Three. Content of the agreement
(I) Party A's responsibility for production safety management
1. Party A must strictly implement and save the laws, regulations and standards related to safety in production, formulate its own rules and regulations and operating procedures for safety in production, establish and improve the management system for safety in production, implement the requirements of various safety technical measures, and ensure the effective implementation of safety investment in engineering construction.
2. Party A shall provide Party B with the existing technical data required for the construction.
3. The design documents provided by Party A shall meet the safety and health requirements of construction personnel.
4. Party A shall bring the safety supervision and management of Party B's construction site into the unified management within the safety system of the unit, and the emergency rescue plan for production safety accidents must include the contents of Party B's construction safety.
5. Party A shall not ask Party B for requirements that do not meet the laws, regulations and mandatory standards of safety production, and shall not arbitrarily compress the construction period agreed in the contract.
6. Party A shall provide first aid and medical convenience for Party B's work injury.
(II) Party B's responsibility for production safety management
1. Party B shall establish a construction safety guarantee system, implement the post responsibility system for construction safety, implement target management for safety production, and standardize construction site operations.
2. The person in charge of Party B's project shall be a qualified person, responsible for the safety production of mine engineering projects, implementing the rules and regulations of safety production and operating procedures, and ensuring the effective use of safety production inputs.
3. Party B shall designate the person in charge of on-site construction safety, and the number of safety supervisors shall meet the production requirements to supervise the whole process of on-site construction safety.
4. Before the project starts, adhere to the principle of one project and one measure, and report the measures before construction. The construction organization design, operation procedures and safety technical measures approved by the competent department of Party B must be reported to Party A for approval before implementation.
5. Party B shall implement the labor production education and training system, strengthen the safety production education and training for its own personnel, truthfully inform the workplace and post of the risk factors, preventive measures and accident emergency measures, and ensure that employees are familiar with and strictly implement the relevant safety production rules and regulations and safety operation procedures, master the safety operation skills of this post, and have the necessary safety prevention knowledge. Special operations personnel shall be organized by the relevant departments for special training, and can only work at their posts after passing the examination and obtaining the post certificate. The project department shall establish employee training files and report them to Zhonghe Coal Company and supervision company for the record.
6. Party B shall organize employees to participate in safety education and training activities arranged by the construction unit according to their own needs, and bear the related expenses arising therefrom.
8, construction personnel must wear certificates, uniform wear work clothes, in accordance with the provisions, the correct use of qualified safety protection tools, to prevent the occurrence of objects, falling accidents. The safety protection equipment of the construction team must be in place and the safety measures are effective, otherwise the operation shall not be started; The construction unit must submit a copy of the safety production license, the qualification certificate of the project manager and the operation certificate of special type of work to the safety supervision department for the record according to the requirements of Party A. ..
9. Party B shall seriously implement Party A's safety management regulations and strengthen safety management. If Party B violates the regulations or Party A's management regulations, Party A has the right to stop Party B's work and cause certain consequences, and Party B shall bear all the responsibilities.
10. Party A has the right to inspect, stop illegal operations, punish acts violating safety regulations or order the construction team to stop work for rectification at any time. The potential safety hazards discovered by Party A shall be rectified within a time limit, and the rectification shall be reported to Party A in writing in time.
1 1. Party B shall sign a safety production management agreement with a third party operating in the same operation area or the same production system. In the event of a safety accident, the responsible party shall bear the consequences. If both parties have responsibilities, they shall bear corresponding responsibilities according to the size of the responsibilities.
12. In case of disasters and accidents, Party B's personnel, materials and equipment shall unconditionally obey the dispatch, and the expenses incurred shall be negotiated separately after the accident is handled.
13, strictly implement the accident reporting system. When a production safety accident occurs, Party B shall report to the superior department of the unit and Zhonghe Coal Company in a timely manner in strict accordance with the accident reporting procedures and requirements.
14. Other outstanding matters shall be settled by both parties through consultation.
(3), production safety management responsibility punishment
1. After winning the bid, when signing the contract and safety agreement, Party B shall pay 200,000 ~ 200,000 yuan as the safety and quality deposit, and take the safety effect and project quality as the important basis for project acceptance. In case of accidents, unqualified quality or violation of relevant agreements in this agreement due to the management responsibility of the outsourcing unit, a fine shall be imposed according to the regulations, and the fine shall be deducted from its safety and quality guarantee fund.
2. If Party B subcontracts the contracted contract or subcontracts it to a third party in disguised form, it shall be ordered to make corrections within a time limit and be fined 50,000 yuan.
3. If Party B fails to implement, inspect or sign the safety technical measures for construction personnel, it shall be ordered to make corrections within a time limit and fined 200 yuan.
4. If Party A finds out that Party B has arranged untrained employees to work in the well, it will be fined 5000 yuan/person.
5. Party B shall, according to the requirements of the special terms and conditions, send a technician to lead the shift at the construction site in each shift, and it is strictly forbidden to leave the shift empty. 500 yuan was fined for finding one person in the empty class.
6. If Party B's personnel are injured or killed due to Party B's poor management or illegal operation, Party B shall bear the responsibility.
In case of minor injuries, Party B will be fined 20,000 yuan;
In case of serious injury accident and non-personal casualty accident above Grade II, Party B shall dismiss the project manager and the person directly responsible, terminate the labor contract, and impose a fine of100000 yuan/person;
Party B shall dismiss and demote the project manager and the person in charge of the death 1 accident; At the same time, Party B will be fined1100,000 yuan/person.
1 Party A gives Party B the right to terminate the construction contract if two people died in an accident or two people died cumulatively;
7. Party B shall be responsible for the safety management of other personnel entering its operation area and for the casualties of other personnel. The penalty is the same as article 5.
8. If Party A's management is not in place or Party B's personnel are injured or killed due to illegal operation, the responsibility shall be borne by Party A, which shall be implemented according to the document of China Coal Safety 20xx 1.
9. Both Party B's management and Party A's management have the responsibility and obligation to * * * implement various reward and punishment measures specified in China Coal Safety 20xx 1.

Three. Party B's responsibilities:
