Compensation scheme for land acquisition, demolition and resettlement

In order to promote the smooth development of land acquisition and demolition along Xia Long and xiamen-shenzhen railway (Zhangzhou section) and safeguard the legitimate rights and interests of the parties involved in the demolition, according to the Land Administration Law of the People's Republic of China, the Regulations for the Implementation of the Land Administration Law of the People's Republic of China, the Measures for the Implementation of the Land Administration Law of the People's Republic of China in Fujian Province, and the Regulations on the Construction and Management of Villages and Market Towns in Fujian Province, etc.

Article 1 This scheme is applicable to the civil buildings and their appurtenances in Xia Long and xiamen-shenzhen railway (Zhangzhou Section) that need land acquisition, demolition and resettlement for construction.

Article 2 The land requisition and demolition unit in this plan is Zhangzhou Railway Construction Office, and the demolition person is the owner of the land, civil buildings and appendages along Xia Long and xiamen-shenzhen railway.

Article 3 The demolition area shall be subject to the red line of land requisition.

Article 4 The compensation fee for railway requisition and relocation of cultivated land in the whole city is 10 times of the average annual output value of local cultivated land in the first three years, and the resettlement subsidy is 15 times of the average annual output value of local cultivated land in the first three years.

Article 6 The compensation fee for young crops in the whole city for railway requisition and relocation shall be 1 times of the average annual output value of local cultivated land in the first three years.

Article 7 The average annual output value of cultivated land in relevant counties (cities, development zones) in Zhangzhou City in the first three years is 1300— 1400 yuan/mu (the average price is 1350 yuan/mu).

Article 8 The demolisher shall make compensation and resettlement for the demolished person according to law, and the demolition and resettlement shall conform to the overall planning of local land use and the planning of village and market town construction, which is conducive to the comprehensive supporting services for the production and life of the demolished person and the construction of the new district.

Ninth according to the actual demolition and resettlement methods to determine the number of resettlement sites, the use of resettlement sites must comply with the overall land use planning and rural construction planning.

Article 10 Principles and handling methods for confirming the source of rights

(1) Since the implementation of the Land Reform Law of the People's Republic of China, land users who have valid non-agricultural construction land documents approved by the competent authorities in their historical period are all legitimate rights and interests, and compensation and resettlement shall be carried out according to this plan.

(two) all kinds of buildings that have been built since the date of investigation by land acquisition administrative personnel are regarded as illegal buildings and will not be compensated and resettled.

(3) Houses with unclear property rights, unaccounted for or managed by others shall be given evidence preservation, and compensation and resettlement shall be given in accordance with the provisions of this scheme.

Eleventh resettlement housing land standard population in principle to the permanent residence confirmed by the public security department shall prevail:

(a) the deadline for population calculation is the day when the land acquisition management personnel start the investigation.

(two) sending households, hanging households or married villagers outside the village shall not be counted. (But the registered permanent residence has not moved out of the village, except that the village still enjoys the contracted land, fulfills the villagers' equal obligations and independently builds households).

(three) college students, active duty conscripts or non-commissioned officers, can be included in the calculation.

(four) have handled the "marriage certificate", did not hold a folk wedding to get married and live, but the woman's account has been changed to the village, can be included in the calculation object.

(5) Those who belong to two-woman households or single-woman households, employ men from other villages (administrative villages) and have settled in their villages can be included in the calculation.

(six) the only child who has handled the "one-child certificate" is calculated by two people.

(seven) older youth over the age of twenty-five can be calculated by two people.

(eight) widowed under the age of fifty can be calculated by two people.

Article 12 Measures for compensation of attachments on the ground

The building is compensated according to its replacement price. See attached table 1 for the replacement price standard of civil buildings, and attached table 2 for the new standard of civil buildings.

(2) Appendage compensation standard:

Drinking well 1000 yuan/mouth; 250 yuan/small water tower; Household septic tank 500 yuan/each.

Attachment: Fine decoration 120 yuan /m2, ordinary paint 100 Yuan /m2, unpainted 80 yuan /m2.

