Statistical institutions and statisticians shall independently exercise their functions and powers of statistical investigation, statistical reporting and statistical supervision in accordance with the provisions of this Law, and shall be inviolable.
The heads of local people's governments at various levels, government statistical agencies and relevant departments and units shall not modify the statistical data collected and collated by statistical agencies and statisticians according to law, nor shall they in any way require statistical agencies, statisticians and other institutions and personnel to forge or tamper with statistical data, nor shall they retaliate against statisticians who perform their duties according to law or refuse or resist statistical violations.
Article 7
State organs, enterprises, institutions and other organizations, as well as individual industrial and commercial households and individuals, must provide truthful, accurate, complete and timely information needed for statistical investigation in accordance with this Law and relevant state regulations, and must not provide untrue or incomplete statistical information, nor delay or refuse to report statistical information.
Article 8
Statistical work should be supervised by the public. Any unit or individual has the right to report statistical fraud and other illegal acts. Units and individuals who report meritorious service shall be commended and rewarded.
Article 9
Statistical institutions and statisticians shall keep confidential the state secrets, business secrets and personal information they know in their statistical work.
Article 10
No unit or individual may use false statistical data to defraud honorary titles, material interests or job promotion. first
Statistical investigation projects include national statistical investigation projects, departmental statistical investigation projects and local statistical investigation projects.
The national statistical investigation project refers to the statistical investigation project of the basic situation of the country. The departmental statistical investigation project refers to the professional statistical investigation project of relevant departments in the State Council. Local statistical investigation projects refer to local statistical investigation projects of local people's governments at or above the county level and their departments.

Article 4

The object of statistical investigation has the right to refuse to fill in the statistical investigation forms that are not marked with the signs specified in the preceding paragraph or exceed the validity period; Statistical institutions of the people's governments at or above the county level shall be ordered to stop relevant statistical investigation activities according to law.
Article 6
To collect and sort out statistical data, we should take regular census as the basis, take regular sampling surveys as the main body, comprehensively use comprehensive surveys, key surveys and other methods, and make full use of administrative records and other materials.
The general survey of major national conditions and national strength was led by the State Council, organized by the State Council and local people's governments, and implemented by relevant departments.
Article 7
The state formulates unified statistical standards to ensure the standardization of the meaning of indicators, calculation methods, classified catalogues, questionnaire forms and statistical codes used in statistical investigations.

Article 8
Statistical institutions of the people's governments at or above the county level may, according to the needs of statistical tasks, promote the use of computer networks to submit statistical data among statistical investigation objects.
Article 9
The people's governments at or above the county level shall include the funds needed for statistical work in the fiscal budget.
The funds needed for the census of major national conditions and national strength shall be jointly borne by the State Council and local people's governments, included in the corresponding annual budget, and allocated on time to ensure that they are in place. Article 1 The statistical agencies of the people's governments at or above the county level and the people's governments of relevant departments, townships and towns shall, in accordance with the relevant provisions of the state, establish a system for the preservation and management of statistical data, and establish and improve a mechanism for sharing statistical information.

Article 3 The relevant departments of the people's governments at or above the county level shall promptly provide the statistical agencies of the people's governments at the corresponding levels with administrative records and financial data, financial data and other materials needed for national economic accounting, and timely submit the relevant materials obtained by the statistical agencies of the people's governments at the corresponding levels in accordance with the provisions of the statistical investigation system.

Article 6 No unit or individual may provide or disclose information obtained in statistical investigation that can identify or infer the identity of a single statistical investigation object, and may not use it for purposes other than statistics.
Article 7 Statistical data obtained by statistical agencies and relevant departments of the people's governments at or above the county level shall be made public in a timely manner for public inquiry, except those that should be kept confidential according to law. Count to five.
Article 27 The National Bureau of Statistics shall be established in the State Council to organize, lead and coordinate the national statistical work according to law.

