Measures of Jiangsu Province on Supervision and Administration of Quality Certification

Article 1 In order to maintain the order of quality certification, protect the legitimate rights and interests of quality certification enterprises, institutions and other units, and promote the healthy and orderly development of quality certification, these Measures are formulated in accordance with relevant national laws and regulations and combined with the actual situation of this province. Article 2 Certification, consulting and training institutions and employees engaged in quality certification activities within the territory of this province, as well as enterprises and institutions applying for certification and certification consulting, must abide by these measures. Article 3 The term "quality certification" as mentioned in these Measures includes product quality certification and quality system certification.

The term "certification bodies, consulting institutions and training institutions" as mentioned in these Measures refers to legal persons and other organizations engaged in quality certification, quality certification consulting and quality system internal auditor training services. Fourth encourage enterprises and institutions to actively apply for quality certification, and support institutions with corresponding qualifications to engage in quality certification, consulting and training activities in this province.

Unqualified units and employees are prohibited from engaging in quality certification, consultation and training activities. Fifth quality certification institutions, consulting institutions and training institutions and their employees shall abide by the relevant laws and regulations of the state to ensure the quality of quality certification, consulting and training. Sixth provincial quality and technical supervision administrative department is responsible for the unified supervision and management of the province's quality certification work, and its main responsibilities are:

(a) according to the relevant national laws and regulations on quality certification, combined with the actual situation of this province, formulate relevant provisions to standardize the quality certification work in this province and specific measures to promote enterprises and institutions to participate in quality certification;

(two) in accordance with the relevant provisions of the state, supervision and management of quality certification institutions, consulting institutions and training institutions;

(three) the implementation of registration management of internal auditors of the quality system;

(four) to supervise the products and quality system recognized by the province;

(five) in accordance with the provisions, responsible for the supervision and management of other related quality certification.

The municipal and county administrative departments of quality and technical supervision shall, within the scope of their duties, be responsible for the supervision and administration of quality certification within their respective administrative areas.

Where laws and administrative regulations provide otherwise for the supervision and management of quality certification, such provisions shall prevail. Seventh quality certification bodies must be nationally recognized certification bodies; Training institutions must be confirmed and approved by the national quality and technical supervision department; Advisory bodies must be filed by the provincial administrative department of quality and technical supervision.

Quality certification institutions, consulting institutions and training institutions must be registered in accordance with the law to carry out business activities, and may not have subordinate relations or other interests with administrative organs and other state organs. Eighth quality Certification staff must have the qualification of national registered intern auditor or above; The certification consultant must have the qualification of national registered intern auditor or above or the qualification of quality certification consultant registered by the provincial quality and technical supervision administrative department.

Quality Certification staff does not provide consultation to the auditee and does not participate in the audit; Certification consultants shall not participate in the audit related to their consulting projects. Article 9 An entity applying for quality certification has the right to decide independently whether it needs certification consultation, the form of applying for certification consultation, and qualified certification institutions, consulting institutions and training institutions.

Certification bodies and consulting institutions shall not restrict enterprises and institutions from applying for quality certification or consulting for any reason, and shall not take unfair competition to carry out certification or consulting activities. Article 10 No department or institution may restrict enterprises, institutions and other units from applying for certification or receiving consultation from the institutions designated by them, and may not restrict the lawful activities of other certification institutions or consulting institutions. Article 11 A certification body shall conduct certification in accordance with the certification standards and prescribed procedures, and issue certification opinions objectively and fairly in accordance with relevant standards according to law, and shall not lower the requirements for issuing certification opinions.

Certification institutions shall not engage in certification consulting activities. Article 12 A certification body shall submit the list of certified units and the catalogue of certified products to the provincial administrative department of quality and technical supervision in June and February of that year. Article 13 The products with safety certification subject to compulsory supervision and management stipulated by the state shall not be sold, imported or used without safety certification or unqualified certification.

For those who have applied to the certification body for certification but have not yet obtained the certificate, the provincial administrative department of quality and technical supervision shall issue a temporary sales certificate after passing the inspection by the statutory inspection body, allowing them to sell within six months. Fourteenth consulting institutions should aim at improving the quality management level and product quality of the consulted units, and carry out their work in accordance with the certification standards and the requirements of consulting contracts to ensure the quality of consulting. Fifteenth certification and training fees shall be implemented in accordance with the standards prescribed by the state. The consulting fee shall be reasonably determined by both parties through consultation according to the scale, workload and difficulty of the consulting unit. Sixteenth certified enterprises and institutions shall operate in strict accordance with the established quality system and organize production in accordance with the prescribed technical standards to ensure the stability of product quality. Failing to operate according to the quality system or the product quality does not meet the requirements of certification standards, measures should be taken in time to correct it. Article 17 No unit may forge, falsely use or transfer quality certification marks and certificates, use certification marks that are inconsistent with the actual situation on commodities, or make misleading false propaganda on their certification by advertising or other means.

Where the product quality does not meet the certification standards and the certification mark is used, it shall stop using the product quality certification mark on the product or its packaging.

If the certification period has not been re-evaluated, the certification marks and certificates shall not be used any more.
