Article 1 In order to ensure the smooth progress and safe operation of urban rail transit construction, standardize the management of urban rail transit and safeguard the legitimate rights and interests of passengers, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to the planning, construction, operation, facilities protection and management of urban rail transit within the administrative area of this Municipality.

Article 3 The term "urban rail transit" as mentioned in these Regulations refers to the public * * * passenger transport system of urban rapid rail such as subway and light rail.

Article 4 Urban rail transit shall follow the principles of unified planning, priority development, standardized service and safe operation.

Article 5 The Municipal People's Government shall establish a comprehensive coordination mechanism for urban rail transit to coordinate and solve major problems in the construction and operation of urban rail transit.

City rail transit management agencies are responsible for organizing the implementation of these regulations.

The relevant administrative departments of development and reform, finance, planning, construction, land, transportation, municipal administration, public security, safety supervision, cultural relics, city landscaping, urban management and law enforcement, etc. shall do a good job in the management of urban rail transit according to their respective functions and duties.

The district and county people's governments and development zone administrative committees along the urban rail transit shall cooperate with the planning, construction, operation and facilities protection of urban rail transit.

Article 6 Urban rail transit belongs to public utilities and is franchised. The business unit shall be determined by the Municipal People's Government according to law.

Urban rail transit business units shall fulfill the legal obligations and social responsibilities of social public utilities, be responsible for the daily management within the business scope, and impose administrative penalties in accordance with the provisions of these regulations.

When implementing administrative punishment, law enforcement officers shall hold valid law enforcement certificates.

Article 7 Citizens, legal persons and other social organizations shall support the development of urban rail transit, protect urban rail transit facilities and maintain the safe operation order of urban rail transit.

Power supply, water supply, drainage, heating, gas supply, communication and other related units should give priority to ensuring the demand of urban rail transit for electricity, water, heat, gas and communication, and ensure the normal construction and operation of urban rail transit.

Eighth urban rail transit construction funds to implement the combination of government investment and multi-channel financing.

Enterprises and other economic organizations are encouraged to invest in the construction and operation of urban rail transit, and the legitimate rights and interests of investors and operators are protected by law. Ninth urban rail transit planning should be incorporated into the overall urban planning.

Urban rail transit planning includes urban rail transit network planning and urban rail transit construction planning.

Urban rail transit network planning shall be organized by the municipal planning administrative department in conjunction with the urban rail transit management institution.

Urban rail transit construction planning shall be organized by the urban rail transit management institution in accordance with the requirements of urban rail transit network planning.

The urban rail transit plan approved according to law shall not be changed at will, and if it is really necessary to change it, it shall be carried out in accordance with legal procedures.

Tenth city planning administrative departments shall, according to the urban rail transit planning, organize the preparation of urban rail transit land planning, urban rail transit construction land planning management and control.

The preparation of urban rail transit land planning should economize and intensively use land resources, comprehensively develop and make overall arrangements for the construction of related supporting facilities.

Without legal procedures, the land for urban rail transit shall not be changed.

Eleventh urban rail transit planning should reasonably arrange the transfer and connection between different lines of urban rail transit and between urban rail transit and urban public transportation such as railways, aviation and highways.

When planning the land around the urban rail transit station, the municipal planning administrative department shall reserve public facilities such as transfer hubs, motor vehicle and non-motor vehicle parking lots and emergency evacuation land according to the passenger flow and passenger transfer demand.

Twelfth urban rail transit construction must adhere to the principle of first survey, then design and then construction, and strictly implement the national capital construction procedures.

The survey, design, construction, supervision and monitoring units of urban rail transit construction projects shall have corresponding qualifications and shall be determined by bidding according to law.

Thirteenth urban rail transit project construction to implement the responsibility system of safety and quality management. The construction unit must establish a safety and quality management system and set up a special safety and quality management organization to implement safety and quality performance management for the survey, design, construction, supervision and monitoring units.

