Regulations of Xuzhou Municipality on the Administration of Voluntary Blood Donation

Article 1 In order to strengthen the management of blood donation without compensation, ensure the need and safety of blood for medical clinical use, and safeguard people's health, these Regulations are formulated in accordance with the provisions of the People's Republic of China (PRC) Blood Donation Law and other laws and regulations, combined with the actual situation of this Municipality.
Article 2 Citizens, legal persons and other organizations within the administrative area of this Municipality shall abide by these Regulations.
Article 3 This Municipality implements the system of blood donation without compensation, and adopts a combination of individual blood storage, family self-help, unit mutual assistance and social assistance.
Article 4 This Municipality implements the management system of unified planning of blood collection and supply institutions, unified management of blood sources, unified blood collection and supply, and rational use of blood for unpaid blood donation.
Article 5 The people's governments of cities and counties (cities) shall lead the work of blood donation without compensation within their respective administrative areas, and organize and coordinate relevant departments to do a good job in blood donation without compensation.
City and county (city) health administrative departments shall supervise and manage blood donation.
Red Cross Societies at all levels shall participate in and promote voluntary blood donation according to law.
Article 6 State organs, social organizations, enterprises, institutions and residents' committees within the administrative area of this Municipality shall do a good job in publicizing blood donation without compensation, and mobilize and organize healthy citizens of their own units and communities to donate blood without compensation.
News units should carry out social public welfare publicity of blood donation without compensation.
Article 7 This Municipality encourages healthy citizens aged 18 to 55 to donate blood voluntarily and without compensation.
Eighth unpaid blood donors with the "resident identity card" can directly to the blood collection agencies or their blood collection points, mobile blood collection vehicles for blood donation registration, but also by their units, neighborhood organizations.
Article 9 The amount of blood donated by unpaid blood donors at one time is generally 200ml, and shall not exceed 400ml at most, and the interval between two blood donations shall not be less than six months.
Citizens who donate blood without compensation shall be sent to blood donation card, which is uniformly produced by the national health administrative department.
It is forbidden to forge, alter, transfer, lease, lend or buy or sell the Certificate of Free Blood Donation.
Article 10 It is forbidden to illegally organize others to sell blood.
It is forbidden to falsely hire others to donate blood.
Article 11 The administrative department of health shall register the personnel who meet the conditions of voluntary blood donation and establish a reserve blood bank.
Blood collection and supply institutions can start the reserve blood bank with the approval of the health administrative department and the consent of the registrant when the blood in stock is insufficient and the medical clinic needs special blood.
Twelfth health administrative departments in the serious shortage of blood or due to natural disasters and accidents and other emergencies need to use blood, you can put forward a blood donation plan, submitted to the people's government at the same level for approval before implementation.
Thirteenth blood collection and supply institutions shall obtain the "Practice License for Blood Collection and Supply Institutions" or "Permit for Blood Collection and Supply" issued by the provincial health administrative department, and engage in blood collection and supply activities within the approved scope of practice.
Fourteenth blood collection and supply institutions shall carry out blood collection and supply activities in accordance with the following procedures:
(1) Fill in the blood donation registration form;
(two) free of charge for blood donors to carry out the necessary health examination;
(3) After checking the "Resident Identity Card" of the blood donor and the blood donation health examination certificate, collect blood samples for inspection;
(four) by qualified personnel in accordance with the blood collection procedures stipulated by the state and the number of blood donors stipulated in Article 9 of these regulations, use disposable blood collection equipment that meets the national standards to collect the blood of those who have passed the inspection;
(five) according to the blood quality standards stipulated by the state, the collected blood is preliminarily inspected and rechecked, and then separated, packaged, stored and supplied.
Citizens whose health does not meet the requirements for blood donation may not collect their blood.
Blood that has not been tested or failed to pass the test shall not be provided to medical institutions.
Fifteenth blood donation must be used for medical clinic, and may not be sold. Blood collection and supply institutions and medical institutions shall not sell blood donated without compensation to apheresis stations or blood products production units.
Sixteenth medical institutions should check whether the blood used is qualified blood provided by legal blood supply institutions before clinical blood transfusion. Unconfirmed blood shall not be used in clinic.
