Article 8 An enterprise that meets the conditions in Items (1) to (4) of Article 6, and also meets one of the following conditions, can be directly recognized as meeting the conditions of small and medium-sized science and technology enterprises:

(two) the enterprise has won the national science and technology award in the past five years, and ranked among the top three winners;
(3) The enterprise has been recognized by R&D institutions at or above the provincial level;
(four) the enterprise has led the formulation of international standards, national standards or industry standards in the past five years.
Ninth small and medium-sized science and technology enterprises evaluation index description:
(a) enterprise scientific and technical personnel refers to the enterprise directly engaged in research and development and related technological innovation activities, and specialized in the management of the above activities and provide direct services, including on-the-job, part-time and temporary employees, part-time and temporary employees must work in the enterprise for more than 6 months throughout the year.
(two) the total number of employees in the enterprise includes on-the-job, part-time and temporary employees. On-the-job personnel are determined by whether the enterprise signs a labor contract or pays social insurance premiums. (5) classified evaluation of intellectual property rights, in which: invention patents, new plant varieties, national crop varieties, national new drugs, national first-class Chinese medicine protected varieties, and layout-design exclusive rights of integrated circuits are evaluated according to Class I; Utility model patents, design patents, and software copyrights are evaluated according to Class II.
(6) Enterprises leading the formulation of international standards, national standards or industrial standards refer to the top five drafters of enterprises in the relevant documents of the National Standardization Committee, the Ministry of Industry and Information Technology, the International Organization for Standardization and other competent departments.
(7) R&D institutions above the provincial level include national (provincial, ministerial) key laboratories, national (provincial, ministerial) engineering technology research centers, national (provincial, ministerial) engineering research centers, national (provincial, ministerial) enterprise technology centers, and national (provincial, ministerial) international joint research centers.