Fourteenth urban rail transit construction units shall, in accordance with the relevant provisions, prepare special construction plans for sub-projects with greater risks. For dangerous sub-projects exceeding a certain scale, experts shall be organized to demonstrate the special construction scheme.

Fifteenth urban rail transit project construction should be carried out in advance for archaeological exploration of cultural relics. When cultural relics are found during construction, corresponding protection measures should be taken and reported to the competent department of cultural relics in time.

Sixteenth urban rail transit construction needs to use power supply, water supply, drainage, heating, gas supply, communication pipelines and civil air defense projects and other buildings, structures and other engineering files, the relevant administrative departments and property rights units should provide.

Seventeenth urban rail transit construction needs to requisition land, houses and other buildings and structures, in accordance with the provisions of relevant laws and regulations, and compensation according to law.

Eighteenth urban rail transit underground construction is not restricted by the ownership and use right of the land above it, but it shall not damage the use right of the land above it.

If the construction of urban rail transit needs to temporarily occupy underground, surface and aboveground space, the relevant units and individuals shall provide necessary convenience.

Urban rail transit entrances, ventilation pavilions and cooling towers and other facilities need to be combined with existing buildings and structures around or occupy land, and their owners and users should cooperate. If damage is caused, the urban rail transit construction unit shall compensate according to law.

Nineteenth urban rail transit construction units should take protective measures to prevent damage to existing buildings, structures and power supply, water supply, drainage, heating, gas supply, communication pipelines and other facilities above and around urban rail transit projects. If damage is caused, compensation shall be made according to law.

Twentieth urban rail transit construction needs to carry out pipeline relocation, pipeline property units should cooperate and negotiate to determine the pipeline relocation plan. According to the original standard, the cost of pipeline relocation shall be borne by the urban rail transit construction unit; If the standard is raised or the capacity and quantity of pipelines are increased, the cost of raising or increasing part shall be borne by the pipeline property right unit.

Article 21 During the construction of urban rail transit, the urban rail transit management institution shall, jointly with the administrative departments of public security, municipal administration, transportation, urban management and law enforcement, city appearance and gardens, formulate traffic relief plans to avoid or mitigate the impact of urban rail transit construction on urban traffic.

Twenty-second after the completion of the urban rail transit project, the construction unit shall organize the completion acceptance according to the following steps:

(1) Preliminary acceptance of the construction project;

(two) the preliminary inspection is qualified, and the trial operation can be carried out;

(three) the trial operation is qualified and has the basic operating conditions, and the trial operation can be carried out after the approval of the Municipal People's government;

(four) after the acceptance of the trial operation, it shall be delivered to the official operation and reported to the relevant departments for the record.

Twenty-third urban rail transit construction units shall collect and sort out the urban rail transit construction project files in a timely manner, and hand over the urban rail transit construction project files to the urban and rural construction file management institutions in a timely manner after the project is completed and accepted.

Twenty-fourth approved by the Municipal People's government, urban rail transit construction and business units can engage in comprehensive development activities by using the underground and aboveground space attached to the construction land of urban rail transit facilities.

The income from comprehensive development shall be subject to municipal financial supervision and earmarked for the construction and operation of urban rail transit.

Article 25 The comprehensive development plan shall conform to the urban rail transit plan, give priority to urban rail transit supporting facilities according to the needs of construction and operation, report to the municipal planning administrative department for approval, and implement it after the land use right transfer formalities are handled by the land and resources management department. Article 26 The protected areas mentioned in these Regulations refer to the control and protection scope of urban rail transit lines, which are divided into key protected areas and control protected areas, with the following scope:

(a) the outer edge of the underground station and tunnel structure within10m is the key protected area, and10m to 50m is the control protected area;

(two) the ground station and the ground line, the elevated station and the elevated line are the key protected areas within five meters of the outer edge of the building structure, and the controlled protected areas within five to thirty meters;

(3) The key protected areas are the outer lines of buildings and structures such as entrances and exits, wind pavilions, cooling towers, centralized cooling stations, main substations, control centers, ground stations, etc., and the land for the vehicle depot (parking lot) is three meters outside, and the controlled protected areas are within three to ten meters;

(four) urban rail transit across the river tunnel, bridge structure on both sides of the outer edge within 20 meters as a key protected area, 20 meters to 100 meters as a control protected area.

