Chapter I General Principles

Article 1 These Regulations are formulated in accordance with the Statistics Law of the People's Republic of China for the purpose of scientifically and effectively organizing and implementing the national population census and ensuring the truthfulness, accuracy, completeness and timeliness of census data.

Article 2 The purpose of the census is to fully grasp the basic situation of the population in the whole country, provide a basis for studying and formulating population policies and economic and social development plans, and provide population information services for the public.

Article 3 The census work shall be organized and implemented in accordance with the principles of unified national leadership, division of labor and cooperation among departments, local responsibility and participation of all parties.

The State Council leads the national census in a unified way, and studies and decides on major issues in the census. Local people's governments at all levels shall lead the census work within their respective administrative areas in accordance with the unified regulations and requirements of the State Council.

During the census work, the people's governments at all levels set up census institutions composed of statistical agencies and relevant departments (hereinafter referred to as census institutions) to be responsible for the organization and implementation of the census.

Villagers' committees and residents' committees shall assist the local people's governments in mobilizing and organizing social forces to do a good job in the population census in their respective regions.

State organs, social organizations, enterprises and institutions shall participate in and cooperate with the census work in accordance with the Statistics Law of the People's Republic of China and the provisions of these Regulations.

Article 4 The census objects shall provide true, accurate, complete and timely information needed for the census in accordance with the Statistics Law of the People's Republic of China and the provisions of these Regulations.

The information provided by the census object shall be kept confidential according to law.

Article 5 Census institutions and their staff, census instructors and enumerators (hereinafter referred to as census personnel) shall independently exercise their powers of investigation, reporting and supervision according to law, and no unit or individual may interfere.

Local people's governments at all levels, departments, units and their responsible persons shall not modify the census data collected and collated by census institutions and census personnel according to law, shall not in any way require census institutions and census personnel and other units and individuals to forge or tamper with census data, and shall not retaliate against census personnel who perform their duties according to law or refuse or resist census violations.

Article 6 People's governments at all levels shall make use of newspapers, radio, television, the Internet and outdoor advertisements to carry out general survey propaganda and mobilization.

Article 7 The funds needed for the census shall be shared by the State Council and local people's governments at all levels, included in the fiscal budget of the current year, and allocated on time to ensure that the full amount is in place.

Census funds should be managed in a unified way, earmarked and strictly controlled.

Article 8 The census shall be conducted once every 10 year, the year with a mantissa of 0 is the census year, and the standard time point is 0: 00 on June 1 1 day of the census year.

Article 9 The National Bureau of Statistics shall, jointly with relevant departments of the State Council, formulate a national census plan (hereinafter referred to as the census plan) and submit it to the State Council for approval.

The census shall be conducted in accordance with the provisions of the census plan.

Article 10 Units and individuals that conscientiously implement these Regulations, be loyal to their duties, adhere to principles and make remarkable achievements shall be commended and rewarded in accordance with relevant state regulations.

Chapter II Objects, Contents and Methods of Population Census

Article 11 The population census targets refer to natural persons in People's Republic of China (PRC) and China citizens who have not settled outside People's Republic of China (PRC), excluding foreigners who have stayed in People's Republic of China (PRC) for a short time.

Article 12 The census mainly investigates the basic information of the population and households, including name, gender, age, nationality, education level, industry, occupation, migration, social security, marriage, birth, death, housing and so on.

Article 13 The census shall be conducted by means of a comprehensive survey and registered door by door.

Article 14 The national statistical classification standards shall be adopted in the population census.

Chapter III Organization and Implementation of Population Census

Fifteenth before the census registration, the public security organ shall complete the household registration in accordance with the provisions of the census plan, and submit the relevant information to the census institutions at the same level.

Sixteenth before the census registration, the census area should be divided. The census area shall be divided into areas under the jurisdiction of villagers' committees and residents' committees, and each census area shall be divided into several census areas.

Seventeenth each census area should have at least one census taker, responsible for household registration and other census work. Each census area should have at least one census instructor, who is responsible for arranging, guiding, supervising and inspecting the work of census takers, or directly registering households.

Eighteenth census instructors and enumerators should have junior high school education or above, good health and strong sense of responsibility.

Nineteenth census instructors and enumerators can be seconded from state organs, social organizations, enterprises and institutions, and can also be hired from villagers' committees, residents' committees or the society. Secondment and recruitment shall be the responsibility of the people's government at the county level.

The state encourages eligible citizens to participate in the census as volunteers.

Twentieth seconded census instructors and enumerators are paid by their original units, and their welfare benefits remain unchanged, and their original jobs are retained.

The labor remuneration of the employed census instructors and enumerators shall be arranged in the census funds and paid by the employing units.

Twenty-first census institutions shall conduct professional training for census instructors and enumerators, and pass the examination and issue a unified national census instructor certificate or enumerator certificate.

