Notice on Standardizing the Entrusted Sales Behavior of Newly-built Commercial Housing in this Municipality
All real estate development enterprises, real estate brokerage institutions and relevant units:
Recently, in the process of selling newly-built commercial housing on behalf of some real estate underwriting agencies, in the name of "enjoying preferential treatment", some real estate underwriting agencies charge buyers "group purchase fee, admission fee, deposit, service fee and e-commerce fee" in a mandatory or disguised form, and the fees cannot be deducted from the purchase price, and no invoices are issued, causing strong dissatisfaction and complaints from buyers. In order to regulate the underwriting behavior of newly-built commercial housing in this Municipality, protect the legitimate rights and interests of buyers, create a fair market environment, and promote the stable and healthy development of the real estate market, according to the Regulations of Shandong Province on the Sale of Commercial Housing and the Measures for the Administration of Real Estate Brokers, relevant matters are hereby notified as follows:
1. A real estate underwriting agency engaged in the sales agency business of newly-built commercial housing shall obtain the qualification of a real estate broker, and its business license shall include real estate intermediary services or commercial housing agency sales. If the registration information is not improved in the competent department of housing and urban and rural construction, it shall not engage in the sales agency business of new commercial housing.
2. When a real estate development enterprise entrusts an underwriting agency to sell new commercial housing, it must sign a written entrustment contract, clearly stipulating the amount of commission to be paid by the real estate development enterprise. If the newly-built commercial housing is sold by entrustment, the entrustment contract shall specify the entrustment authority, entrustment period, commission payment and other contents; Where new commercial housing is sold by underwriting, the underwriting contract shall specify the underwriting method, underwriting scope, underwriting base price, house payment and underwriting period. Real estate development enterprises shall not entrust underwriting institutions to sell or underwrite commercial houses that do not meet the sales conditions.
Three, real estate development enterprises in the application for pre-sale permit of commercial housing, should specify the sales method in the pre-sale plan. Commissioned sales, it should be clear in the pre-sale plan the name of the underwriting institution and the main entrusted matters. When the underwriting agency entrusted in the sales process changes, it shall timely submit the change information to the competent department of housing and urban and rural construction.
Four, when the underwriting agency sells new commercial housing, it shall express the power of attorney for the sale of commercial housing and the supporting documents for approving the sale of commercial housing at the sales site.
The underwriting institution shall not charge the buyer's commission in disguised form, or charge the buyer "group purchase fee, entrance fee, deposit, service fee, e-commerce fee" and other fees in any form other than reservation and advance payment through a third party. All fees charged by the underwriting agency are included in the total house price of the buyer, and the total house price paid by the buyer shall be consistent with the total house price agreed in the house purchase contract.
The underwriting institution shall strictly implement the regulatory policies of this Municipality and inform the buyers of relevant policies in writing. It is strictly prohibited to intentionally mislead, induce, deceive, force or assist the purchaser to provide false certification materials to defraud the purchaser or evade the purchase restriction policy.
Five, real estate development enterprises, underwriting institutions to sell commercial housing prices should be consistent with the project site publicity price, not a room with two prices, not to split the purchase price in the third form, not to use false or irregular price labels to mislead buyers, not to use false or misleading pricing methods for price fraud. There shall be no so-called commercial propaganda such as "workers go to households" and "go to offices", no false supply and demand information shall be released, no false information shall be fabricated and disseminated for malicious speculation, no housing shall be hoarded in disguise, and no market order shall be disturbed.
Six, the city and district housing and urban construction departments will further strengthen supervision, resolutely control the chaos of new commercial housing sales agents, and investigate and deal with all kinds of illegal acts according to law. All relevant real estate development enterprises and underwriting institutions should immediately organize self-inspection, and the existing problems should be rectified before 20 19 12 10. For real estate development enterprises and underwriting institutions that violate the requirements of this notice and the rectification is not in place, the online signing and sales of new commercial housing will be suspended, and bad behavior will be recorded in the enterprise credit file; If the circumstances are serious, it shall be handed over to law enforcement departments for investigation and punishment according to law, and shall be included in the enterprise credit blacklist; The transfer of suspected price fraud to the price department for investigation; Those suspected of tax evasion are handed over to the tax authorities for investigation; Anyone suspected of committing a crime shall be handed over to the public security department for investigation.
