The main channel of the Lancang River is the main channel from Guide Bader to No.243 on the national border. Article 3 The provincial traffic administrative department is the competent department of navigation of the Lancang River, and its navigation management agencies perform specific management duties.
The navigation safety of ships in the main channel of Lancang River is managed by Simao Port Supervision Bureau and Xishuangbanna Port Supervision Bureau. Article 4 The Lancang River waterway development plan shall be formulated by the provincial traffic administrative department according to the needs of opening to the outside world and the principle of overall planning and comprehensive utilization, and shall be implemented after being approved by the provincial people's government. Article 5 Waterways and waterway facilities are protected by law, and no unit or individual may occupy or destroy them.
In addition to the construction projects approved by the state and the provincial people's government, those who engage in activities such as building facilities, dredging, quarrying, borrowing soil, mining gold and stacking materials in the waters, bank slopes, beaches, river beds and other waterways below the highest navigable water level of the Lancang River shall report to the navigation management agency for approval in advance, and those involving water traffic safety shall also obtain the prior consent of the harbour superintendency agencies and operate within the approved scope and methods. However, it shall not hinder the navigation of the ship or damage the navigation channel. Sixth waterway transportation should strictly implement the relevant provisions of the state. Shall not engage in water transport activities without approval. Seventh units and individuals approved to engage in commercial waterway transportation must pay taxes according to law and pay fees according to regulations. Article 8 The navigation and waterway transportation activities of Chinese and foreign ships that specialize in or concurrently engage in inbound and outbound passenger and cargo transportation shall abide by the relevant provisions of the state and relevant international navigation conventions. Article 9 A sailing vessel must be in a seaworthy state, and shall not overload or sail beyond the approved navigation area or route. It is strictly forbidden for ships that do not have the conditions for carrying passengers to carry passengers privately. No dangerous goods may be shipped without the approval of the harbour superintendency administration. Article 10 When ships, rafts, crew members and passengers on board are in distress, they must take effective measures to organize self-help and report the distress situation to the nearest harbour superintendency administration or local people's government promptly. The organ that receives the report shall immediately organize rescue. After receiving the distress signal, the staff on ships, rafts and facilities near the scene of distress should do their best to rescue them. Eleventh ship design and repair, shall be submitted to the provincial shipping management agencies for approval. Without the approval of the ship design and repair units, shall not engage in ship design and repair business.
The design drawings of new ships shall be submitted to the provincial ship inspection department for examination and approval before they can be used.
The operating ship shall be inspected by the provincial ship inspection department and hold a valid ship inspection certificate. Ships that have not been inspected or failed to pass the inspection are prohibited from being put into use. Twelfth water transport units to set up ship-shore radio stations and use other radio communication equipment shall go through the formalities of declaration and approval in accordance with the relevant radio management regulations, and can only be set up and put into use after approval.
The use of radio communication equipment for communication must strictly implement the rules and regulations of radio communication management in waterway transportation industry. Thirteenth port units, ships, rafts and facilities shall not discharge waste oil, residual oil, garbage, feces and other pollutants into the Lancang River. Fourteenth in violation of these provisions and the relevant provisions of the state on the administration of waterway transportation, the provincial waterway bureau or the harbour superintendency agencies shall be punished in accordance with the provisions of relevant laws, regulations and rules.
Violation of public security regulations shall be punished by public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Fifteenth the specific application of these Provisions shall be interpreted by the Provincial Communications Department. Article 16 These Provisions shall come into force as of the date of promulgation.
