According to the new regulations on online lending: "When all parties participate in the business activities of information intermediaries in peer-to-peer lending and need to use electronic signatures and electronic authentication for the basic information and transaction information of lenders and borrowers, they should abide by the provisions of laws and regulations to ensure the authenticity and integrity of the data and the legal effect of electronic signatures and electronic authentication." To conclude a contract by electronic contract, a reliable electronic signature is needed to ensure that it has the same legal effect as a handwritten signature.
The Electronic Signature Law stipulates that an electronic signature is considered reliable if it meets the following conditions:
(1) When the electronic signature production data is used for electronic signature, it belongs to the exclusive right of the electronic signer.
(two) the electronic signature data is only controlled by the electronic signer at the time of signature.
(3) Any changes to the electronic signature after signing can be found.
(4) Any changes to the content and form of the data message after signature can be found. The parties can also choose to use electronic signatures that meet their agreed reliable conditions.
Article 13 of the Electronic Signature Law of People's Republic of China (PRC) shall be regarded as a reliable electronic signature if it meets the following conditions:
(1) When the electronic signature production data is used for electronic signature, it belongs to the exclusive right of the electronic signer.
(two) the electronic signature data is only controlled by the electronic signer at the time of signature.
(3) Any changes to the electronic signature after signing can be found.