Article 28 The relevant departments of the people's governments at or above the county level shall, according to the needs of statistical tasks, set up statistical institutions, or set up statisticians in the relevant institutions, and designate persons in charge of statistics, organize statistical work within the scope of management responsibilities according to law, and carry out statistical investigations, and be guided by the statistical institutions of the people's governments at the corresponding levels in statistical business.
Article 29 Statistical institutions and statisticians shall perform their duties according to law, collect and submit statistical data truthfully, and shall not forge or tamper with statistical data, and shall not ask any unit or individual to provide untrue statistical data in any way, and shall not commit other acts in violation of the provisions of this Law.
Statisticians should persist in seeking truth from facts, abide by professional ethics, and be responsible for the consistency between the statistical data collected, reviewed and entered by them and the statistical data submitted by the statistical investigation objects.
Thirtieth statisticians have the right to ask statistical questions to relevant personnel when conducting statistical investigations, and ask them to truthfully provide relevant information and materials, and correct untrue and inaccurate materials.
When conducting statistical investigations, statisticians shall produce work certificates issued by statistical agencies or relevant departments of the people's governments at or above the county level; If they don't show it, the respondents have the right to refuse the investigation.
Article 31 The State implements a system of qualification examination and evaluation for statistical professional and technical posts, so as to improve the professional quality of statisticians and ensure the stability of statistical teams.
Statisticians should have professional knowledge and professional ability suitable for their statistical work.
Statistical institutions and relevant departments of the people's governments at or above the county level shall strengthen professional training and professional ethics education for statisticians. Count to five.
Article 32 The people's governments at or above the county level and their supervisory organs shall supervise the implementation of this Law by the people's governments at lower levels, statistical agencies of the people's governments at the corresponding levels and relevant departments.
Article 33 The National Bureau of Statistics shall organize and manage the supervision and inspection of national statistical work, and investigate and deal with major statistical violations.
Statistical institutions of local people's governments at or above the county level shall investigate and deal with statistical violations within their respective administrative areas according to law. However, the investigation agency sent by the National Bureau of Statistics is responsible for investigating and handling statistical violations that occur in the statistical investigation activities organized and implemented by the investigation agency.
Where laws and administrative regulations provide otherwise for the relevant departments to investigate and deal with statistical violations, such provisions shall prevail.
Thirty-fourth relevant departments of the people's governments at or above the county level shall actively assist the statistical agencies of the people's governments at the corresponding levels to investigate and deal with statistical violations, and timely transfer the relevant statistical illegal case materials to the statistical agencies of the people's governments at the corresponding levels.
Thirty-fifth statistical agencies of the people's governments at or above the county level shall have the right to take the following measures when investigating illegal acts or verifying statistical data:
(a) issued a statistical inspection inquiry, inspection of related matters;
(two) require the inspection object to provide relevant original records and vouchers, statistical ledgers, statistical questionnaires, accounting materials and other relevant certificates and materials;
(three) to ask the relevant personnel about matters related to the inspection;
(four) to enter the business premises of the inspection object and the statistical data processing information system for inspection and verification;
(five) with the approval of the person in charge of the institution, register and keep the relevant original records and vouchers, statistical ledgers, statistical questionnaires, accounting materials and other relevant certificates and materials of the inspected object;
(6) Recording, audio-recording, video-recording, photographing and copying the information and materials related to the inspection items.
When the statistical agencies of the people's governments at or above the county level conduct supervision and inspection, the number of supervision and inspection personnel shall not be less than two, and the law enforcement certificates shall be produced; If it is not produced, the relevant units and individuals have the right to refuse the inspection.
Article 36 When the statistical agencies of the people's governments at or above the county level perform their duties of supervision and inspection, the relevant units and individuals shall truthfully report the situation and provide relevant certificates and materials, and shall not refuse or hinder the inspection, and shall not transfer, conceal, alter or destroy the original records and vouchers, statistical ledgers, statistical questionnaires, accounting materials and other relevant certificates and materials. Article 37 If the person in charge of a local people's government, government statistical agency or relevant department or unit commits any of the following acts, the appointment and removal organ or the supervisory organ shall punish him according to law, and the statistical agency of the people's government at or above the county level shall notify him:

