There are four ways to deal with disputes over housing in renovation contract: mediation, negotiation, arbitration and litigation. The incomplete performance of the contract is mainly manifested in the following aspects: the decoration unit failed to carry out the decoration according to the practices agreed in the contract, used non-contractual decoration materials, stopped work for no reason during the construction, and failed to complete the project within the agreed time limit. 2. The decoration is shoddy and the construction quality is inferior. Some decoration companies' construction workers are not careful in their work and their technology is not standardized. It seems reasonable on the surface, but it can't stand the test of acceptance or time. If something goes wrong, you will argue irrationally. Especially the "street guerrillas", the quality is not guaranteed. 3. After the renovation, the maintenance service is not perfect or the quality commitment is not fulfilled. After renovation, it should be repaired in time according to the contract, but some companies shirk it. There is no warranty during the warranty period. The noise during the construction is annoying. Noise is inevitable during construction, but the owner mainly makes an appointment with the decoration company in advance for the start and completion time. Don't violate the relevant regulations of environmental protection, otherwise it will easily lead to disputes. 5. Decorative materials or wastes are piled up in a pile. 6. Decoration damaged the neighboring houses. 7. Decoration destroyed the main structure and load-bearing structure of the house. In view of decoration disputes, the relevant departments have formulated some regulations. For example, the Law of People's Republic of China (PRC) on the Protection of Consumers' Rights and Interests, the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution, the Ministry of Construction [1997] No.60, the Interim Provisions on Handling Quality Complaints of Construction Projects, and the Ministry of Construction [1997] No.92, the Trial Measures for the Management of Family Room Decoration, etc. "Regulations on the Management of Building Decoration" points out that if a house owner or user damages an adjacent house due to decoration, he shall be responsible for repair or compensation. Article 15 of the "Trial Measures for the Management of Family Room Decoration" stipulates that in the event of a family room decoration dispute, you can complain to the local construction administrative department or its designated institution, or you can bring a civil lawsuit to the local people's court; Article 19 stipulates that if the decoration of a family room causes pipeline blockage, water leakage, power failure or damage to adjacent residents' houses, the residents who decorate the family room shall be responsible for maintenance and compensation. If it is the responsibility of the decoration construction unit, the owner should find the decoration unit to be responsible for maintenance and compensation. At the same time, relevant regulations have also been formulated within the industry. According to Article 43 of the Law on the Protection of Consumers' Rights and Interests in People's Republic of China (PRC), disputes between consumers and operators can be resolved through the following channels: 1, through consultation with operators; 2. Consumers request mediation from consumer associations; 3. Complain to the relevant administrative department; 4. According to the arbitration agreement reached with the operator, submit it to an arbitration institution for arbitration; 5. Bring a lawsuit to the people's court. However, it must be noted that under normal circumstances, if it is submitted to arbitration, it is impossible to bring a lawsuit to the court. According to the general principles of civil law, economic contract law and other laws involved, there are only the following items to solve decoration disputes: 1, and the parties negotiate by themselves; 2. Administrative mediation by the competent department; 3. Arbitration settlement; 4. Litigation settlement. In addition, industry regulations also provide many ways to resolve disputes. For example, in some home improvement markets, disputes are resolved according to the following procedures: complaint-accepted by the mediation department-on-site inspection by the quality inspection department according to the contract and drawings-mediation by the mediation department and the quality inspection department according to the inspection results-maintenance or rework when both parties reach an agreement; If no agreement is reached or the agreement is not fulfilled, apply for arbitration or bring a lawsuit to the court. For consumers, it is advisable to inform neighbors and say hello before renovation, so that everyone can be psychologically prepared and reduce the probability of disputes. In the event of a dispute, as long as the two sides negotiate calmly and shoulder their respective responsibilities, the dispute can be resolved. If you can't negotiate by yourself, you can solve it smoothly as long as the administrative department comes forward. However, if the subject matter involved is large or other disputes that have a great impact on life cannot be resolved through consultation, then the most formal, authoritative and effective way can only be to go to court. Of course, disputes between other residents due to the work of decorating their families and decorating their families can also be solved accordingly.
