First of all, let's take two cases to see how important the prenuptial housing agreement is.
First case
Before marriage, Mr. Zhang and Ms. Wu bought a set of real estate in full as a wedding room, and Mr. Zhang's name was written on the real estate license. Out of trust and care for Mr. Zhang, Ms. Wu did not draw up a prenuptial agreement before marriage, nor did she propose to add her name to the real estate license after marriage. The relationship broke down a few years ago, and the property was owned by Mr. Zhang at the time of divorce. Ms. Wu regretted it.
The second situation
It was Mr. Huang who had a real estate before marriage and lived with Ms. Li after marriage. After consultation, Ms. Li resigned from her job and became a full-time wife. The two sides signed a prenuptial agreement, stipulating that if the divorce is not the fault of the woman, the property belongs to the woman. When she finally divorced, although Ms. Li had no salary income, she kept her residence. It can be seen that the prenuptial real estate agreement can protect the rights and interests of both parties, especially the rights and interests of the relatively weak party.
Then talk about how to draw up the prenuptial real estate agreement. Before marriage, both parties should frankly explain their real estate situation, whose name is on the real estate license, whether they have paid off the purchase price, and whether the other half needs to bear the mortgage after marriage. Discuss rationally and peacefully how to deal with the existing real estate, communicate from the other side's point of view, and be sure to come up with an agreement recognized by both sides.
Finally, when signing, it should be noted that the prenuptial real estate agreement must include the following contents:
1. Property address, apartment type and construction area.
2. Purchase contract amount, purchase contract number and copy of the purchase contract.
3. Who is the owner of the real estate license?
4. Agreed property ownership: owned by the original owner or jointly owned by both parties, and the distribution ratio.
5. Do you need to repay the loan together after marriage?
6. In case of an accident (divorce, death of one party), the owner of the property changes.
7. Signature of both parties and date of signature
It is best to have multiple witnesses sign the prenuptial real estate agreement, and it is even more foolproof if you can go to the notary office for notarization.