Increase: brick increases 40 yuan /m2. 45 yuan /m2 for cement works and 50 yuan /m2 for stone works.

Simple building foundation: concrete ring beam foundation 160 yuan /m2, stone foundation 90 yuan /m2.

Cowshed, pigsty, duck shed, firewood shed, toilet and other four types of accessories and simple covers: concrete (stone) slab 130 yuan/square meter; Brick (stone) wood 90 yuan/square meter; Bamboo frame linoleum 50 yuan/m2; Uncovered 25 yuan/m2.

Special land such as ancestral halls and temples shall be compensated as appropriate with reference to this plan.

(3) See Schedule 3 for the compensation standard of the ground attachments.

Thirteenth demolition resettlement land area calculation method

(1) According to Article 62 of the Land Administration Law of the People's Republic of China, rural villagers can only own one homestead. Article 41 of the Measures for the Implementation of the Land Management Law of the People's Republic of China in Fujian Province stipulates that the residential land area of each household with less than three mouths (including three) shall not exceed 80 square meters, and the residential land area of each household with more than six mouths (including six) shall not exceed 120 square meters.

(two) the demolition and resettlement shall be carried out by households, and the division of households shall be based on the household registration book of the public security department in principle. If there are no separate households in the household registration book, but in fact they have been separated, after verification, the calculation is based on the permanent population's registration in the village and the legal marriage registration certificate. Widowed elderly people have many children, and their children are married and live separately. The elderly should live together with one of them, and no longer be placed alone to build a house.

(3) Land area for demolition and resettlement:

1, the demolition and resettlement area is divided into 80 square meters, 100 square meters and 120 square meters.

2, the family population in three (including three) the following, according to 80 square meters for resettlement.

3, the family population of five (including five) the following, according to no more than the relocation area of +000 square meters for resettlement.

4, the family population of six (including six) or more, according to no more than 120 square meters for resettlement.

5, a multi-household, household placement.

6, a family of multiple plots, according to a family placement. The specific resettlement land area shall be implemented according to the provisions of points 2, 3 and 4 of this item.

Article 14 Where the demolished still owns 1 set or more houses that have not been demolished, and enjoys the resettlement land according to this scheme, the certificate of land use right of the houses that have not been demolished shall be cancelled together with the signing of the agreement on land use for demolition and resettlement, and the houses owned by them can continue to be used before obtaining the compensation for demolition, but it shall be promised in writing that the residential land used by them will be re-arranged by the village collective after the village committee or the village collective economic organization compensates for the demolition in accordance with relevant regulations.

Fifteenth demolition and resettlement land area within the statutory area in principle, the implementation of a variety of monetary forms. Resettlement land area is greater than the legitimate source of rights, the implementation of compensation. The relocated people are required to pay the land acquisition registration tax of 92 yuan/m2, and the resettlement area is smaller than the legal right source. The excess part shall be compensated by the demolished person according to 92 yuan/m2.

Sixteenth enterprise land and residential mixed, if it is the source of enterprise rights and interests, can be included in the enterprise evaluation, compensation, not resettlement, but can be submitted for approval according to law; If it is residential land, it can be included in the compensation and resettlement scope of homestead. However, the two cannot be compensated and resettled repeatedly.

Seventeenth historical housing has not obtained valid documents issued by the competent authorities of the legitimate land use rights, in principle, not demolition compensation and resettlement. If the demolished person can actively cooperate, sign an agreement on compensation and resettlement for demolition on time and implement relocation, he can make compensation and resettlement as appropriate according to historical reasons and actual specific conditions by referring to the relevant provisions of Articles 12, 13 and 14 of this plan.

(a) to the villagers' committee to pay the compensation fee for applying for building land or to the town government to pay the relevant fees for applying for building town planning, but has not been reported to the relevant competent authorities for approval, according to the 70% reference source area of the demolished house area for resettlement.

(two) where the administrative staff of land acquisition began to investigate the existing houses formed in history, they were resettled according to the reference source area of 50% of the building area.

(3) If the house to be demolished has no legal source of rights, the resettlement place shall go through the formalities of legal source of rights, and the demolished person shall pay the taxes and fees for handling the license according to the regulations.