Twenty-seventh in the key protected areas in addition to the necessary municipal, garden, sanitation and civil air defense projects, no other construction activities.

Twenty-eighth in the controlled protected areas to carry out the following construction activities, the need to apply for administrative license, the relevant administrative departments shall solicit the opinions of the urban rail transit management agencies in writing before making an administrative license; Without obtaining the administrative license, the construction unit and individual shall inform the urban rail transit management institution in writing before the construction operation:

(a) new construction, expansion, renovation or demolition of buildings and structures;

(two) engaged in excavation, excavation, pile foundation construction, jacking, blasting, foundation reinforcement, grouting, anchoring and drilling operations;

(3) building fish ponds, digging canals, quarrying and dredging, drilling wells for water and exploiting groundwater;

(4) Overhead operations such as laying pipelines or erecting crossing lines;

(5) Dredging rivers and channels in the cross-river tunnel section;

(six) other operations that may endanger urban rail transit facilities.

The urban rail transit management institution shall make a written reply within five working days after receiving the written comments.

Twenty-ninth urban rail transit planning line within fifty meters on both sides of the building control area. The planning administrative department shall solicit the opinions of the urban rail transit management institution in writing when implementing the planning permission of the construction project in the construction control area.

Thirtieth construction in the protected area may affect the safety of urban rail transit facilities, the construction unit shall, in conjunction with the urban rail transit management agencies, make a special evaluation of the design and construction plan, and formulate the corresponding safety protection plan. The urban rail transit management institution shall conduct safety supervision on the construction situation in the protected areas, and shall promptly stop and report to the relevant administrative departments for handling the situation that endangers the safety of urban rail transit.

Article 31 Where an underground pipeline is laid in a protected area, the owner or user of the underground pipeline shall strengthen the inspection, maintenance and management of the pipeline to ensure the safety of the pipeline and avoid affecting the operation safety of urban rail transit.

If the inspection and maintenance of pipelines need the cooperation of urban rail transit business units, urban rail transit business units shall provide convenience.

Article 32 If the construction unit needs to cross or cross the urban rail transit facilities in the survey, drilling, new construction, reconstruction and expansion of buildings, structures and pipeline laying of non-urban rail transit construction, it shall solicit the opinions of the urban rail transit management institution in writing.

Thirty-third in the urban rail transit ground lines or elevated lines on both sides of the new construction, renovation of buildings, structures or planting trees, shall not hinder the traffic lookout, affecting traffic safety.

Article 34 The following acts endangering the safety of urban rail transit facilities are prohibited:

(a) Using emergency devices or safety devices in non-emergency situations;

(two) damage to vehicles, tunnels, tracks and their equipment, roadbed, bridges, track closed network, crossings, stations and other facilities and equipment;

(three) damage and interference with mechanical and electrical equipment, communication signal system, power supply system, protection monitoring system;

(four) damage, cover or move the safety and fire warning signs, evacuation signs, stop signs and other signs;

(five) digging holes in elevated roads (including bridges) and taking wires and other load-bearing ropes without permission;

(six) other acts endangering the safety of urban rail transit facilities. Thirty-fifth city urban rail transit management institutions shall formulate urban rail transit operation service standards, and conduct supervision and inspection of urban rail transit operation activities.

Thirty-sixth urban rail transit business units shall establish and improve the operation service and safety management system to provide safe and convenient passenger service for passengers. Perform the following duties:

(a) to conduct regular safety operation, standardized service education and business skills training for employees;

(two) in accordance with the relevant national standards and unified norms set up urban rail transit guidance and safety warning signs;

(three) to keep the operating facilities in good condition and normal operation;

(4) Keep the entrances and exits of urban rail transit unblocked;

(five) keep the business environment clean and tidy;

(6) Formulating passenger codes according to law;

(seven) other duties as prescribed by laws and regulations.