When conducting census tasks, census instructors and enumerators shall show their census instructor certificates or census enumerators' certificates.

Twenty-second before the census registration, census instructors and enumerators shall draw a map of the census community and compile a list of household heads in the census community.

Twenty-third census instructors and enumerators shall explain the purpose and legal basis of the census and the rights and obligations of the census objects when they register at home.

Twenty-fourth census objects should provide the information needed for the census on time, truthfully answer the relevant questions, and may not conceal the relevant information, provide false information, or refuse or hinder the census work.

Twenty-fifth census objects should sign or seal the census form for confirmation, and be responsible for the authenticity of its contents.

Twenty-sixth census personnel should persist in seeking truth from facts, abide by professional ethics, and refuse or resist illegal acts in census work.

Census institutions and census personnel shall not forge or tamper with census data, and shall not ask any unit or individual to provide false census data in any way.

Article 27 The post responsibility system for quality control shall be implemented in the census, and the census institutions shall conduct quality control and inspection on all aspects of the census implementation, and review, review and accept the census data.

Article 28 The National Bureau of Statistics shall uniformly organize post-event quality spot checks of census data.

Chapter IV Management and Publication of Census Data

Twenty-ninth local census institutions at all levels shall conduct data processing in accordance with the provisions of the census plan and report the census data on time.

Thirtieth census summary data, except that it should be kept confidential according to law, should be made public.

The main census data of the whole country and all provinces, autonomous regions and municipalities directly under the Central Government are published by the National Bureau of Statistics in the form of bulletins.

The statistical agencies of local people's governments shall publish the main census data within their respective administrative areas and report them to the statistical agencies of the people's governments at the next higher level for approval.

Thirty-first statistical agencies of the people's governments at all levels should do a good job in the management, development and application of census data, and provide inquiry and consulting services for the public.

Article 32 The original census data obtained in the population census shall be preserved and destroyed in accordance with the relevant provisions of the state.

Article 33 No unit or individual may provide or disclose the information obtained in the census that can identify or infer the identity of a single census object, and may not be used as the basis for specific administrative actions against the census object or for purposes other than the census.

Census data shall not be used as the basis for performance evaluation and accountability of local people's governments.

Chapter V Legal Liability

Article 34 If the person in charge of a local people's government, government statistical agency or relevant department or unit commits one of the following acts, it shall be punished by the appointment and removal organ or the supervisory organ according to law, and shall be notified by the statistical agency of the people's government at or above the county level; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Modifying census data or fabricating false census data;

(2) Requiring relevant units and individuals to forge or tamper with census data;

(3) failing to preserve or destroy the census data in accordance with the relevant provisions of the state;

(4) illegally publishing census data;

(five) to take revenge on census personnel who perform their duties according to law or refuse or resist illegal census activities;

(six) to supervise the serious violations of the census in the region, the department and the unit.

Thirty-fifth census institutions in the organization and implementation of census activities have one of the following illegal acts, by the people's government at the same level or the people's government at a higher level statistics institutions shall be ordered to make corrections, and shall be notified; The directly responsible person in charge and other directly responsible personnel shall be punished by the appointment and removal organ or the supervisory organ according to law:

(1) Failing to implement the census plan;

(2) Forging or tampering with census data;

(3) Requiring census objects to provide untrue census data;

(four) failing to submit the census data in accordance with the provisions of the census plan;

(five) in violation of the relevant provisions of the state, resulting in damage or loss of census data;

(6) divulging or providing others with information that can identify or infer the identity of a single census object.

If a census taker commits one of the acts listed in the preceding paragraph, he shall be ordered to stop the census task, be informed and be punished according to law.

Thirty-sixth census objects refuse to provide census data, or provide untrue and incomplete census data, the statistical agencies of the people's governments at or above the county level shall order them to make corrections and give them criticism and education.

If the census object obstructs census institutions and census personnel from carrying out census work according to law, which constitutes a violation of public security administration, the public security organ shall punish them according to law.

Thirty-seventh statistical agencies of the people's governments at or above the county level shall set up reporting telephones and mailboxes to accept the reporting and supervision of illegal acts in the population census by all sectors of society.

Chapter VI Supplementary Provisions

Article 38 The contents and methods of the general survey of soldiers of the China People's Liberation Army and the People's Armed Police shall be formulated by the National Bureau of Statistics in conjunction with the relevant departments of the State Council and the army.

The time and method of census registration in areas with extremely inconvenient transportation shall be stipulated by the National Bureau of Statistics in conjunction with relevant departments of the State Council.

Article 39 The population of the Hong Kong Special Administrative Region and the Macao Special Administrative Region shall be calculated according to the data published by the governments of the Hong Kong Special Administrative Region and the Macao Special Administrative Region.

The population of Taiwan Province Province is calculated according to the data published by the relevant departments of Taiwan Province Province.
