Legal consultation on house demolition

Legal analysis: 1. The compensation fee or replacement fee of the demolished house is mainly used to compensate the loss of the owner of the demolished house. Generally, it is classified according to the structure of the demolished house and the depreciation degree of the house, and calculated according to the unit price of square meters;

2. The relocation turnover compensation fee is used to compensate the residents of the demolished houses for temporary housing or temporary residence, so as to cope with the housing problems caused by the demolition. Turnover compensation fees are generally subject to temporary living conditions, and monthly subsidies are given according to the residents of the demolished houses.

3. Reward compensation fees are generally used to encourage the demolished people to actively cooperate with the house demolition or voluntarily give up some rights they can enjoy, such as the demolished people voluntarily moving to the suburbs or not requiring the demolition units to resettle their houses.

Legal basis: Article 17 of the Regulations on Expropriation and Compensation of Houses on State-owned Land. The compensation given by the people's government of the city or county that made the decision on house expropriation includes:

(1) Compensation for the value of the expropriated house;

(two) relocation compensation and temporary resettlement caused by the expropriation of houses;

(3) Compensation for losses caused by expropriation of houses.

The people's governments at the city and county levels shall formulate measures for subsidies and incentives, and give subsidies and incentives to the expropriated people.