Thirty-seventh train drivers, dispatchers and conductors of urban rail transit business units shall be trained and qualified before they can take up their posts.

Thirty-eighth urban rail transit business units shall publish the travel time of the first and last buses, train operation status tips and transfer instructions in a prominent position at the station, and provide relevant ground traffic information. If the travel time of the first and last bus is adjusted, the stop is temporarily adjusted or the train is delayed for some reason, the passengers shall be informed in time.

Thirty-ninth urban rail transit business units should ensure that barrier-free facilities are in good condition and smooth, and provide convenience and services for passengers with special needs.

Fortieth urban rail transit business units shall, in accordance with the relevant provisions of the state, implement pollution prevention measures to reduce noise pollution during the operation of trains on ground lines.

Forty-first urban rail transit fares shall be subject to government pricing according to law. Urban rail transit business units shall implement the fares determined by the Municipal People's Government and shall not adjust them without authorization.

If the urban rail transit cannot operate normally for some reason, the fare shall be refunded according to the original fare.

The municipal price administrative department shall supervise and inspect the implementation of urban rail transit fares.

Forty-second passengers should consciously abide by public order and social morality, and ride in a civilized manner in accordance with the passenger code.

Passengers should wait in a safe area with valid tickets and get on and off in the order of getting off first and getting on. Do not interfere with the opening and closing of screen doors (safety doors) and doors during the operation of amusement equipment.

Forty-third urban rail transit business units should strengthen public security and fire safety inspection, timely discover and eliminate potential safety hazards.

It is forbidden to bring inflammable, explosive, toxic, radioactive and corrosive dangerous goods and other contraband into the station. Urban rail transit business units can conduct safety inspections, and passengers should cooperate.

Forty-fourth prohibit the following acts that affect the operation order and safety of urban rail transit:

(1) illegally intercepting a train;

(2) getting on or off the bus by force;

(three) unauthorized access to the track, tunnel and other prohibited areas;

(four) distributing goods, advertising or engaging in sales activities in urban rail transit facilities without authorization;

(five) shooting movies, TV dramas and other non-operating activities within the scope of urban rail transit facilities without authorization;

(six) the use of roller skates, skateboards, etc. ;

(seven) carrying bicycles and other means of transportation into the station;

(eight) carrying inflatable balloons, sharp objects, easy to stain, have a serious odor, unopened fragile items into the station, ride;

(nine) carrying animals into the station;

(ten) playing in the station or car, making a loud noise;

(eleven) stranded in the station or other urban rail transit facilities, begging, performing arts, picking up garbage;

(twelve) other acts that affect the operation order of urban rail transit.

Forty-fifth it is forbidden to engage in the following acts that affect the city appearance, environmental sanitation and hinder others from riding in public places of urban rail transit:

(1) Depicting, scribbling, posting or hanging articles on urban rail transit facilities without authorization;

(two) lying in the station and car, stepping on the seat;

(three) smoking, spitting, urinating, chewing gum, littering and other wastes in urban rail transit facilities such as stations and carriages;

(4) Eating and drinking in the carriage;

(five) other acts that affect the appearance and environmental sanitation of urban rail transit public facilities.

Article 46 It is forbidden to pile up articles, set up stalls, park vehicles and other acts that hinder the passage, rescue and evacuation of passengers or affect the normal operation of ventilation facilities in urban rail transit stations, passages, entrances and exits, squares in front of stations and around wind pavilions and cooling towers.

Forty-seventh urban rail transit management institutions and urban rail transit business units shall establish a complaint acceptance system to accept complaints from passengers.

The urban rail transit business unit shall make a reply within five working days from the date of accepting the complaint. If there is no reply or objection to the reply, you can complain to the urban rail transit management institution, which shall make a reply within seven working days from the date of acceptance. Forty-eighth urban rail transit construction and operation units shall bear the responsibility for the safety of urban rail transit construction and operation according to law, and set up special safety production management institutions to ensure safe production and operation.

