The term "traffic construction projects" as mentioned in these Regulations refers to the new construction, reconstruction and expansion projects of highways, waterways and their ancillary facilities, as well as other traffic construction projects determined by the provincial people's government; The term "quality and safety work" as mentioned in these Regulations refers to quality and safety production and its supervision and management. Article 3 The quality and safety work of traffic construction projects shall follow the principles of safety first, prevention first, quality first, graded responsibility and territorial management, and establish a mechanism of employees' responsibility, employees' participation, government supervision, industry self-discipline and social supervision.
No unit or individual may, in violation of laws, regulations and technical standards, require the construction, survey, design and construction units of traffic construction projects to shorten the survey and design period and construction period agreed in the contract. Article 4 Local people's governments at or above the county level shall strengthen their leadership over the quality and safety of traffic construction projects, establish a coordination mechanism for preventing and handling serious accidents, urge relevant departments to perform their supervisory duties according to law, strengthen the construction of quality and safety supervision teams for traffic construction projects, and incorporate the required funds into the fiscal budget at the same level.
The transportation departments of the local people's governments at or above the county level shall be in charge of the quality and safety supervision of traffic construction projects within their respective administrative areas in accordance with their duties and powers; Other relevant departments of the local people's governments at or above the county level shall, in accordance with their respective duties, do a good job in the quality and safety supervision of traffic construction projects.
The transportation departments of local people's governments at or above the county level may entrust the traffic construction quality and safety supervision institutions to supervise the quality and safety of traffic construction projects. Business units shall obtain corresponding qualification certificates according to law, establish and improve the project quality and safety assurance system, strengthen the project quality and safety management and risk prevention and control measures, implement mandatory standards and relevant technical specifications for project construction, protect resources and ecological environment, and assume corresponding responsibilities for project quality and safety within the design service life of the project. Employees shall obtain corresponding qualification certificates according to law and hold relevant certificates.
The term "business units" as mentioned in these Regulations refers to the units engaged in the construction, survey, design, construction, supervision and testing of traffic construction projects.
Other units engaged in traffic construction engineering consulting, bidding agency and safety assessment. Services shall be provided in accordance with relevant laws, regulations and contracts, and shall be responsible for the quality of services. Article 6 Trade associations related to traffic construction shall strengthen industry self-discipline, improve industry credit system, guide employees to compete in an orderly manner and standardize their operations, organize quality and safety publicity, education and training, and promote standardization of construction, management and safety production. Article 7 In the field of traffic construction engineering, encourage and support business units, societies, scientific research units and other relevant organizations and individuals to carry out research and popularization of new technologies, new processes, new materials and new equipment for quality and safety management, strengthen informatization and standardization construction, and improve the quality and safety management level of construction projects. Chapter II Responsibilities of the Construction Unit Article 8 The construction unit shall be mainly responsible for the quality and safety management of traffic construction projects. The construction unit shall scientifically determine and implement a reasonable construction period, establish and improve the project quality and safety management system, set up a quality and safety management department according to law or equip full-time quality and safety management personnel.
If the construction unit does not have the project construction management ability stipulated by the state and this province, it shall entrust a qualified construction agent to manage the project construction, and the construction agent shall bear the management responsibilities of project quality, safety, investment, time limit for a project in accordance with the relevant provisions and the contract. Article 9 The tender documents for traffic construction projects shall specify the requirements for safe production according to law, and the construction tender documents shall also specify the extraction standards for safe production expenses. Construction safety production costs shall not be used as competitive quotations, and the extraction ratio shall not be lower than the standards prescribed by the state. For long-span bridges, underwater tunnels and other projects with great technical difficulties and high safety risks, the extraction ratio should be increased accordingly. Article 10 The construction unit shall establish a safety evaluation system for traffic construction projects, organize safety risk evaluation in the design stage and overall risk evaluation of construction safety in accordance with relevant regulations, and take the evaluation and evaluation results as an important basis for determining the design and construction schemes respectively. Article 11 The construction unit shall review the safety production conditions of the construction unit, strengthen the daily safety supervision of construction projects, establish and improve the system of investigation and management of hidden dangers in production safety and emergency plans, strengthen monitoring, forecasting and early warning, discover and eliminate hidden dangers in time, and strengthen plan management and emergency drills. Article 12 The construction unit shall specify the project quality and safety objectives, quality and safety responsibilities and requirements in the contracts with business units such as survey, design, construction and supervision, strengthen the performance management of business units, urge the main project leaders of business units such as construction, supervision, test and detection to perform their duties, organize quality and safety inspections, and urge relevant units to rectify quality and safety issues in a timely manner.
