If the corresponding epidemic prevention regulations are not violated, the "yellow code" is not caused by personal reasons. Whether the unit refuses to go to work or does not go to work according to the unified regulations of the government, it is for the needs of epidemic prevention. Therefore, even if employees don't go to work, the unit will pay wages normally. Employees who can't go to work on time due to the epidemic or enterprises that still don't have the conditions to return to work should negotiate to solve the problem of being unable to return to work by arranging employees to telecommute at home or giving priority to paid annual leave and welfare leave set by enterprises. If a worker violates the government's epidemic prevention and control measures, refuses treatment, medical observation, medical examination or isolation, which affects the production and operation of the employing unit or seriously violates labor discipline and the rules and regulations of the employing unit, the employing unit may terminate the labor contract in accordance with Article 25 of the Labor Law or Article 39 of the Labor Contract Law.
People's Republic of China (PRC) Law on the Prevention and Control of Infectious Diseases Article 6 The health administrative department of the State Council is in charge of the prevention and control of infectious diseases and its supervision and management throughout the country. The health administrative departments of local people's governments at or above the county level shall be responsible for the prevention and control of infectious diseases and their supervision and management within their respective administrative areas. Other departments of the people's governments at or above the county level shall be responsible for the prevention and control of infectious diseases within their respective functions and duties. The prevention and control of infectious diseases in the army shall be handled in accordance with this Law and the relevant provisions of the state, and shall be supervised and managed by the competent health department of the People's Liberation Army of China.
