Article 1 In order to comprehensively strengthen the management of national e-government construction projects, ensure the quality of project construction and improve the investment benefit, these Measures are formulated in accordance with the Decision of the State Council on the Reform of Investment System and relevant regulations.
Article 2 These Measures shall apply to national e-government construction projects using central financial funds (hereinafter referred to as "e-government projects").
Article 3 The e-government projects mentioned in these Measures mainly refer to: national unified e-government network, national key business information system, national basic information base, national e-government network and information security system related infrastructure, national e-government standardization system and e-government related support system.
The construction of e-government project should take the development and utilization of government information resources as the main line, rely on the national unified e-government network, focus on improving the application level and exerting the system efficiency, deepen the application of e-government, promote the interconnection, information sharing and business collaboration of application systems, build an e-government system in line with China's national conditions, improve administrative efficiency, reduce administrative costs, and give full play to the role of e-government in strengthening economic regulation, market supervision, improving social management and public services.
Article 4 The project construction units mentioned in these Measures refer to the central government departments and local government departments that participate in the construction of national e-government projects. Project construction units are responsible for applying for e-government projects, organizing or participating in the design, construction, operation and maintenance of e-government projects.
Article 5 The project examination and approval department mentioned in these Measures refers to the National Development and Reform Commission. The project examination and approval department is responsible for the preparation of the national e-government construction plan and the examination and approval of e-government projects, and shall supervise and manage the e-government projects jointly with relevant departments.
Chapter II Administration of Declaration and Approval
Sixth project construction units should be based on the relevant documents of the Central Committee and the State Council and the national e-government construction plan, research and put forward the application for e-government projects.
Article 7 In principle, e-government projects include the following examination and approval links: project proposal, feasibility study report, preliminary design scheme and investment estimation. If the total investment is less than 30 million yuan and there are special circumstances, it can be simplified as approving the project feasibility study report (on behalf of the project proposal), preliminary design scheme and investment estimation.
Eighth project construction units should be in accordance with the "national e-government project construction project proposal preparation requirements" (annex 1), organize the preparation of project proposals, submitted to the project examination and approval department. The project examination and approval department shall solicit the opinions of relevant departments, entrust a qualified consulting agency to conduct examination and approval after evaluation, or submit it to the State Council for approval and issue a reply. The project construction unit shall organize the project demand analysis in the preparation stage of the project proposal, form a demand analysis report and send it to the project examination and approval department to organize experts to put forward opinions as a reference for the preparation of the project proposal.
Article 9 The project construction unit shall, according to the approval of the project proposal, and in accordance with the Requirements for the Preparation of Feasibility Study Report of National E-government Project Construction Project (Annex 2), select by public bidding or entrust an engineering consulting institution with Grade A qualification of relevant majors to prepare the feasibility study report of the project, and submit it to the project examination and approval department. The project examination and approval department entrusts a qualified consulting agency for review and approval, or issues a reply after reporting to the State Council for examination and approval.
Article 10 The project construction unit shall, according to the approval of the project examination and approval department on the feasibility study report, select or entrust a design unit with Grade A qualification of relevant majors to prepare the preliminary design plan and investment budget report and submit it to the project examination and approval department. The project examination and approval department entrusts a special examination institution for examination and approval.
Eleventh e-government projects built by the central and local government departments, led by the central government departments to organize local government departments to prepare project proposals, involving local construction content and investment planning, should seek the opinions of local development and reform departments. After the overall approval of the project proposal by the project examination and approval department, the central and local government departments shall prepare the project feasibility study report, preliminary design scheme and investment budget respectively, and report them to the development and reform department at the same level for examination and approval. The local development and reform department shall examine and approve the feasibility study report submitted by the local government department in accordance with the requirements for examination and approval of the project proposal, and solicit the opinions of the central government department in advance. Where the local development and reform department has special provisions on the examination and approval of feasibility study report, preliminary design scheme and investment budget, it may refer to local regulations.
Article 12 For local e-government projects built by the central and local governments that need to apply for central financial subsidies, local government departments shall organize the preparation of fund application reports in accordance with the Interim Measures for the Administration of Investment Subsidies and Discounted Projects in the Central Budget (Order No.31of the National Development and Reform Commission), which shall be audited by local development and reform departments and submitted to the project examination and approval departments for examination and approval. Grant funds can be paid in one lump sum or in installments according to the project construction progress.
Thirteenth project approval departments for e-government project project proposal, feasibility study report, preliminary design and investment budget and other approval documents are the main basis for project construction. In principle, the control indicators such as construction content, scale, standard and total investment budget approved in the reply should be strictly observed.