Urban rail transit management institutions, public security organs, production safety supervision and other departments shall supervise and inspect the operation safety of urban rail transit, and shall order the operating units to take measures to eliminate the safety hazards if potential safety hazards are found.

Article 49 The construction and business units of urban rail transit shall, in accordance with the relevant provisions on fire control management and accident rescue, allocate fire fighting, explosion-proof, anti-virus, alarm, rescue, evacuation lighting, escape, protective monitoring and other equipment and equipment, and regularly check, maintain and update them to ensure their normal use.

Fiftieth urban rail transit business units are responsible for the management and maintenance of urban rail transit facilities, regular maintenance and inspection of civil works, vehicles and operating equipment, timely maintenance and update, to ensure that they are in a safe state. Inspection and maintenance records shall be kept until the service life of civil works, vehicles and operating equipment expires.

Fifty-first urban rail transit business units should organize professional institutions to conduct long-term monitoring of key parts and key equipment of urban rail transit facilities, regularly assess the safety of urban rail transit, and formulate safe operation countermeasures for weak links.

After the occurrence of geological disasters such as earthquakes and major disasters such as fires, urban rail transit business units shall cooperate with relevant departments to inspect and evaluate the safety of urban rail transit.

Fifty-second urban rail transit management institutions shall, jointly with relevant departments and units, formulate emergency plans for the construction and operation of urban rail transit, and implement them after being approved by the Municipal People's Government.

Urban rail transit construction and business units shall formulate emergency plans for urban rail transit construction and operation, and organize regular drills.

Article 53 When a safety accident occurs in the construction and operation of urban rail transit, the construction and operation unit of urban rail transit shall, according to the emergency plan for urban rail transit emergencies, take effective measures quickly to prevent the accident from expanding, avoid and reduce casualties, and report to the Municipal People's Government and relevant administrative departments in a timely manner.

When a safety accident occurs in the operation of urban rail transit, the staff of the urban rail transit business unit shall organize the evacuation of passengers, and the passengers shall obey the on-site command.

Article 54 When an emergency occurs in the construction and operation of urban rail transit, the relevant departments of the Municipal People's Government, the district and county people's governments where the emergency occurs, and the power supply, water supply, gas supply, heat supply, communication and other units shall provide emergency support and rescue in accordance with the provisions of the emergency plan for urban rail transit, and resume the construction and operation of urban rail transit as soon as possible.

Fifty-fifth due to holidays, large-scale mass activities and other reasons caused by the increase in passenger traffic, urban rail transit business units should reasonably increase the capacity.

Due to the surge in passenger flow, which may endanger the operation safety, the urban rail transit business unit may temporarily take emergency measures such as limiting the number of passengers entering the station and report to the urban rail transit management agency in time.

Article 56 If the operation safety of urban rail transit is seriously affected due to natural disasters, bad meteorological conditions and other reasons, the urban rail transit business unit shall stop the line operation or part of the road section operation, evacuate passengers in time, report to the urban rail transit management institution and make an announcement to the public.

Fifty-seventh urban rail transit construction and operation in the event of casualties, urban rail transit construction and operation units shall organize the rescue of the wounded, timely troubleshooting, as soon as possible to resume operation, and timely report to the relevant departments; After receiving the report, the relevant departments shall arrive at the scene in time and deal with it according to law. Fifty-eighth in violation of the provisions of article twenty-seventh, article twenty-eighth, engaged in illegal construction activities in key protected areas and controlled protected areas, the urban rail transit management agencies shall be ordered to stop operation and restore to the original state; If losses are caused, it shall be liable for compensation according to law.

Article 59 If, in violation of the provisions of Article 28 and Article 29 of these regulations, the relevant administrative department fails to seek the opinions of the urban rail transit management institution in writing before making the administrative license of the protected area and the construction control area, the Municipal People's Government shall order it to make corrections; If damage is caused, the administrative responsibility of the relevant personnel shall be investigated according to law.

