Measures of Yunnan Province for the Administration of Recycling and Dismantling Scrap Motor Vehicles

Article 1 In order to regulate the recycling and dismantling of scrapped motor vehicles, ensure the safety of road traffic and life and property, prevent and control environmental pollution, and promote the comprehensive utilization of resources, these measures are formulated in accordance with the Law of the People's Republic of China on Road Traffic Safety, the Measures for the Administration of Scrap Motor Vehicles Recycling and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the recycling, dismantling, supervision and management activities of scrapped motor vehicles within the administrative area of this province. The term "scrapped motor vehicles" as mentioned in these Measures refers to motor vehicles that meet the compulsory scrapping standards stipulated by the state.

Motor vehicles that do not meet the mandatory scrapping standards, and the owners of motor vehicles voluntarily scrap, shall be recycled and dismantled with reference to these measures. Article 3 The people's governments at or above the county level shall strengthen the leadership over the supervision and management of the recycling and dismantling of scrapped motor vehicles, establish and improve the coordination mechanism, and incorporate the funds needed for recycling and dismantling of scrapped motor vehicles into the fiscal budget at the corresponding level.

The competent department of industry and information technology at or above the county level shall be responsible for the supervision and management of the recycling and dismantling activities of scrapped motor vehicles.

Public security organs, environmental protection, industrial and commercial administration departments shall, in accordance with their respective responsibilities, do a good job in the supervision and management of the recycling and dismantling of scrapped motor vehicles. Article 4 The competent department of industry and information technology of the province shall, jointly with the relevant units, prepare the development plan for the recycling and dismantling industry of scrapped motor vehicles in this province according to law and organize its implementation. State (city) and county (city, district) people's governments shall incorporate the recycling and dismantling places of scrapped motor vehicles into urban and rural planning, and incorporate the trading market of used motor vehicles and their parts into the local market construction planning. Article 5 The people's governments at or above the county level shall encourage the recycling and dismantling industry associations of scrapped motor vehicles to play their self-discipline role and provide services in industry statistics, information consultation, technology promotion, publicity and training, service system construction and social credit evaluation. Article 6 People's governments at or above the county level shall encourage old cars to be scrapped and updated, and the finance at the same level shall give subsidies and rewards. Specific measures shall be formulated by the competent department of industry and information technology in conjunction with relevant departments such as finance, and shall be implemented after being approved by the people's government at the corresponding level. Advocate organs, institutions and state-owned enterprises at all levels to take the lead in scrapping yellow-label cars and old cars. Seventh people's governments at or above the county level shall support the scientific research and development of the recycling and dismantling of scrapped motor vehicles, promote the application of new technologies, new processes and new equipment, and promote the upgrading and transformation of recycling and dismantling enterprises. Article 8 Enterprises engaged in the recycling and dismantling of scrapped motor vehicles shall meet the conditions stipulated by relevant laws and administrative regulations, and meet the development plan and relevant standards and norms of the recycling and dismantling industry of scrapped motor vehicles. The competent department of industry and information technology shall conduct examination in accordance with the relevant provisions of the state.

It is forbidden for scrapped motor vehicle recycling and dismantling enterprises to allow non-scrapped motor vehicle recycling and dismantling enterprises or individuals to operate scrapped motor vehicle recycling and dismantling business by means of leasing, entrustment and affiliation. Ninth scrapped motor vehicle recycling and dismantling enterprises should set up reasonable recycling outlets. The site area of recycling outlets is not less than 2,000 square meters, and it has facilities and equipment such as recycling, storage, office, fire protection and environmental protection that meet the standards and more than 3 professional recycling personnel. Recycling outlets shall not dismantle and recycle scrapped motor vehicles without authorization. Article 10 The owner of a motor vehicle that meets the compulsory scrapping standards shall sell it to the scrapping motor vehicle recycling and dismantling enterprise according to law, and handle the scrapping cancellation registration.

If it is impossible to drive back to the vehicle registration place due to motor vehicle damage, the owner can sell the motor vehicle to the scrapped motor vehicle recycling and dismantling enterprise nearby, and the scrapped motor vehicle recycling and dismantling enterprise will verify it, and report the relevant information of the vehicle to the provincial competent department of industry and information technology. Eleventh scrapped motor vehicle recycling and dismantling enterprises to recycle scrapped motor vehicles, should pay the purchase fee to the owner of motor vehicles, issue a scrap motor vehicle recycling certificate, and go through the cancellation registration of motor vehicles with the public security organ in accordance with the relevant provisions.

The recycling certificate of scrapped motor vehicles shall be uniformly printed and managed by the provincial competent department of industry and information technology in accordance with the style stipulated by the national competent department of industry. Article 12 It is forbidden for scrap metal purchasing enterprises, automobile maintenance enterprises and other units or individuals to illegally purchase and disassemble scrapped motor vehicles and engines, steering gears, transmissions, front and rear axles and frames of scrapped motor vehicles (hereinafter referred to as "five assemblies"). Article 13 When handling the registration of newly purchased motor vehicles and the issuance of vehicle operation licenses, the public security organs and transportation management departments shall inform and urge the owners of motor vehicles to go through the formalities of scrapping and deregistration of vehicles whose names meet the compulsory scrapping standards according to law. Fourteenth operating buses and non-operating buses, dangerous goods transport trucks, semi-trailers and other trucks and semi-trailers change the nature of use, and their service life and scrapping shall be implemented in accordance with the Provisions on Operating Passenger Cars and Dangerous Goods Transport Trucks and Semi-trailers. Fifteenth enterprises engaged in the recycling and dismantling of scrapped motor vehicles shall establish the archives and information management system for the recycling and dismantling of scrapped motor vehicles, truthfully record the relevant information in the process of recycling and dismantling, and submit it to the relevant departments of industry and information technology in accordance with regulations. The retention period of information records shall not be less than 3 years. Sixteenth scrapped motor vehicle recycling and dismantling enterprises shall, in accordance with the relevant standards and norms, adopt a dismantling method that is conducive to preventing environmental pollution and recycle spare parts and materials. Scrapped large buses, school buses, trucks and other operating vehicles shall be disintegrated under the supervision of public security organs.

Other parts and components other than the "Five Assemblies" dismantled by scrapped motor vehicles recycling and dismantling enterprises can be sold if they meet the mandatory requirements of national technical specifications, but they should be marked with "Reuse Parts and Components of Scrapped Motor Vehicles" and the name of the recycling and dismantling enterprise. Hazardous wastes such as dismantled waste batteries should be disposed of by units with corresponding hazardous waste disposal business licenses.