If there are significant changes in the contents of the preparation of the project feasibility study report and the approval of the project proposal, the project proposal should be resubmitted. If the contents of the preliminary design scheme and investment budget report of the project are significantly changed from those approved in the feasibility study report of the project, or the changed investment exceeds 10% of the approved total investment, the feasibility study report shall be resubmitted. If the contents of the preliminary design scheme and investment estimate report of the project are slightly adjusted with the approved contents of the feasibility study report of the project, and the adjusted contents do not exceed 65,438+00% of the approved total investment, it is necessary to make quantitative supplementary explanations in separate chapters of the adjustment part when submitting the preliminary design scheme and investment estimate report of the project.
Chapter III Construction Management
Fourteenth project construction units should establish and improve the responsibility system, strictly implement the bidding, government procurement, project supervision, contract management and other systems.
Fifteenth project construction units should determine the project implementation agencies and project leaders, and establish and improve the project management system. The person in charge of the project shall report the design changes, construction progress and budget control in the process of project construction to the project examination and approval department. The competent leader of the project construction unit is fully responsible for the project construction progress, quality, fund management and operation management.
Article 16 The procurement of goods, projects and services for e-government projects shall be conducted in accordance with the relevant provisions of the Bidding Law of People's Republic of China (PRC) and the Procurement Law of People's Republic of China (PRC), and follow the principle of giving priority to the procurement of domestic goods, projects and services.
Seventeenth project construction units shall organize bidding and purchasing according to the law and in accordance with the contents and methods of bidding approved when the feasibility study report is approved, and determine the winning bidder with corresponding qualifications and abilities. The project construction unit shall conclude a contract with the winning bidder and strictly perform the contract.
Eighteenth e-government projects to implement the project supervision system. The project construction unit shall, in accordance with the relevant provisions of information system engineering supervision, entrust an engineering supervision unit with corresponding information system engineering supervision qualification to supervise the project construction.
Nineteenth project construction units should be at the end of July each year and the following year 1 before the end of the month, to the project examination and approval department and the financial sector report the first half of the year and the annual project construction progress and budget implementation.
Twentieth project construction units must implement the project construction in strict accordance with the preliminary design plan and investment budget approved by the project examination and approval department. If there are special circumstances, it is necessary to adjust the main construction content or investment budget, and the adjustment report must be submitted to the project examination and approval department in advance to perform the examination and approval procedures. If a major design change is made without approval, resulting in an over-estimate, the project examination and approval department will no longer accept the application for post-event adjustment.
Twenty-first in the process of project construction, the project construction unit shall report to the project examination and approval department in a timely manner, and the project examination and approval department may require the project construction unit to rectify and suspend the project construction in accordance with relevant regulations.
Chapter IV Fund Management
Twenty-second project construction units in the feasibility study report approved, you can apply for funds for the preliminary work of the project. The preliminary work funds of the project are mainly used to carry out application demand analysis, project proposal, feasibility study, preliminary design scheme and investment estimation, expert consultation and evaluation, etc. The project examination and approval department shall verify the preliminary work funds according to the actual situation of the project, and the preliminary work funds shall be included in the total investment of the project.
Article 23 After the preliminary design scheme and investment budget are approved and the conditions for commencement are met, the project construction unit shall submit an application for the annual fund use plan to the project examination and approval department according to the project implementation progress, and the project examination and approval department shall use it as the basis for issuing the annual central investment plan.
Before the preliminary design scheme and investment estimate are approved, the project construction funds shall not be issued in principle. For e-government projects that really need to arrange funds in advance (such as land purchase, house purchase, demolition, etc. ), the project construction unit may, after the approval of the project feasibility study report, apply to the project examination and approval department for the use of funds, explain the reasons and reasons for arranging funds in advance, and issue the project construction funds after the approval of the project examination and approval department.
Twenty-fourth project construction units should use financial funds in strict accordance with the relevant provisions of financial management, special account management, earmarking.
Chapter V Supervision and Administration
Twenty-fifth project construction units should accept the supervision and management of the project examination and approval departments and relevant departments.
Twenty-sixth project examination and approval department is responsible for the inspection of e-government projects, mainly to supervise and inspect the implementation of relevant laws, regulations and policies by the project construction unit in the process of project construction, as well as the project bidding, project quality, progress, fund use and budget control. During the inspection, it is found that there is a violation of the relevant provisions of the state and the requirements for examination and approval. The project examination and approval department may require the project construction unit to rectify within a time limit or deal with it in accordance with relevant regulations. For those who refuse to make rectification or still fail to meet the requirements after rectification, the project examination and approval department may give informed criticism, suspend the allocation of construction funds, suspend project construction and terminate the project.