Article 17 Citizens shall pay the fees for blood collection, storage, separation and inspection (hereinafter referred to as the fees for medical clinical blood use) in accordance with the unified charging standards formulated by the state.
The cost of blood for clinical use shall be announced to the society and medical units that use blood.
Eighteenth whoever donates more than 800 ml (including 800 ml) of blood in this city will receive blood for medical clinical use free of charge for life; If the amount of unpaid blood donation does not reach 800 ml, the amount of blood donated by me is 3 times that of free medical clinical blood.
The cumulative blood consumption of spouses, parents and children of unpaid blood donors is equal to the blood consumption of unpaid blood donors for medical clinic.
If the blood donated by unpaid blood donors is unqualified, I will use the same amount of blood for clinical use free of charge.
Article 19 Those who meet the conditions stipulated in Article 18 shall submit their blood donation receipts, blood donation card, resident identity cards, household registration books and other valid documents to the health administrative department or its designated institutions for reimbursement of preferential blood use expenses.
Twentieth any of the following circumstances, by the city and county (city) people's government, the administrative department of health and the Red Cross to give recognition and reward:
(1) Individuals donate blood for free 1000 ml or more;
(two) the completion of the blood donation plan;
(three) publicity, education and organization of blood donation work has made remarkable achievements;
(4) remarkable achievements have been made in the research and popularization of new technologies of blood for medical clinical use;
(five) others who have made remarkable achievements in blood donation, blood collection, blood supply and medical clinical use.
Twenty-first one of the following acts shall be banned by the municipal and county (city) health administrative department, and the illegal income shall be confiscated, and a fine of 1 10,000 yuan but not more than 50,000 yuan may be imposed; If the circumstances are serious, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(1) illegally collecting blood;
(2) Blood collection and supply institutions and medical institutions sell blood donated without compensation;
(3) illegally organizing others to sell blood.
Twenty-second one of the following acts, the city and county (city) health administrative department shall order it to make corrections, and shall be punished in accordance with the following provisions; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) failing to truthfully issue a "blood donation certificate", a fine of one hundred yuan or more and one thousand yuan or less shall be imposed;
(two) forge, alter, transfer, lease, lend, buy and sell the "blood donation certificate", and impose a fine of one hundred yuan to one thousand yuan; Among them, for the purpose of making profits, a fine of not less than one thousand yuan but not more than five thousand yuan shall be imposed;
(three) employing others to donate blood by fraud, and imposing a fine of 5,000 yuan to 20,000 yuan; Impose a fine of more than 100 yuan and less than 1000 yuan on the individual, and the unit or the competent department at a higher level shall give administrative sanctions to the relevant responsible personnel;
(4) If the packaging, storage and transportation of blood for clinical use do not meet the hygienic standards and requirements stipulated by the state, it shall be given a warning and may be fined between 1,000 yuan and 10,000 yuan;
(5) Whoever uses blood for clinical purposes without verification shall be fined between 1,000 yuan and 5,000 yuan.
Twenty-third blood collection and supply institutions provide medical institutions with blood that does not meet the standards prescribed by the state, and the health administrative department at or above the county level shall order it to make corrections; If the circumstances are serious, resulting in the spread of blood-borne diseases or serious risk of spread, rectification shall be made within a time limit, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-fourth medical institutions provide patients with blood that does not meet the standards prescribed by the state, and the health administrative department at or above the county level shall order them to make corrections; If damage is caused to the patient, compensation shall be made according to law; The directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-fifth if a party refuses to accept the decision of administrative punishment made by the administrative department of health, it may apply for administrative reconsideration or bring an administrative lawsuit according to law. If a party fails to apply for administrative reconsideration, bring an administrative lawsuit or perform the decision on administrative punishment within the time limit, the health administrative department that made the decision on administrative punishment shall apply to the people's court for compulsory execution according to law.
Twenty-sixth health administrative departments and their staff in the supervision and management of unpaid blood donation dereliction of duty, abuse of power, corruption, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 27 These Regulations shall come into force on June 20 10 1999.
