The term "dust pollution" as mentioned in these Regulations refers to the pollution to the atmospheric environment caused by the production, construction, demolition of buildings (structures), transportation and storage of materials, cleaning and greening of public places and roads, and dust particles produced by mud exposure. Article 3 The prevention and control of dust pollution shall follow the principles of government leading, departmental supervision, subject self-discipline, public supervision and investigation of pollution responsibility. Article 4 All units and individuals have the obligation to prevent dust pollution and protect the environment. Units and individuals that have the right to report dust pollution; Have the right to report and complain to the local government, competent departments and their staff for failing to perform their duties according to law. Article 5 The Municipal People's Government is responsible for organizing and leading the prevention and control of dust pollution in this Municipality, establishing a joint meeting system for dust pollution prevention and control, establishing a working mechanism of overall coordination, long-term management and information sharing, formulating an overall work plan, organizing and implementing the response to heavy polluted weather, and coordinating the prevention and control of dust pollution across regions.
County (city, district) people's government is responsible for the prevention and control of dust pollution in this area, formulate specific work plans, organize the implementation of grid management of environmental supervision, and organize the response to heavily polluted weather.
Township people's governments and sub-district offices shall cooperate with the competent departments to do a good job in the prevention and control of dust pollution in their respective jurisdictions and implement the grid management responsibility of environmental supervision; Report to the supervision and management department in time and cooperate with the investigation and punishment of illegal acts.
Communities, villagers' committees and residents' committees shall assist the competent departments, supervision and management departments, township people's governments and sub-district offices to do a good job in the prevention and control of dust pollution, and timely discover, discourage and report dust pollution in the region. Article 6 The ecological environment department is the competent department for the prevention and control of dust pollution, and coordinates and urges other supervision and management departments to perform their duties for the prevention and control of dust pollution; Responsible for the supervision of dust pollution in enterprise material yard (warehouse); Responsible for monitoring dust pollution and atmospheric environmental quality, and regularly publish monitoring information.
Housing and urban-rural construction departments are responsible for the supervision and management of dust pollution prevention and control in municipal infrastructure construction, housing construction, building (structure) demolition and other construction projects.
The urban management department is responsible for the supervision and management of the prevention and control of dust pollution such as urban roads, landfill sites and construction waste disposal sites; Responsible for the supervision and management of dust prevention measures for bulk muck, garbage, coal, gravel and other transport vehicles that are easy to be scattered and scattered; Responsible for the supervision and management of the prevention and control of dust pollution in the storage places of coal, cement, lime, sandstone and other materials that are prone to dust.
The traffic administrative department of the public security organ shall, jointly with the urban management department, be responsible for setting the driving route, no-go route, restricted area and time of materials transport vehicles that are prone to dust, such as muck and construction waste; Responsible for the supervision and management of dust prevention measures for transport vehicles that are easy to spill and float out of the city.
The traffic department is responsible for the supervision and management of the prevention and control of dust pollution in the construction of highway bridges and supporting projects; Responsible for the supervision and management of dust pollution prevention and control in logistics parks, stations and dock yards; Responsible for the supervision and management of the prevention and control of dust pollution in national highways, provincial highways, county and township highways and village roads.
The water conservancy department is responsible for the supervision and management of river regulation and dust pollution prevention and control of water conservancy projects.
Natural resources and planning departments are responsible for the supervision and management of dust pollution prevention and control in open-pit mining areas.
Other relevant departments shall, within the scope of their respective duties, do a good job in the supervision and management of dust pollution prevention and control. Seventh departments responsible for the supervision and management of dust pollution prevention and control shall establish a daily inspection system and strengthen daily supervision and on-site inspection. Article 8 The departments responsible for the supervision and management of dust pollution prevention and control violate the provisions of these regulations, and under any of the following circumstances, the people's governments at or above the county level or the supervisory organs shall order them to make corrections, and the main persons in charge and the persons directly responsible shall be punished according to law:
(1) Failing to perform the duties of preventing and controlling dust pollution or failing to investigate and deal with it according to the regulations after receiving the report;
(2) Failing to implement emergency treatment of heavily polluted weather in accordance with regulations;
(three) the daily inspection system has not been established or the daily supervision and on-site inspection have not been carried out according to the inspection system;
(four) other circumstances that should be investigated for responsibility. Article 9 Relevant units and individuals shall take corresponding dust prevention measures according to the emergency plan and emergency response level initiated by the people's governments at or above the county level.
In violation of the provisions of this article, the supervision and administration department of the people's government at or above the county level shall impose a fine of more than 1 10,000 yuan and less than10,000 yuan. Article 10 All kinds of production and operation sites and construction sites listed as key dust pollution sources shall install video monitoring and on-line dust monitoring systems at the main dust producing points, and connect with the supervision and management departments and ecological and environmental departments of the people's governments at or above the county level to ensure their normal operation and real-time data transmission.
In violation of the provisions of this article, the supervision and administration department of the people's government at or above the county level shall order it to make corrections and impose a fine of 1 10,000 yuan or more10,000 yuan or less; Refuses to correct, shall be ordered to suspend production for rectification.