Twenty-seventh relevant departments shall supervise and manage the procurement, the use of funds and whether they comply with the relevant provisions of the state.
Twenty-eighth project construction units and relevant departments shall assist in inspection, audit and other supervision and management, truthfully provide the relevant information and materials of the construction project, and shall not refuse, conceal or conceal.
Chapter VI Acceptance Evaluation Management
Twenty-ninth e-government project construction to implement the acceptance and post evaluation system.
Thirtieth e-government projects shall be carried out in accordance with the relevant provisions of the national e-government construction project acceptance outline (Annex 4, hereinafter referred to as the acceptance outline). The project acceptance includes two stages: preliminary acceptance and completion acceptance. The preliminary acceptance shall be organized by the project construction unit according to the requirements of the acceptance work outline; The completion acceptance is organized by the e-government project completion acceptance committee established by the project examination and approval department or its organization; For e-government projects with small construction scale or simple construction content, the project examination and approval department may entrust the project construction unit to organize acceptance.
Thirty-first project construction units shall complete the information security risk assessment and preliminary acceptance of construction projects within half a year after completing the project construction tasks. After the preliminary acceptance, the project construction unit shall submit the application report for completion acceptance to the project examination and approval department, and submit the project construction summary, preliminary acceptance report, financial report, audit report and information security risk assessment report as attachments. The project examination and approval department shall timely organize the completion acceptance. If the project construction unit fails to submit the application for completion acceptance on schedule, it shall submit an application for extension acceptance to the project examination and approval department.
Thirty-second project examination and approval department according to the operation of e-government projects after acceptance, can timely organize experts or entrust relevant institutions to post-evaluate the system operation efficiency and use effect of construction projects. After evaluation, if the construction project fails to reach the approved construction goal or the expected effect, the project construction unit shall make rectification within a time limit; For those who refuse to make rectification or still do not meet the requirements after rectification, the project examination and approval department may conduct informed criticism.
Chapter VII Operation Management
Thirty-third e-government projects after the completion of the operation and management of the project construction unit responsibility system. The project construction unit shall establish the project operation organization, formulate and improve the corresponding management system, strengthen the daily operation and maintenance management, and implement the operation and maintenance expenses. Encourage professional service organizations to participate in the operation and maintenance of e-government projects.
Article 34 The project construction unit or the professional organization entrusted by it shall, in accordance with the relevant provisions of risk assessment, conduct information security risk assessment on the completed project, test the adaptability of its network and information system to changes in the security environment and the effectiveness of security measures, and ensure the realization of information security objectives.
Chapter VIII Legal Liability
Thirty-fifth relevant departments, units or individuals in violation of the relevant provisions of the state, interception, misappropriation of funds for e-government projects. , by the relevant departments in accordance with the relevant provisions of the "Regulations on penalties and sanctions for financial violations" shall be punished; If the case constitutes a crime, it shall be handed over to the relevant departments for criminal responsibility according to law.
Article 36 In case of violation of other provisions of these measures or due to poor management and fraud, resulting in serious over-estimation, poor quality, loss and waste, safety accidents or other accidents, the project examination and approval department may give informed criticism and request the relevant departments to punish the directly responsible person in charge and other responsible personnel according to law; If the case constitutes a crime, it shall be handed over to the relevant departments for criminal responsibility according to law.
Chapter IX Supplementary Provisions
Article 37 These Measures shall be interpreted by the National Development and Reform Commission.

I. Time limit for acceptance
Within half a year after the completion of e-government project construction, the project construction unit shall complete the preliminary acceptance work and submit an application report for completion acceptance to the project examination and approval department.
If the application report for completion acceptance cannot be submitted on time due to special reasons, the project construction unit shall submit an application for extension of acceptance to the project examination and approval department. With the approval of the project examination and approval department, the completion acceptance can be appropriately postponed.
Second, the acceptance task

Three. Acceptance basis

Four. acceptance condition
(1) The main works and auxiliary facilities such as network, application and security determined by the construction project have been completed as designed and can meet the needs of system operation.
(two) the main projects and supporting facilities such as network, application and security determined by the construction project have passed the test and trial operation.
(three) the protection, safety, fire protection and other facilities involved in the operation environment of the construction project system have been built synchronously with the main project according to the design and passed the trial operation.
(four) the preliminary work of the construction project has been completed, which can meet the needs of the normal operation of the project.
(five) to complete the budget implementation report and preliminary financial statements.
