How much is the compensation for house demolition in Kunming?

Kunming should develop into a developed city. As Kunming people, everyone supports it. The original intention of urban village reconstruction is to improve the quality of life of residents in urban villages and benefit the villagers in urban villages. But when the party's policies are implemented at the grassroots level, it becomes a "profit-making project for some people at the expense of farmers' interests". Without seeing the real developer, the villagers' meeting was held to discuss and understand the compensation scheme for the transformation, and they moved out of the house they had worked hard for all their lives in extreme panic. Everyone is thinking: how to live in the future?

We were farmers before 1993. The party's good policies enable us to own our own land, and we can do some small businesses to support our families. The work in the field is hard, but we are very happy to see the grain that is about to be harvested. We thank the Party from the heart and our beloved * * * and Deng Xiaoping!

From 1993 to 1994, our land was expropriated by the high-tech development zone, and the compensation for land expropriation was a one-time buyout, with 18 above 13000 yuan and 18 below/8000 yuan. Faced with such a low compensation, we didn't ask the government for more, and we cooperated with the government very much. We are still strong to live! At that time, he was over 50 years old, and no one wanted to find a job. In order not to disturb the children, those who have labor go to pick up some waste paper plastic bottles and change some money to supplement their families. Parents in their 30 s and 50 s, old and young, can only do odd jobs, sell coolies everywhere, take pains to run cars, sell vegetables and collect garbage in order not to let their children starve and the elderly suffer ... The same thing all of us do is to scrimp and save! All our prayers are only one sentence: "I hope my family is safe and healthy"! Because the medical expenses are too high, we are too poor to afford the extra expenses.

In 2003, we found that renting out part of our house can collect rent and become a source of life. We thank God for finally giving us hope for survival! So we began to work harder to make money and put all our money into houses, from straw houses to adobe houses, from adobe houses to brick houses. We collected the rent and saved it to build a house, one floor, two floors, three floors ... Up to now, the house has become taller and more beautiful, and we are old and old. I have always felt that life is stable now, and I should eat better if I have money. If I want, I will go to Tiananmen Square, and we look forward to a bright future! !

In 2009, the government said it would transform the village in the city, and publicized on TV to improve the quality of life of the villagers in the village in the city. This policy is beneficial to the villagers in the village, but now, it is said that the relocation will begin in July 1! We want to know:

1. Article 4 of Chapter 1 of People's Republic of China (PRC) Property Law stipulates that the property rights of the state, the collective and the private are protected by law, and no unit or individual may infringe upon them. Article 152 of Chapter XIII stipulates that the right to use the homestead shall have the right to possess and use the collectively owned land according to law, and the right to use the land to build houses and ancillary facilities according to law. Our homestead is a state-owned land use certificate issued after approval by the land department. Our house is a private property built after submitting an application to the group and is protected by national laws. How to open it without any explanation?

2. The municipal government document said: "In the main examination and approval procedures for the special planning of urban village reconstruction, the demolition and resettlement plan must be submitted to the grassroots democratic vote (more than 90%), and the district government can report it to the municipal planning department for examination and approval. After the approval of the special plan, it will be reported to the leading group for the reconstruction of urban villages in the city and listed in the catalogue of the reconstruction planning of urban villages in Kunming. " Why haven't we held a villagers' meeting to discuss the planning scheme? Without more than 90% of the villagers signing the demolition contract, our village will be listed in the catalogue of urban village reconstruction planning. Who signed it for us?

3. The reconstruction project of villages in cities is guided by the government and planned by introducing market mechanism. Isn't the market about buying and selling? Why can't buyers and sellers bargain, but the price of "classic one city" property is 5900 ~ 7000 yuan per square meter. Why is our house only worth 2000 yuan per square meter on the same plot? The price stipulated in the Guiding Opinions on Compensation and Resettlement for Land Requisition and Demolition in the Reconstruction of Villages in Kunming City is only the minimum compensation standard. Why can we only compensate at the lowest price? Why does the high-tech zone have to set such a shameless price that we can only accept it?

Since developers are investing in the renovation of our village, why haven't they been there? Where is their compensation plan for demolition? Neighborhood committees and residents' groups have been demanding demolition. They are just villagers' self-governing organizations, elected by the villagers, exercising the rights entrusted by the villagers, and the villagers do not agree to the demolition. What qualifications do they have to discuss matters related to demolition on our behalf?

We built a house on our own homestead and did not violate the relevant provisions of the State Property Law. Why do illegal buildings exceeding 300 square meters only pay 700 yuan per square meter?

6. With such a low demolition price, we have to choose the form of demolition, but how can we get the relocated house? Will it give us a house with poor geographical location, poor lighting and poor floors? Can we sell the relocated houses? Now many houses are empty and can't be sold, and there will be a large number of houses after the transformation of the village in the city. Can our house be sold? Can I rent the house if it is not for sale? If you can't rent it out, you have to pay a high property management fee. Can we afford it? If the pool of high-rise buildings is calculated as 15%, 45 square meters of the 300 square meters we moved back will be lost in vain. Is this fair to us? The relocated house is just a rough house. Even if you can get it, it will cost 60,000 to 70,000 for casual decoration and 60,000 to 70,000 for supporting fees. Where can I collect the extra 654.38+0.5 million? The property right of commercial housing is only 70 years. Will the house still belong to our children and grandchildren in 70 years?

7. We work hard to create collective assets. If the collective assets are demolished, how to distribute them? The group said that the money should be used as a public welfare fund. Who will manage such a huge public welfare fund? Who will supervise?

8. We are confused. What's our status now? Is it a farmer? No, because we have no land, and now even the homestead will be taken back by the state! ! Are we workers? No, because we have no job, no medical insurance and no minimum living allowance! ! Then what are we? How will we survive? Who will arrange the work for the young and middle-aged laborers in the village? Who will share the medical expenses when you are sick?

We have lived in our own village for generations, worked hard to feed ourselves and contributed our strength to the vegetable basket of urban residents. We just want to compensate our house reasonably. Is there something wrong? Fellow villagers, brothers and sisters, there are still many problems in our renovation and demolition. Can you sign it in a muddle? Looking at the house that I have worked so hard to build all my life, like other groups, I don't know when it will be built, and it has become a relocated house with too much risk and no future. Can we stop crying? This is our life, and it is the economic source for our survival! !

We don't know anything now, but listen to rumors from other groups: this is an irresistible national transformation; The government has given a time limit, and if it is not demolished at the expiration, it will be forcibly demolished without giving you a penny; If you don't move, cut off water and electricity, and find other people in the society to make trouble and hit you; At that time, they will send people to your house to intimidate you, induce you to sign an agreement, and voluntarily hand over the keys, real estate licenses, land certificates and other scary words. If you sign it, it's too late to cry again, because you volunteered.

There are formal declaration and approval procedures for the transformation of villages in cities stipulated by the municipal government. Developers meet certain conditions before they are eligible for renovation, and more than 90% of the villagers agree to demolition and renovation. We haven't seen these programs. The high-tech zone government said: "If you don't want to sign, you don't have to tear it down!" Do you agree to the demolition? Maybe everyone has insomnia because of the demolition. I hope you can use this time to think about the past and the future and make the right decision. If you don't agree to the demolition and reconstruction, please sign it. We want the city and the province to know what is happening here that harms our interests. We want the city and the province to hear our true voice at the bottom! ! But these all need everyone's unity! !
