Legal analysis: (1) Levy compensation measures.

4. The transitional resettlement rent of the expropriated household shall be subsidized to 5 yuan per square meter per month according to the main building area of the expropriated house, and the maximum monthly rent of each household shall not exceed 500 yuan, and the subsidy period shall be 12 calendar month.

(2) Compensation standard.

1. The standards for collecting collective land compensation fees, resettlement compensation fees and young crops compensation fees shall be implemented in accordance with the Notice of the People's Government of Hubei Province on Promulgating the Unified Annual Output Value Standard of Land Acquisition in Hubei Province and the Regional Comprehensive Land Price (Efazheng [20 14] 12).

2. The house and its appendages are appraised by a qualified real estate appraisal agency, and a one-time monetary compensation is given according to the appraised value.

(3) Compensation for attachments, graves and trees on the ground. It shall be implemented according to the following standards.

1. Tomb: earthen tomb 1000 yuan/coffin, monument 2000 yuan/coffin, building 3000 yuan/coffin.

2. Trees: fruit trees 150 yuan/tree (including camellia oleifera, oranges, plums, peaches, etc. ), all fruit trees without hanging are 100 yuan/plant, DBH 10cm or more, 50 yuan/plant, DBH 3- 10cm, 25 yuan/plant, and miscellaneous trees 8 yuan/square meter.

(4) Disposal of illegal buildings and temporary buildings. Illegal buildings and temporary buildings exceeding the approved period shall not be compensated in accordance with the provisions of laws and regulations. After the scope of house expropriation is determined, those who rob and rebuild will not be compensated and will be forcibly removed according to law.

(5) Subsidies and rewards.

1. The house relocation fee is 3,000 yuan per household, and the air-conditioning relocation fee is subsidized to 400 yuan; The solar relocation fee subsidizes 800 yuan for each unit.

2. If the expropriation compensation agreement is signed within the specified time, the signing reward will be given according to the main building area of the expropriated house 100 yuan /m2.

Six, other provisions

(a) power supply, water supply, gas supply, telecommunications, radio and television, mobile, China Unicom, Netcom, municipal and other public facilities need to be relocated, and their competent units will dismantle them themselves and relocate them free of charge.

(II) After the house expropriation implementation unit and the expropriated person sign the house expropriation compensation agreement according to this scheme, the property right certificate, land use right certificate, house ownership certificate and "one book and two certificates" of the expropriated house will be recovered at the same time. If it is not recovered within the time limit, the relevant departments shall announce the cancellation according to law. After the house is expropriated according to law, the land use right is recovered at the same time.

(3) The expropriated person shall move out of the expropriated house within 15 days from the date of signing the expropriation compensation agreement. After the empty acceptance of the relocation, the expropriated person will receive the housing compensation fee and reward at one time with his ID card.

(4) When the expropriated house is relocated and vacated and handed over to the house expropriation implementation unit, the expropriated person shall maintain the structural integrity of the expropriated house, and shall not dismantle the expropriated house and its decoration, accessories and ancillary facilities without authorization. The implementation unit of house expropriation shall organize professional demolition institutions to carry out unified demolition.
