What procedures and materials are needed for marriage registration?
The current marriage registration process can be roughly divided into three links: application, examination and registration.
(1) application
Couples who meet the requirements of marriage registration can apply for marriage registration at the marriage registration office where one party is located with relevant documents, certification materials and registration photos, and fill out the Declaration of Application for Registration according to the guidance of the staff.
Different people have different requirements on the documents and supporting materials for applying for marriage registration. For example, when applying for marriage registration in China, China citizens need to hold their valid ID card, household registration book, marriage inspection certificate, single spouse certificate and a signed statement that they are not related to each other. If they are divorced, they should also bring divorce papers.
Foreigners (including foreigners residing or temporarily residing in China, overseas Chinese, and foreigners residing in China) applying for marriage in China must hold their valid passports or nationality certificates, valid residence permits for foreigners, and certificates that can effectively prove their marital status.
(2) Review
The marriage registration office will examine the application of the parties to find out whether the documents and certificates meet the conditions for marriage. In case of doubt, the marriage registration authority shall ask the parties concerned and ask them to provide relevant materials when necessary.
(3) Registration (Licensing)
The marriage registration authority will register eligible couples and issue marriage certificates; For divorced people, the marriage registration office will cancel their divorce certificates; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.
What procedures and documents do you need for divorce?
The divorce registration procedure is as follows:
(1) application
If both parties voluntarily divorce, they shall sign a divorce agreement in accordance with the provisions, apply to the marriage registration authority (which has jurisdiction), and provide the following documents and supporting materials:
1, marriage certificate of both men and women;
2. Valid and compliant identity documents, such as household registration book, ID card, Hong Kong, Macao and Taiwan pass, passport, etc. ;
3. Fill in the application for divorce registration.
(2) Accept
The staff will conduct a preliminary examination of the materials provided by the parties in accordance with the regulations. After the documents and certification materials submitted by the parties have been verified in the first instance, a receipt for accepting the divorce registration application will be issued. Those who do not meet the application conditions will not be accepted, and the registrar may issue a notice that the divorce registration application will not be accepted.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for accepting the application for divorce registration to the parties concerned, any party unwilling to divorce can bring his valid identity certificate and the receipt for accepting the application for divorce registration (if the receipt is lost, it is not required to provide it, but a written explanation is required) to the marriage registration office that accepts the application for divorce registration, withdraw the application for divorce registration, and fill in the application for withdrawal of divorce registration as required. After verification by the marriage registration authority, a Confirmation Letter for Withdrawing the Application for Divorce Registration will be issued. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply for a divorce certificate at the marriage registration office, the application for divorce registration shall be deemed to have been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date), both parties shall bring relevant documents and materials, such as divorce agreement, marriage certificate, two recent bareheaded photos of two-inch singles, passports, passes, ID cards, etc. , apply for a divorce certificate at the marriage registry. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. Do not meet the conditions for divorce registration, do not provide divorce registration procedures. If a party requests to issue a notice not to register for divorce, it shall issue it.
(5) Registration (certification)
The marriage registration authority shall carry out relevant registration in accordance with the relevant provisions and issue divorce certificates to the parties.
