The basic contents of the general principles of the Measures for Supervision and Management of Bidding issued by the Housing and Urban-Rural Development Department of Henan Province;
Article 1 In order to further standardize the bidding activities of housing construction and municipal engineering projects in this province, safeguard public safety and the legitimate rights and interests of bidding parties, ensure project quality and safety, and improve investment efficiency, according to the Construction Law of People's Republic of China (PRC), the Bidding Law of People's Republic of China (PRC) and the Implementation Regulations of the Bidding Law of People's Republic of China (PRC) (hereinafter referred to as the Bidding Law).
Article 2 These Measures shall apply to the survey, design, construction and supervision of various housing construction and municipal engineering projects within the administrative area of this province, as well as the supervision and management of the bidding activities of goods and services related to engineering construction.
The term "housing construction project" as mentioned in these Measures refers to all kinds of housing construction and its ancillary facilities and their supporting lines, pipelines, equipment installation and indoor and outdoor decoration projects.
The term "municipal engineering projects" as mentioned in these Measures refers to the civil works, pipelines, pipelines and equipment installation works of urban roads, bridges and tunnels, public transportation (including subway light rail and manned ropeway), water supply, drainage, gas, heat, rivers, squares, gardens, sanitation, sewage discharge and treatment, garbage disposal, flood control, underground public facilities and their ancillary facilities.
The goods related to project construction as mentioned in these Measures refer to the equipment and materials that constitute a part of the project and are necessary to realize the basic functions of the project.
The services related to project construction as mentioned in these Measures refer to the survey, design and supervision services required for the completion of the project.
Article 3 The bidding activities for housing construction and municipal engineering projects shall follow the principles of openness, fairness, impartiality, honesty and credibility.
Fourth provincial housing and urban construction departments shall supervise and manage the bidding activities of various housing construction and municipal engineering projects in the province according to law.
The competent departments of housing and urban construction at or above the county (city) shall supervise and manage the bidding activities of various housing construction and municipal engineering projects within their respective responsibilities. The tendering and bidding supervision and management institution (hereinafter referred to as the tendering and bidding supervision institution) is responsible for the specific work.
Article 5 The functions of bidding supervision institutions at all levels are:
(a) to supervise the bidding of projects that must be tendered according to law in accordance with the statutory organizational forms, bidding methods and prescribed procedures;
(two) to supervise the preparation of pre-qualification documents and bidding documents according to the requirements;
(3) Supervising the establishment of a qualification examination committee or a bid evaluation committee according to law;
(four) supervision of the qualification review committee and the bid evaluation committee to recommend pre-qualified applicants, candidates for winning the bid or directly determine the winning bidder and other bid evaluation activities;
(five) to supervise the whole process of bidding for the record as required;
(six) to supervise the signing, filing and performance of contracts;
(seven) dynamic management of bid evaluation experts and bidding agencies according to law;
(eight) to investigate and deal with illegal acts in bidding activities according to law;
(nine) other duties that should be performed according to law.
Sixth all kinds of housing construction and municipal engineering projects that must be tendered according to law must enter the local bidding and tendering trading places established according to law for trading.
Tendering and bidding trading places shall establish effective links with legal tender announcement release media, and provide information, consultation, release of tender announcement (prequalification announcement), bidding registration, selection of bid evaluation experts, bid opening, bid evaluation, calibration and publicity services for construction project bidding activities.
Seventh make full use of information network technology, and gradually build a more transparent, unified and efficient engineering transaction information service platform in the province, and gradually establish a unified electronic bidding system in the province to realize the informationization and networking of bidding information release, bidding registration, bid opening and remote bid evaluation.
Article 8 State functionaries are prohibited from illegally interfering in bidding activities in any way.
