Regulations of Tianjin Municipality on Rewarding and Protecting Courageous Persons (20 18)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the provisions of relevant laws and administrative regulations and in the light of the actual situation of this Municipality in order to carry forward the spirit of being courageous, promote social integrity and cultivate and practice socialist core values. Article 2 The "courageous act" as mentioned in these Regulations refers to the act of a person who, without legal duties, legal obligations or agreed obligations, stands forward to fight against the illegal and criminal acts being carried out, or has outstanding deeds in emergency rescue and disaster relief, in order to protect national interests, social interests or the personal and property safety of others. Article 3 These Regulations shall apply to the reward and protection of courageous people and related work in this Municipality. Article 4 The principles of openness, fairness, impartiality and timeliness shall be adhered to in rewarding and protecting courageous people, and the combination of government leading and social participation, moral encouragement and material rewards, and pension and preferential treatment and social security shall be adhered to. Article 5 The municipal and district people's governments shall be responsible for the reward and protection of courageous people within their respective administrative areas, and the required funds shall be included in the fiscal budget at the same level.

The public security organs are responsible for rewarding and protecting the daily work of courageous people.

Civil affairs, finance, human resources and social security, health and family planning, land and housing management, judicial administration, education and other departments shall, according to their respective functions and duties, do a good job in rewarding and protecting the courageous people.

Trade unions, youth leagues, women's federations and disabled persons' federations assist the government in rewarding and protecting courageous people. Article 6 Under the guidance of the public security organs at the same level, the municipal and district associations established according to law shall assist the people's governments at the same level in rewarding and protecting the courageous people. Article 7 The media such as radio, television, newspapers and the Internet shall report the advanced deeds of doing good deeds in a timely and objective manner, publish and broadcast public service advertisements for doing good deeds, and actively publicize and carry forward the spirit of doing good deeds. Article 8 Units and individuals are encouraged to donate property and provide voluntary services to courageous people and their families, so as to create a good atmosphere for the whole society to respect and support courageous people. Chapter II Confirmation of Courageous Acts Article 9 In any of the following circumstances and with outstanding deeds, it shall be recognized as a courageous act:

(a) to stop illegal and criminal acts that endanger national security, public safety or disrupt social management order;

(two) to stop the illegal and criminal acts that infringe upon the state or collective property or the personal and property rights and interests of others;

(3) voluntarily assisting public security and judicial organs in detecting major criminal cases or assisting in the pursuit of criminal suspects and fugitives;

(four) outstanding performance in emergency rescue, disaster relief and rescue;

(5) Other courageous situations. Article 10 The public security organ shall take the initiative to confirm if it finds that it is courageous.

Any unit or individual (including the perpetrator and his/her family) may recommend himself/herself to the district public security organ where the courageous act occurred, and provide relevant certification materials.

Self-recommendation or self-recommendation for courageous acts shall be made within one year from the date of courageous acts. Article 11 The district public security organ that accepts the recommendation or self-recommendation shall investigate and collect evidence in time, confirm those that meet the requirements of Article 9 of these regulations, and notify the recommender, the recommended person or the self-recommendation person of the confirmation result.

If a person is recognized as a courageous person, the public security organ shall issue a courageous confirmation certificate after consulting the opinions of the courageous person. Chapter III Rewards for Courageous Persons Article 12 If a person is recognized as a courageous person by a public security organ, the municipal or district people's government shall give him a notice of commendation, award a bonus or other awards. Article 13 The Municipal People's Government shall award honorary titles to courageous people or groups whose deeds are particularly outstanding, such as being a model and an advanced individual, or being a model collective and an advanced collective. Article 14 Rewards and commendations for courageous people shall be made in public, except those involving state secrets and protecting the personal safety of courageous people and their families. Fifteenth won the honorary title of Tianjin, and was awarded the honorary title of national courageous by the relevant state ministries and commissions, enjoy the treatment of municipal model workers. Article 16 bonuses or prizes won by courageous people shall be exempted from personal income tax in accordance with state regulations.

When families of courageous people apply for the minimum living allowance, bonuses, pensions and subsidies obtained for courageous people are not included in family income.

Encourage enterprises, institutions, social organizations and other organizations to reward, sympathize with and help courageous people. Chapter IV Protection of Courageous Persons Article 17 Any unit or individual shall give timely help and protection to courageous persons; Those who are injured due to courageous acts shall be escorted to medical institutions in time. Eighteenth of the wounded, medical institutions should be treated first, and then go through the formalities of charging; Where follow-up treatment is needed, medical institutions shall provide convenience. Article 19. Those who are injured, disabled or sacrificed because of being courageous and meet the social insurance conditions such as work-related injuries shall enjoy social insurance benefits such as work-related injuries according to law. The shortage of medical expenses shall be solved by the district people's government where the courageous act occurred.

If the work unit of the courageous staff listed in the preceding paragraph should participate in social insurance according to law and fails to participate, the relevant treatment shall be borne by the work unit; If there is no work unit, it shall be solved by the district people's government where the courageous act takes place. Among them, the disabled, in accordance with the provisions of the state on the management of pensions for the disabled, are assessed by the civil affairs department and enjoy relevant treatment.
