant administrative departments within 2 working days from the date of cancellation of the fire safety inspection certificate. Article 12 Community service management institutions, property service enterprises and village (neighborhood) committees shall strengthen the publicity and education on fire safety for residents in their respective jurisdictions or service areas, set up fixed fire protection billboards in communities, residential areas and villages to publicize fire safety knowledge, and focus on fire safety publicity, education and assistance for the elderly, the weak, the sick and the disabled in their own areas, and establish corresponding files for these people.
