Regulations of Chongqing Municipality on Human Resources Market

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Employment Promotion Law of People's Republic of China (PRC), the Provisional Regulations on Human Resources Market and other relevant laws and administrative regulations, combined with the actual situation of this Municipality, with a view to regulating human resources market activities, cultivating and developing the human resources market, promoting the rational flow and optimal allocation of human resources, and promoting employment and entrepreneurship. Article 2 These Regulations shall apply to job hunting, recruitment and human resources services through the human resources market within the administrative area of this Municipality, as well as the cultivation, supervision and management of the human resources market.

Where laws, administrative regulations and the State Council have other provisions on job hunting, recruitment and human resources services, those provisions shall prevail. Article 3 The human resources service institutions mentioned in these Regulations include public welfare human resources service institutions and business human resources service institutions.

Public human resources service institutions refer to public employment and talent service institutions established by the people's governments of cities, districts and counties (autonomous counties). Operating human resources service institutions refer to institutions established in accordance with the law to engage in human resources service business activities. Article 4 The construction of human resources market shall conform to the strategic positioning and development goals of this Municipality, and adhere to the principles of government guidance, market operation, scientific planning, rational distribution and standardization and order.

Human resources market activities should follow the principles of legality, fairness and good faith.

The supervision and management of human resources market should follow the principles of legality, fairness and efficiency. Article 5 The people's governments of cities, districts and counties (autonomous counties) shall incorporate the construction of human resources market into the national economic and social development plan, establish a unified, open, competitive and orderly human resources market system, give play to the decisive role of the market in the allocation of human resources, improve the human resources development mechanism, strengthen the application of big data and intelligent technologies in the human resources market, stimulate human resources innovation and create entrepreneurial vitality, and promote the prosperity and development of the human resources market.

Township people's governments and sub-district offices shall assist in the basic work of human resources market cultivation, service, supervision and management. Article 6 The municipal administrative department of human resources and social security shall be responsible for the overall planning and comprehensive management of the city's human resources market.

The administrative departments of human resources and social security of counties (autonomous counties) shall be responsible for the management of human resources market within their respective administrative areas.

City, county (Autonomous County) people's government development and reform, education, public security, finance, commerce, taxation, market supervision and management, data resources management and other departments to do a good job in the management and service of human resources market within the scope of their respective duties. Article 7 The Municipal People's Government shall strengthen the standardization of human resources services, establish and improve the system of implementation, publicity and evaluation of human resources service standards, and give play to the leading role of human resources service standards in industry guidance, service standardization, institutional self-discipline and market supervision.

City, county (Autonomous County) human resources and social security administrative departments responsible for the promotion and application of human resources service standards. Article 8 Human resources service industry associations shall, in accordance with laws, regulations, rules and their articles of association, formulate industry self-discipline norms, promote the construction of industry integrity, improve service quality, guide and supervise members' human resources service activities, safeguard members' legitimate rights and interests according to law, reflect members' demands, and promote fair competition in the industry.

The administrative departments of human resources and social security of cities, counties (autonomous counties) shall strengthen the guidance and supervision of trade associations. Chapter II Cultivation of Human Resources Market Article 9 The people's governments of cities, districts and counties (autonomous counties) shall establish a human resources flow allocation mechanism featuring macro-control by the government, fair competition in the market, independent employment by units and individuals, and honest service by human resources service institutions, so as to promote the free and orderly flow of human resources.

The people's governments of cities, districts and counties (autonomous counties) shall guide and promote the rational flow of human resources among organs, enterprises, institutions, social organizations and between different regions, and encourage and support the flow of talents to hard and remote areas and grassroots units.

No department or unit may, in violation of state regulations, set conditions to restrict the flow of human resources in terms of household registration, region and identity.

The flow of human resources shall comply with the provisions of laws and regulations on service period, employment restrictions and confidentiality. Article 10 The people's governments of cities, districts and counties (autonomous counties) comprehensively apply policies such as industry, land, finance, finance, taxation, employment and social security to promote the construction of human resources market, encourage the establishment of human resources service industry development funds, support the development of human resources service institutions, and improve the development level of human resources service industry.

Encourage social forces to participate in the construction of human resources market. Article 11 The people's governments of cities, districts and counties (autonomous counties) shall establish a catalogue of government-purchased human resources services, and support operating human resources service institutions to provide public welfare human resources services in the form of government-purchased services.

Operating human resources service institutions that provide public welfare human resources services such as free job introduction and employment practice may apply for relevant financial subsidies in accordance with the relevant provisions of the state and this Municipality. Article 12 The people's governments of cities, districts and counties (autonomous counties) shall establish an information system on the supply and demand of human resources market covering urban and rural areas and various industries, improve the market information release system, and realize information sharing among relevant government departments, employers, human resources service institutions and industry associations.

The municipal human resources and social security department shall establish relevant standards for the supply and demand information system of the human resources market, organize the human resources and social security departments of counties (autonomous counties) to do a good job in online collection, classification, analysis and release of human resources information, provide services for job recruitment, and promote the development, utilization and rational allocation of human resources.