Article 60 If a construction unit fails to formulate a safety protection plan for its operation in the protected area in violation of the provisions of Article 30 of these regulations, the urban rail transit management institution shall give it a warning, order it to make corrections within a time limit, and may impose a fine of not less than 10,000 yuan but not more than 30,000 yuan; If losses are caused, it shall be liable for compensation according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 61 If a construction unit, in violation of the provisions of Article 32 of these regulations, crosses or crosses urban rail transit facilities in its operation activities without consulting the urban rail transit management institution in writing, the urban rail transit management institution shall order it to stop its operation and restore to its original state; If losses are caused, it shall be liable for compensation according to law.

Article 62 In violation of the provisions of Articles 34, 42, 43, 44 and 46 of these Regulations, urban rail transit business units have the right to dissuade and stop acts that endanger the safety of urban rail transit facilities and affect the operation order of urban rail transit, and may order the actors to leave urban rail transit facilities or refuse to provide passenger services for them; If losses are caused, it shall be liable for compensation according to law; Violation of the "People's Republic of China (PRC) Public Security Administration Punishment Law" shall be punished by the public security organs; If a crime is constituted, criminal responsibility shall be investigated according to law.

Sixty-third in violation of the provisions of Article 36, Article 43, Article 49, Article 52, Article 54, Article 55 and Article 56 of these regulations, urban rail transit construction and operation units have one of the following acts, and if there are provisions in laws and regulations, they shall be dealt with according to law; If there are no provisions, the urban rail transit management institution shall order it to make corrections, give a warning and impose a fine of 5000 yuan to 50 thousand yuan; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Failing to train and assess employees regularly;

(2) Failing to set up urban rail transit guidance and safety warning signs in accordance with relevant national standards and unified norms;

(3) Failing to keep the operating facilities in good condition and normal operation;

(four) to stop the operation of the line or part of the road, and not to report to the urban rail transit management institution in time;

(five) did not strengthen public security and fire safety inspection, timely discover and eliminate potential safety hazards;

(six) not equipped with fire, explosion, gas, alarm, rescue, evacuation lighting, escape, protective monitoring and other equipment, and keep it in good condition and effective;

(seven) the emergency plan for the construction and operation of urban rail transit has not been formulated;

(8) Failing to take emergency measures when the passenger flow surges or unexpected events occur.

Article 64 In violation of the provisions of Article 42 of these regulations, the urban rail transit business unit may pay the fare according to the full fare, and may also impose a fine of less than five times the full fare.

Article 65 If anyone violates the provisions of Article 45 of these regulations, affecting the environmental sanitation of public places of urban rail transit and obstructing others' riding behavior, the urban rail transit business unit shall order him to make corrections, give him a warning or impose a fine of more than 20 yuan 100 yuan.

Article 66 Whoever, in violation of the provisions of these Regulations, refuses or hinders the staff of urban rail transit management institutions and business units from performing their duties according to law shall be punished by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 67 If a unit is fined more than 30,000 yuan, the party concerned shall be informed of the right to request a hearing.

Article 68 If the staff of the relevant administrative departments, urban rail transit management institutions, urban rail transit construction and business units fail to perform their duties as stipulated in these Regulations, or commit other acts of dereliction of duty, abuse of power or corruption, their units shall order them to make corrections; If the circumstances are serious and cause an accident, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 69 If a party refuses to accept a specific administrative act, it may apply for administrative reconsideration or bring an administrative lawsuit according to law.

Seventieth acts in violation of the provisions of this Ordinance, other laws and regulations provide for administrative punishment, in accordance with its provisions; Causing property losses or other damage, it shall bear civil liability according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 71 The urban rail transit facilities mentioned in these Regulations refer to the tracks, roadbed, tunnels, viaducts, stations, control centers, rolling stock depots, parking lots, vehicles, electromechanical equipment, communication signal systems and other ancillary facilities of urban rail transit, as well as related facilities set up to ensure the operation of rail transit.

Article 72 These Regulations shall come into force on September 20 1 year 1 day.
