Regulations of Fujian Province on the Development of Green Buildings

Chapter I General Provisions Article 1 In order to implement the new development concept, promote the high-quality development of the construction industry, reduce carbon emissions and improve the living environment, these Regulations are formulated in accordance with the People's Republic of China (PRC) Building Law, the People's Republic of China (PRC) Energy Conservation Law, the Civil Building Energy Conservation Regulations and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the planning, design, construction, operation, transformation, technology application and other activities related to green buildings within the administrative area of this province, as well as the supervision, management, guidance and encouragement of green building activities.

The term "green building" as mentioned in these Regulations refers to high-quality buildings that save resources, protect the environment, reduce pollution, provide people with healthy, applicable and efficient use space, and maximize the harmony between man and nature. Article 3 The development of green buildings shall follow the principles of government guidance, overall planning, resource conservation and local conditions. Article 4 The local people's governments at or above the county level shall incorporate the green building work into the national economic and social development plan, establish and improve the assessment mechanism, and comprehensively promote the development of green buildings. Fifth local people's governments at or above the county level shall be responsible for the guidance, supervision and management of green building activities within their respective administrative areas.

The relevant departments in charge of development and reform, natural resources, industry and informatization, finance, ecological environment, market supervision, urban management, science and technology of local people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the development of green buildings. Article 6 Green buildings are divided into four grades according to the technical application level: basic, one star, two stars and three stars.

The competent department of housing and urban and rural construction of the provincial people's government shall, in accordance with the national standards and the actual situation of this province, formulate local standards related to green buildings, actively cultivate and develop group standards, and guide enterprises to formulate higher enterprise standards. Seventh to encourage and support the research, development, demonstration, promotion and publicity and training of green building technology, and promote the technological innovation and knowledge popularization of green building. Chapter II Planning, Design and Construction Article 8 The competent department of housing and urban and rural construction of the provincial people's government is responsible for formulating the guidelines for the preparation of special planning for green buildings in this province. The competent department of housing and urban-rural construction of the people's government at the city or county level divided into districts shall, jointly with relevant departments such as natural resources, organize the preparation of special plans for green buildings in their respective administrative areas, and announce them to the public after approval by the people's government at the corresponding level.

The green building special planning shall determine the green building grade and layout requirements of new civil buildings, and define the development goals, key development areas, prefabricated buildings, fully decorated finished houses, green transformation of existing buildings and application of green building materials.

The special planning of green building should be based on the national economic and social development planning, follow the overall planning of land and space, and coordinate with the relevant special planning. Ninth new civil buildings within the scope of urban construction land should be built in accordance with the basic standards of green buildings.

Government-invested or government-invested public buildings with a construction area of more than 20,000 square meters shall be built in accordance with the green building standards of more than one star. Encourage other civil buildings to build in accordance with the green building standards of more than one star.

Cities with districts can implement higher green building standards in light of local conditions. Tenth new civil construction project feasibility study report or project application report shall specify the requirements of green building grade, clear the project selection of green building technology, energy saving and emission reduction methods. Article 11 When transferring or allocating state-owned land, the competent department of housing and urban and rural construction shall put forward relevant indicators such as green building grade requirements to the competent department of natural resources, and the competent department of natural resources shall incorporate them into the announcement on the transfer of state-owned land use rights, the transfer contract or the decision on the allocation of state-owned construction land. Twelfth construction units in the project consultation, design, construction, supervision, materials and equipment procurement and related bidding activities, should be clear about the green building grade requirements of construction projects, and organize their implementation. Thirteenth design units should design the project plan and construction drawing according to the requirements of green building grade, and prepare a special article on green building.

The examination institution of construction drawing design documents shall examine whether the construction drawing design documents meet the requirements of green building grade; Do not meet the requirements, shall not issue a certificate of examination. Fourteenth construction units shall prepare a special construction plan for green buildings, organize construction according to the requirements of construction drawings and design documents and green building grades, and shall not use building materials, building components and facilities that do not meet the requirements.

The construction unit shall take measures to reduce energy consumption, construction waste, noise pollution, dust prevention, emission reduction and environmental protection. Fifteenth supervision units shall prepare a special supervision plan for green buildings, and supervise whether the construction units carry out construction in accordance with the construction drawing design documents and the requirements of green building grades.

If the supervision unit finds that the construction unit is not in accordance with the construction drawing design documents and the requirements of green building grade, it shall require it to make corrections; Refuses to correct, the supervision unit shall promptly inform the construction unit, and report to the relevant competent departments. Article 16 When organizing the project completion acceptance, the construction unit shall conduct special inspection on whether the building meets the requirements of green building grade and put forward inspection opinions; Do not meet the requirements, shall not pass the final acceptance.

The competent department of housing and urban and rural construction of the local people's government at or above the county level shall supervise and inspect the quality of green building projects, and if it is found that it does not meet the requirements, it shall order the construction unit to reorganize the acceptance.