(2) Requiring statistical institutions, statisticians or other institutions and personnel to forge or tamper with statistical data;
(three) to take revenge on statisticians who perform their duties according to law or refuse or resist statistical violations;
(four) to supervise the serious statistical violations in the region, the department and the unit.
Thirty-eighth statistical agencies of the people's governments at or above the county level or the relevant departments in the organization and implementation of statistical investigation activities have one of the following acts, by the people's government at the same level, the people's government at a higher level or the statistical agencies of the people's government at the same level shall be ordered to make corrections and be informed; The directly responsible person in charge and other directly responsible personnel shall be punished by the appointment and removal organ or the supervisory organ according to law:
(a) without approval, organize the implementation of statistical investigation;
(2) Changing the contents of the statistical investigation system without approval;
(3) Forging or tampering with statistical data;
(4) Requiring statistical investigation objects or other institutions and personnel to provide untrue statistical data;
(five) failing to submit relevant information in accordance with the provisions of the statistical investigation system.
Statisticians who commit any of the acts listed in items 3 to 5 of the preceding paragraph shall be ordered to make corrections and be punished according to law.
Article 39 If the statistical agencies or relevant departments of the people's governments at or above the county level commit any of the following acts, the directly responsible personnel in charge and other directly responsible personnel shall be punished by the appointment and removal organ or the supervisory organ according to law:
(1) illegally publishing statistical data;
(2) divulging business secrets and personal information of statistical investigation objects, or providing or disclosing information obtained in statistical investigation that can identify or infer the identity of a single statistical investigation object;
(three) in violation of the relevant provisions of the state, resulting in damage or loss of statistical data.
Statisticians who commit any of the acts listed in the preceding paragraph shall be punished according to law.
Fortieth statistical agencies and statisticians who disclose state secrets shall be investigated for legal responsibility according to law.
Article 41 If a state organ, enterprise, institution or other organization that is the object of statistical investigation commits one of the following acts, the statistical agency of the people's government at or above the county level shall order it to make corrections, give it a warning, and may notify it; If the directly responsible person in charge and other directly responsible personnel belong to national staff, they shall be punished by the appointment and removal organ or the supervisory organ according to law:
(a) refusing to provide statistical data or failing to provide statistical data on time after being urged;
(2) Providing untrue and incomplete statistical data;
(3) Refusing to answer or not truthfully answering statistical inspection inquiries;
(4) Refusing or obstructing statistical investigation and inspection;
(5) Transferring, concealing, tampering with, destroying or refusing to provide original records and vouchers, statistical ledgers, statistical questionnaires and other relevant certificates and materials.
Enterprises, institutions or other organizations that commit any of the acts listed in the preceding paragraph may be fined not more than 50,000 yuan; If the circumstances are serious, a fine of not less than 50,000 yuan but not more than 200,000 yuan shall be imposed.
Individual industrial and commercial households have one of the acts listed in the first paragraph of this article, and the statistical agencies of the people's governments at or above the county level shall order them to make corrections, give them a warning and may impose a fine of not more than 10,000 yuan.
Article 42 If a state organ, enterprise, institution or other organization that is the object of statistical investigation reports statistical data late, or fails to set up original records and statistical ledgers in accordance with relevant state regulations, the statistical agency of the people's government at or above the county level shall order it to make corrections and give it a warning.
Enterprises, institutions or other organizations that commit any of the acts listed in the preceding paragraph may also be fined not more than 10,000 yuan.
If individual industrial and commercial households report statistical data late, the statistical agencies of the people's governments at or above the county level shall order them to make corrections, give them a warning and may impose a fine of less than 1,000 yuan.
Forty-third statistical agencies of the people's governments at or above the county level shall, when investigating and counting illegal acts, think that the relevant state functionaries should be punished according to law, and shall put forward suggestions on punishment; The appointment and removal organ or the supervisory organ shall make a timely decision according to law, and notify the statistical agencies of the people's governments at or above the county level of the results in writing.
Article 44 If an individual who is the object of statistical investigation refuses or hinders the statistical investigation in the census activities of major national conditions and national strength, or provides untrue and incomplete census data, the statistical agency of the people's government at or above the county level shall order him to make corrections and give him criticism and education.
Article 45 Whoever, in violation of the provisions of this Law, uses false statistical data to defraud honorary titles, material benefits or job promotion shall be investigated for legal responsibility according to law, and the unit that made the relevant decision or its superior unit or supervisory organ shall cancel his honorary title, recover the obtained material benefits and revoke his promoted post.
Article 46 If a party refuses to accept the decision on administrative punishment made by the statistical agency of the people's government at or above the county level, it may apply for administrative reconsideration or bring an administrative lawsuit according to law. Among them, if they are dissatisfied with the decision on administrative punishment made by the investigation agencies dispatched by the National Bureau of Statistics in provinces, autonomous regions and municipalities directly under the Central Government, they shall apply to the National Bureau of Statistics for administrative reconsideration; Anyone who refuses to accept the decision on administrative punishment made by other investigation agencies dispatched by the National Bureau of Statistics shall apply for administrative reconsideration to the investigation agencies dispatched by the National Bureau of Statistics of the province, autonomous region or municipality directly under the Central Government where the agency is located.
