Regulations of Rizhao Municipality on Pension Services

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the Regulations of Shandong Province on Pension Services and other laws and regulations, combined with the actual situation of this Municipality, in order to actively respond to the aging population, standardize the work of pension services, improve the pension service system and meet the needs of the elderly. Article 2 These Regulations shall apply to the old-age service and its related activities such as guarantee, encouragement, supervision and management within the administrative area of this Municipality. Article 3 Old-age care services shall adhere to the principles of government leading, family responsibility, social participation, market operation and basic guarantee, and establish an old-age care service system with the characteristics of modern coastal cities, which is coordinated with home community institutions, integrated with medical care, coordinated between urban and rural areas, livable and suitable for business. Article 4 The people's governments of cities and counties (districts) shall strengthen the organization and leadership of the aged care service within their respective administrative areas and perform the following duties:

(a) the old-age service work into the national economic and social development planning;

(two) the old-age service work into the annual work plan and performance appraisal, commend and reward the units and individuals that have made outstanding contributions in the old-age service work;

(three) in accordance with the duties and powers, the land for the construction of old-age service facilities will be included in the national spatial planning, and the land for the old-age service facilities will be guaranteed;

(four) the funds needed for the development of old-age services will be included in the fiscal budget at the same level, and a stable and effective fund guarantee mechanism will be established;

(five) improve the social security system related to the aged care service;

(six) to formulate and publish the list system of local basic old-age services, clarify the service objects, service contents, service standards and expenditure responsibilities, and make timely adjustments according to the level of economic and social development and changes in the demand for old-age services;

(seven) to establish a joint meeting mechanism for the aged care service, clarify the responsibilities and tasks of all relevant departments, and coordinate the work of the aged care service;

(eight) give corresponding construction subsidies and operating subsidies to eligible pension institutions and pension service institutions;

(nine) the water, electricity, gas and heat used in the old-age service places are charged according to the living standards of local residents;

(ten) support state-owned capital, social capital and other ways to participate in pension and industrial development, take the form of government and social capital cooperation, public construction and private, and promote the development of pension service industry;

(eleven) to encourage social forces to use idle hospitals, schools, enterprises and factories, commercial facilities, rural collective houses and other available social resources, which will be used for old-age services after being transformed according to law;

(12) Other related work. Article 5 The people's governments of cities and counties (districts) shall take the following measures to establish the training, use, assessment and incentive mechanism for the aged care service personnel, increase the training of the aged care service personnel, and gradually improve and improve the treatment of the aged care service personnel:

(1) Institutions of higher learning, vocational schools, technical schools, etc. , in which the establishment of pension services related majors, in accordance with the provisions of incentives and subsidies;

(two) graduates from ordinary universities, vocational schools and technical schools who work in the old-age care institutions in this Municipality shall be rewarded or subsidized in accordance with the regulations;

(three) regularly hold professional skills competitions for aged care, and support the recommendation of outstanding aged care workers to participate in all kinds of selection and recognition at all levels;

(4) Medical practitioners, nurses, rehabilitation doctors and other professional and technical personnel engaged in pension services have obtained professional qualifications and registered in the health department in accordance with state regulations, and their professional title evaluation, continuing education, vocational training and skill appraisal enjoy the same treatment as professional and technical personnel in medical and health institutions;

(five) the old-age service institutions shall sign labor contracts with the employees of the old-age service, pay social insurance premiums, strengthen labor protection and occupational protection, and conduct regular health examinations. Article 6 The civil affairs department of the people's government of a city or county (district) is the competent department of pension services within its administrative area, and is responsible for the preparation, business guidance, training evaluation, management supervision and other work of special planning for pension service facilities.

The health department is responsible for the prevention and treatment of diseases, medical care and health management of the elderly in this administrative area.

The medical security department is responsible for medical insurance and long-term care insurance related to old-age care services, including medical institutions set up in eligible old-age care institutions into the scope of management of designated medical insurance agreements, and encouraging commercial insurance institutions to develop commercial care insurance linked to long-term care insurance.

Development and reform, education, public security, finance, human resources and social security, natural resources and planning, housing and urban and rural construction, agriculture and rural areas, culture and tourism, emergency management, auditing, state-owned assets management, administrative examination and approval services, market supervision and management, urban management, comprehensive administrative law enforcement, fire rescue, big data and other departments should do a good job in old-age services in accordance with the division of responsibilities.

Trade unions, * * Communist Youth League, women's federations, disabled persons' federations, overseas Chinese Federation, Red Cross, family planning associations, elderly associations, charitable organizations and other mass organizations participate in the old-age service according to their duties or articles of association. Seventh Township People's governments and sub-district offices shall perform the following duties:

(a) to organize the implementation of pension services within their respective jurisdictions;

(two) to guide the villagers' committees and residents' committees to carry out pension services;

(three) to assist the relevant departments to do a good job in the supervision and management of old-age services;

(four) to guide and support enterprises, institutions, social organizations and individuals to participate in the work of old-age services;

(five) other duties stipulated by the Municipal People's government.
