Regulations of Qingyuan Municipality on the Administration of Village Planning and Construction

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Land Administration Law of the People's Republic of China and other laws and regulations in combination with the actual situation of this Municipality in order to crack the dual structure of urban and rural areas, promote the integrated development of urban and rural areas, promote rural revitalization, strengthen the management activities of village planning and construction in this Municipality, and build an ecologically livable beautiful countryside. Article 2 These Regulations shall apply to village planning, construction and management activities outside the boundaries of land and space planning and urban development within the administrative area of this Municipality.

Village planning and construction management of street (township) communities, state-owned forest farms and state-owned farms shall be implemented with reference to these regulations. Article 3 The people's governments of cities and counties (cities, districts) are responsible for coordinating and solving major problems in the management of village planning and construction within their respective administrative areas, including the funds for the preparation and management of village planning into the fiscal budget at the corresponding level, delineating the scope of village planning, and realizing the full coverage of village planning.

City, county (city, district) people's governments shall formulate village planning guidelines, village design guidelines, architectural style control and construction guidelines, establish a database of urban and rural planners, architects, engineers and rural construction craftsmen, and improve the management level of village planning and construction. Article 4 The competent department of natural resources of the people's governments of cities and counties (cities, districts) is responsible for village planning and management, the competent department of housing and urban and rural construction is responsible for village construction management, and the competent department of agriculture and rural areas is responsible for rural homestead management.

The administrative departments of development and reform, finance, transportation, water conservancy, ecological environment, forestry, culture, radio and television, tourism and sports, health, human resources and other relevant units of the people's governments of cities and counties (cities, districts), as well as radio and television, electric power, communications, postal services and other relevant units, shall, according to their respective functions and duties, do a good job in the management of village planning and construction. Article 5 The Township People's Government shall be responsible for organizing and implementing the management of village planning and construction within its jurisdiction, defining institutions and personnel, and performing the following duties:

(1) Organization, revision, implementation and management of village planning;

(two) the daily supervision and management of village construction;

(three) to manage the approval, planning and verification of rural villagers' residential land;

(four) the establishment of village planning and construction management files;

(five) other duties of village planning and construction management. Article 6 Villagers' committees shall assist township people's governments in managing village planning and construction, participate in the compilation, revision and implementation of village planning, and incorporate the requirements of village planning and construction into village rules and regulations. Chapter II Management of Village Planning Article 7 Village planning is the legal basis for developing and protecting village land space, controlling land space use, issuing planning permits for rural construction projects and carrying out various constructions.

Village planning should adhere to the principles of intensive, land-saving and multi-regulation, implement the spatial planning requirements of township land use, pay attention to protecting history and culture and improving ecological environment, and reflect local characteristics. Article 8 The people's governments of cities and counties (cities, districts) shall, according to the demand for land for village planning and construction, define the scale and control requirements of land use, and make overall arrangements for rural collective construction land and rural villagers' residential construction land indicators in the annual land supply plan.

City, county (city, district) people's government can reserve no more than 5% of the mobile index of construction land in the spatial planning of township land and village planning for the development of rural villagers' houses, public facilities, public welfare undertakings and new industries and formats in rural areas. Ninth village planning is generally based on one or several administrative villages.

Village planning should include village development goals, ecological protection and restoration, cultivated land and permanent basic farmland protection, historical and cultural inheritance and protection, industrial and construction space arrangement, village safety and disaster prevention and mitigation, and recent construction actions.

The basic achievements of village planning should include the general plan of village planning, the list of recent construction projects and the controlling rules of village planning. Tenth village planning by the Township People's government organization, after the villagers' committee convened a villagers' meeting or villagers' representative meeting in accordance with relevant laws and regulations, submitted to the county (city, district) people's government for approval. The materials submitted for examination and approval shall be accompanied by the deliberation opinions of the villagers' committee and the resolutions adopted by the villagers' meeting or the villagers' representative meeting.

In the process of village planning, we should solicit and listen to the opinions of rural villagers and experts through various forms.

The draft village plan shall be announced before being submitted for examination and approval, and the announcement time shall not be less than thirty days. Eleventh approved village planning, the Township People's Government shall publish within five working days from the date of approval.

Village planning should be published in the village public places, free of charge for rural villagers to consult. Twelfth village planning period should be consistent with the township land spatial planning period.

Without legal procedures, the approved village planning shall not be modified at will. According to the needs of economic and social development, or put forward by the villagers' meeting or the villagers' representative meeting, if it is really necessary to amend it, it shall be submitted for approval in accordance with legal procedures and re-promulgated. Thirteenth Township People's governments shall entrust planning and design units with corresponding qualification levels to prepare village planning, and do a good job in supervising the implementation of village planning.

The relevant competent departments of the people's governments of cities and counties (cities, districts) shall provide relevant basic data such as geological survey and natural resources status free of charge, and do a good job in the preparation and implementation of village planning.
