Regulations of Shanxi Province on the Protection of Electric Power Facilities

Article 1 In order to strengthen the protection of power facilities, ensure the safe and orderly operation of power, and safeguard public interests and safety, these Regulations are formulated in accordance with the provisions of the People's Republic of China (PRC) Electric Power Law, the Regulations on the Protection of Power Facilities and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the protection of power facilities that have been built and completed within the administrative area of this province.

The term "power facilities" as mentioned in these Regulations refers to power generation facilities such as firepower, water power, wind power and photovoltaic, power transmission and transformation facilities, power line facilities, power trading facilities and related auxiliary facilities. Article 3 The people's governments at or above the county level shall strengthen their leadership over the protection of power facilities within their respective administrative areas and coordinate and solve major problems in the protection of power facilities; To organize the compilation of the electric power development plan in this administrative region, so as to coordinate it with the overall land use planning and urban and rural planning, and make overall arrangements for the land for power facilities, power line corridors and cable channels according to the plan. Article 4 The administrative department of economy and informatization of the people's government at or above the county level (hereinafter referred to as the administrative department of electric power) shall be responsible for the supervision and management of the protection of electric power facilities within its administrative area, and perform the following duties:

(1) Organizing publicity and education on the protection of power facilities;

(two) in conjunction with the relevant departments and units along the power line, establish mass organizations and improve the responsibility system;

(three) in conjunction with the local public security departments, strengthen the safety and security of power facilities within their respective jurisdictions;

(four) to accept reports and complaints about violations of laws and regulations related to the protection of power facilities, and investigate and deal with illegal acts of destroying power facilities;

(five) other duties as prescribed by laws and regulations.

The administrative department of electric power may entrust an organization that meets the statutory conditions to carry out supervision and management. Fifth people's governments at or above the county level development and reform, public security, land resources, housing and urban and rural construction and other administrative departments and energy regulatory agencies in accordance with their respective responsibilities, do a good job in the protection of power facilities.

Township (town) people's governments, sub-district offices and village (neighborhood) committees shall assist the relevant departments of the people's governments at or above the county level in the protection of power facilities. Article 6 The owners of power facilities shall establish and improve the safety management and guarantee system, ensure the relevant capital investment, implement preventive measures such as technology, equipment and personnel, patrol, maintain and overhaul power facilities in accordance with relevant norms, eliminate hidden dangers and ensure the safe operation of power facilities. Article 7 The owner of electric power facilities shall formulate an emergency plan for electric power facilities of his own unit, report it to the local electric power administrative department for the record, ensure the reserve and integrity of emergency facilities, equipment and materials according to the requirements of the emergency plan, and conduct emergency drills on a regular basis. Article 8 All units and individuals have the obligation to protect power facilities, and have the right to stop acts that endanger power facilities and report to the administrative department of electric power or the public security organ in time. Article 9 The protection scope of wind power generation facilities includes generators, transformers, booster stations and other related ancillary facilities used for wind power generation.

The protection scope of photovoltaic power generation facilities includes controllers, storage batteries, inverters and other related ancillary facilities for solar power generation, solar thermal power generation systems and other related ancillary facilities.

The protection scope of power trading facilities includes power trading places and related facilities such as measurement, quotation and information release. Article 10 Power line protection zones include the following areas:

(1) Overhead power line protection zone: the area in two parallel planes formed by the conductor sideline extending horizontally outward and perpendicular to the ground. In general, the sideline extension distance of voltage conductors at all levels is as follows:

In densely populated areas such as factories, mines and towns, the area of overhead power line protection zones may be slightly smaller than the above provisions. However, the extension distance of voltage conductor sideline at all levels should not be less than the sum of the maximum calculated sag and the maximum calculated horizontal distance of conductor sideline after wind deflection and the safe distance from the building after wind deflection.

(2) Power cable line protection area: the underground cable is the area within two parallel lines formed by 0.75m on both sides of the cable line pile.

(3) The protected areas of water, oil, gas, ash and heating pipelines attached to the power generation facilities are the areas within two parallel lines formed by 0.75m on both sides of the pipeline edge. Article 11 The administrative department of electric power shall, in accordance with the relevant provisions, set up unified safety signs of power facilities and signs of power line protection zones, and keep the signs intact and effective, and the owners of power facilities shall cooperate with them.

No unit or individual may move or damage the safety signs of power facilities and the signs of power line protection zones without authorization. Article 12 Before planning a power facility construction project, a power facility construction unit shall know the distribution and exploitation of mineral resources where the proposed project is located from the land and resources management department of the local people's government in advance, and the construction of power facilities shall try to avoid important mineral deposits and mined-out areas. Thirteenth power facilities construction project planning is determined, the power facilities construction unit shall promptly notify the administrative department of electric power, the administrative department of electric power shall make an announcement on the legally determined power line protection zones. The announcement shall include the basic information of power facilities, the width of the power line protection zone, the safe distance between the conductor and the crossover, and the protective measures.

Before the announcement, buildings, structures, factories and other facilities owned by law, such as houses, inflammable and explosive goods warehouses, need to be dismantled, moved, trimmed and cut down in the process of power facility construction. The power facility construction unit shall give a one-time compensation in accordance with the relevant provisions of the state and go through the relevant procedures according to law.

After the announcement, no unit or individual may build, rebuild or expand buildings or structures that endanger the safety of power facilities or plant plants that endanger the safety of power facilities in the designated power line protection areas; Buildings, structures or cut plants that need to be demolished according to law shall not be compensated.
