The marriage registration procedure is mainly composed of application, examination and registration.

(1) application

Couples who meet the requirements for marriage registration can apply for marriage registration at the marriage registration office where one party is located with relevant certificates, certification materials and registration photos, and fill in the declaration required for applying for marriage registration on the spot.

The preparation materials for applying for marriage registration depend on the specific circumstances. For example, China citizens applying for marriage registration in China must hold their valid ID card, household registration book, marriage examination certificate, single spouse certificate and a signed statement that they are not related to each other. Those who apply for divorce and remarriage must also bring a divorce certificate.

Foreigners, such as foreigners living in China, overseas Chinese, etc. To apply for marriage registration in China, you must hold your valid passport or other identification, nationality certificate, foreigner's residence permit issued by the public security organ or valid temporary residence permit in China, and the certificate of marital status issued by the domestic notary office certified by the Ministry of Foreign Affairs (or the authorized organ of the Ministry of Foreign Affairs) and the Chinese embassy or consulate in that country.

What procedures and documents do you need for divorce?

The divorce registration process is as follows:

(1) application

If the husband and wife divorce voluntarily, the two parties who need divorce shall sign a divorce agreement according to the regulations, jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:

1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;

(2) Accept

After the documents and certification materials submitted by the parties have been verified in the first instance, a receipt for accepting the divorce registration application will be issued. If there are differences with the conditions of divorce registration application, it will not be accepted, and if necessary, a Notice of Rejection of Divorce Registration Application will be issued at the request of the parties concerned.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for accepting the application for divorce registration to the parties concerned, any party who does not want to divorce can withdraw the previously submitted application for divorce registration from the divorce registration office that accepts the application for divorce registration with relevant materials, such as his valid identity card and the receipt for accepting the application for divorce registration (written explanation is required if the receipt is lost), and fill out the Application for Withdrawal of Divorce Registration according to regulations. After verification, the marriage registration authority shall issue the Confirmation of Withdrawal of Divorce Registration to the parties concerned, and the application for divorce registration, the application for withdrawal of divorce registration and the confirmation of withdrawal of divorce registration (stubs) shall be filed together. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, it shall be deemed that both parties are unwilling to divorce and withdraw their application for divorce registration.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date of the period), both parties shall present relevant certificates and materials, such as photos, marriage certificates, identity cards or passports, divorce agreements, etc. , to the marriage registration office, according to the provisions of the divorce certificate. The marriage registration authority shall conduct an examination according to the provisions of the Marriage Registration Code. Those who do not meet the conditions for divorce registration shall not go through the divorce registration formalities. If a party requests to issue a notice not to register for divorce, the marriage registration authority shall issue it.

(5) Registration (certification)

The marriage registration authority shall, in accordance with the provisions of the marriage registration work norms, register the parties concerned and issue a divorce certificate.
