According to Article 42 of the Regulations of Beijing Municipality on Wage Payment (Order of Beijing Municipal People's Government (No.142), "Wage deduction refers to the behavior that the employer deducts the wages of workers except the behavior specified in Article 11 of these regulations. Unpaid wages refer to the behavior of the employer to delay the payment of wages except for natural disasters, wars and other force majeure and the circumstances stipulated in Article 26 of these Provisions.
According to Article 9 of the Regulations on Labor Security Supervision (Order No.423 of the State Council), "Workers who think that the employing unit has violated their legitimate rights and interests of labor security have the right to complain to the administrative department of labor security."
According to Article 6 of the Notice on Printing and Distributing the Administrative Measures of Beijing Municipality on Accepting Cross-regional Complaints and Reports by Labor Security Supervision (J.R.S.J.F. [20 17] 157), "Labor security supervision institutions at all levels implement the' first inquiry responsibility system' when accepting complaints and reports, so as to ensure the accessibility of the whole city's windows, and workers can work in any labor security supervision institution in the city.
There are many channels for reporting complaints about unpaid wages in Beijing.
If the employer has unpaid wages, in accordance with the relevant provisions on the handling of labor disputes, the laborer may complain and report to the labor administrative department or apply for mediation, arbitration or litigation according to law.
Beishi Human Resources and Social Security Bureau pointed out that in daily work, workers should be aware of evidence and pay attention to keeping labor relations certificates, salary slips, overtime allowances, attendance records, etc. And require the employer to issue a written certificate when leaving the company, so as to claim their legitimate rights and interests in the future. Once you encounter unpaid wages, you can complain and report through the following four channels.
The first is policy consultation. If workers encounter wage arrears, they can first consult relevant policies and call the unified labor security policy consultation telephone number 12333.
The second is to complain and report. Workers who encounter unpaid wages can directly complain and report to the labor security supervision department where they are employed. During the construction of Daxing International Airport, employees of relevant units can directly complain and report to Beijing Labor and Social Security Supervision Corps.
The third is mediation and arbitration. If there is a dispute between the laborer and the employing unit on issues related to wage payment, they may apply to the labor and personnel dispute arbitration institution where the laborer is located for mediation and arbitration.
The fourth is complaints from different places. Eligible Beijing-Tianjin-Hebei registered workers who use the construction site in Beijing-Tianjin-Hebei region can complain in different places if they encounter wage arrears. The laborer himself holds valid identity documents and evidence that the employer has deducted or defaulted on wages, and applies to the labor security supervision institution at or above the county level where the household registration is located. At present, the labor inspection in Beijing, Tianjin and Hebei has achieved "one complaint and three joint dispositions", effectively protecting the legitimate rights and interests of workers.