(four) there is no legal and effective source of rights procedures and the demolition of buildings exceeding the permitted construction area, and compensation shall be made according to 85% of the standards stipulated in Article 12 of this scheme; The demolished buildings that have paid relevant fees to villages and towns shall be compensated according to 90% of the standards stipulated in Article 12 of this scheme.

Eighteenth has gone through the formalities for examination and approval of the land has not yet been completed, according to the "program" twelfth, thirteenth provisions.

Article 19 If the household registration of the relocated households is not in the village, the demolished houses shall not be resettled in principle, and the relocated households shall pay the land acquisition permit tax of 92 yuan/m2 according to the land area where the legal rights come from.

Twentieth if the demolition of voluntary monetary resettlement, demolition according to the legal source of land area to pay land acquisition permit tax 92 yuan/square meters.

Twenty-first resettlement homestead by the village committee to the local township land and resources management departments for land use procedures and collective land use permits.

Twenty-second demolition villagers' committee is responsible for providing residential resettlement land to the demolition, and the specific measures shall be implemented in accordance with the provisions of article fourteenth; Demolition is responsible for site leveling, roads, water supply, drainage, power supply, communication and other related outdoor facilities, as well as the plane planning and design of resettlement land and unit building design.

Twenty-third in principle, the operation mode of unified relocation and self-construction, first construction and then demolition is implemented. First occupy the place to build a house, then move it, and then dismantle the building and accessories; Part of the construction needs, the need for resettlement after the demolition, according to the provisions of article twenty-fourth.

(a) before the demolition of buildings, we must first sign the demolition compensation and resettlement agreement, and then receive 90% compensation according to this plan. At the same time, each household shall pay the relocation fee of 300 yuan, and then carry out site selection and construction, and the remaining 10% compensation shall be paid within three days after the building is delivered for demolition.

(two) the principle of taking priority in demolition and resettlement. According to the time sequence of signing the agreement, choose the resettlement land, sign first, then sign.

Twenty-fourth transitional resettlement measures

Transitional resettlement mode. When the demolished people move into the revolving house of their own houses, they will be given a temporary resettlement subsidy (transition fee) of RMB 100 per person per month for 8 months, and the temporary resettlement subsidy will be paid in one lump sum after the residents move. The confirmation of population shall be based on the permanent residence registered by the public security department.

If the demolished person fails to move or demolish within the time limit, the demolished person has the right to cancel the remaining 10% compensation fee and forcibly demolish it according to law.

Twenty-fifth there are two ways to demolish buildings, one is organized by the demolisher, and the other is to bear the expenses by the demolisher according to the relevant regulations. By the demolition, the demolition of materials owned by the demolition; Demolition by the demolition, demolition materials owned by the demolition.

Twenty-sixth since the date of signing the demolition agreement, each household signed the demolition compensation and resettlement agreement within 3 days, and was rewarded with 1500 yuan. If each household signed the demolition compensation and resettlement agreement within 6 days, 500 yuan was rewarded. Within the specified time, if the demolition fails to sign an agreement within the time limit, it shall be handled according to the provisions of national land laws and regulations, and the compensation and resettlement standards shall be appropriately reduced according to the length of delay.

Twenty-seventh resettlement areas adopt the architectural model of commercial and residential integration and street co-construction. The demolished people are required to build houses in strict accordance with the regulations and architectural design drawings. In the process of construction, the land and construction departments are responsible for supervising the implementation. The person to be demolished shall build a house in full by the individual in accordance with the planning of the resettlement community.

Article 28 The calculation rules of building construction area shall be implemented in accordance with the relevant provisions of the state land management department: the calculation rules of building construction area shall be implemented in accordance with the Code for Real Estate Survey (GB/T 17986.6438+0-2000) issued by the State Bureau of Quality and Technical Supervision.

Twenty-ninth this "program" needs to be reported to the Fujian Provincial Department of Land and Resources and the Fujian Provincial Construction Department for review.

Thirtieth the interpretation right of this "Program" belongs to Zhangzhou Municipal Bureau of Land and Resources.
