Measures of Shenzhen Municipality on the Administration of Personal Credit Information and Credit Rating

Article 1 In order to establish the personal credit system of Shenzhen (hereinafter referred to as "the city"), standardize personal credit investigation and rating activities, prevent credit risks and protect the legitimate rights and interests of the parties, these Measures are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation. Article 2 These Measures shall apply to the collection and utilization of personal credit information within this Municipality.

The term "individual" as mentioned in these Measures refers to a natural person with full capacity for civil conduct. Article 3 The meanings of the following terms in these Measures are:

(1) Credit reporting institutions refer to legal entities established with the approval of these Measures, which collect personal credit information from commercial banks and other users of personal credit information and provide personal credit information consultation and rating services;

(2) Personal credit reporting refers to the activities of credit reporting institutions to collect and store personal credit information scattered in commercial banks and relevant social departments by signing agreements with commercial banks and other information providers to form a personal credit information database;

(3) Personal credit rating refers to the activities of credit rating agencies to evaluate the collected personal credit information according to the credit rating standards of credit rating agencies;

(4) Personal credit information refers to personal business credit records and other information that may affect the judgment of personal credit status. Article 4 Credit institutions, information providers, users of personal credit information and their staff members shall keep confidential the personal information obtained in the process of collecting and using personal credit information, and shall not disclose it to third parties, and shall not use the personal credit information obtained beyond the scope of use and job responsibilities stipulated in these Measures. Article 5 Units engaged in personal credit investigation and rating business shall be approved by the Shenzhen Municipal People's Government and Shenzhen Central Sub-branch of the People's Bank of China, and go through industrial and commercial registration procedures according to law.

Individuals are not allowed to engage in personal credit investigation and rating business. Article 6 This Municipality shall set up a supervision committee for personal credit information industry, which shall be responsible for the supervision and management of personal credit information industry.

The composition, responsibilities and rules of procedure of the personal credit investigation and rating supervision committee shall be formulated separately by the Municipal People's Government. Article 7 A credit reporting agency shall obtain the consent of the person concerned when collecting personal credit information, except for personal credit information disclosed according to law. Article 8 Personal credit information collected by credit reporting agencies is limited to the following information that may affect personal credit status:

(1) Personal identity: name, gender, date of birth, ID number, domicile, residence, marital status, family members, income, work unit, occupation, education, etc. ;

(2) Commercial credit records: personal loan and repayment records in commercial banks, personal credit card use and other related records, other credit behavior records in commercial banks, and credit transaction records between individuals and other commercial institutions;

(3) Social public information records: records of individual tax payment, participation in social insurance and personal property status and changes;

(4) Special records: records involving civil, criminal, administrative litigation, administrative punishment, etc. that may affect personal credit status. Article 9 Where a credit reporting agency agrees to collect personal credit information, it shall collect personal credit information from the information providing unit by means agreed with the information providing unit.

The agreement signed between the credit reporting agency and the information providing unit shall be reported to the Municipal Personal Credit Reporting and Rating Supervision Committee for the record.

The information provider shall provide personal credit information for the credit reporting agency in accordance with the agreement.

Information providers are responsible for the authenticity of the information they provide. Article 10 A credit reporting agency shall collect personal credit information objectively and fairly, maintain the original integrity of the information provided by the information provider, and shall not selectively collect personal credit information. Article 11 A personal credit rating report shall be made objectively and fairly in accordance with the credit rating standards of credit reporting agencies.

The credit rating standards of credit reporting agencies shall be reported to Shenzhen Personal Credit Report and Rating Supervision Committee for approval. Twelfth credit institutions can provide personal credit consulting services to the following objects:

(1) A financial institution that accepts my application for financial business or a commercial institution that has credit dealings with me;

(2) Other natural persons or legal persons authorized by me;

(3) Judicial organs and tax authorities that conduct investigations ex officio;

(four) other organs as prescribed by laws and regulations. Article 13 Credit reporting agencies shall provide personal credit consulting services on the principle of paid use, but no fees shall be charged under any of the following circumstances:

Judicial organs and tax authorities conduct investigations according to their functions and powers;

(two) other users who are not allowed to charge according to laws and regulations.

The charging standards for services provided by credit reporting agencies shall be reported to the municipal price department for approval. Article 14 The use of personal credit information by users as stipulated in Items (1) and (2) of Article 12 of these Measures is limited to understanding personal credit status.

Users are prohibited from using the obtained personal information to engage in activities other than understanding personal credit status. Fifteenth credit institutions should provide personal credit information inquiry.

Individuals can use their resident ID cards to check personal credit information with credit reporting agencies. Article 16 If an individual thinks that his credit information is wrong, he may apply to a credit reporting agency for correction.

After receiving an individual's application for correction, the credit reporting agency shall check it. Inconsistent with the original information provided by the information provider, it shall be corrected immediately; If it is consistent with the original information provided by the information provider, it shall inform me to apply to the information provider for correction.

An individual shall submit a written application for correction of information to the information provider within 5 working days from the date of notification by the credit reporting agency, and the information provider shall make a written reply within 10 working days from the date of receiving the application for correction of personal information.
