What procedures and materials are needed for marriage registration?
The current marriage registration process can be roughly divided into three links: application, examination and registration.
(1) application
Couples who meet the conditions of marriage registration can apply for marriage registration at the marriage registration office where one party is located with relevant documents, certification materials and registration photos, and fill in the Declaration on Application for Marriage Registration and other documents.
The preparation materials for marriage registration application depend on the specific circumstances. Mainland residents who apply for marriage registration must hold their own identity certificate, household registration certificate, marriage examination certificate, single spouse certificate and a signed statement that they are not related to each other. If it is a divorce, you need to hold a divorce certificate or a divorce certificate to apply for remarriage.
Foreigners, such as foreigners living in China, overseas Chinese, etc. To apply for marriage registration in China, you must hold your valid passport or other identification, nationality certificate, foreigner's residence permit issued by the public security organ or valid temporary residence permit in China, and the certificate of marital status issued by the domestic notary office certified by the Ministry of Foreign Affairs (or the authorized organ of the Ministry of Foreign Affairs) and the Chinese embassy or consulate in that country.
(2) Review
The marriage registration office will examine the application of the parties to find out whether the documents and certificates meet the conditions for marriage. If the application materials submitted by the parties are unknown, the marriage registration authority will ask the parties and ask them to provide relevant certification materials when necessary.
(3) Registration and licensing
If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and then issue a marriage certificate; For divorced people, the marriage registration office will cancel their divorce certificates; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.
What procedures and documents do you need for divorce?
The divorce registration procedure is as follows:
(1) application
If the husband and wife divorce voluntarily, the two parties who need divorce shall sign a divorce agreement according to the regulations, jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:
1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;
2. Relevant valid identity documents that meet the requirements, such as household registration book, identity card, Hong Kong, Macao and Taiwan pass, passport, etc. ;
3. An application for divorce registration filled in at the marriage registration office.
(2) Accept
The staff of the marriage registration office will conduct a preliminary examination of the application materials submitted by both husband and wife as required. After the application materials submitted by the parties are verified by the staff in the first instance, the parties will receive a "Receipt of Acceptance of Divorce Registration Application". Do not meet the application conditions, will not be accepted. If the parties request to issue a notice of not accepting the application for divorce registration, they shall issue it.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for accepting the application for divorce registration to the parties concerned, any party who does not want to divorce can bring his valid identity certificate and the receipt for accepting the application for divorce registration (if he loses it, he can not provide it, but he needs to explain the situation in writing), and ask the marriage registration office that accepts the application for divorce registration to withdraw the application for divorce registration, and fill out the application for withdrawal of divorce registration in person. After verification by the staff of the marriage registration office, a "Confirmation Letter for Withdrawing the Application for Divorce Registration" will be issued. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday will be the expiration date of the period), both parties shall apply for divorce certificates at the marriage registration office with photos, marriage certificates, ID cards or passports, divorce agreements and other relevant supporting materials. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. For those who do not meet the requirements for divorce registration, divorce registration procedures are not provided, and if the parties request to issue a notice of not handling divorce registration, they shall issue it.
(5) Registration (certification)
The marriage registration authority shall, in accordance with the relevant provisions, register and issue divorce certificates.
